For being angry at our neighbours parking?

Hi all!

We live in a terraced house on an estate that has designated parking for those without driveways. Infront and to the left of our house is where our neighbour parks his van as that is his space. However recently he has taken to parking his second car and encouraging his visitors to park infront of it and therefore directly over our pathway. I have asked nicely a few times and its still happening. To me that is clearly an obstruction? We have to go onto our neighbours property to get around. I have had to carry my wheelchair bound friend OVER the gravel on new years eve because his friends had parked there. What route do I need to take with this??

I'd be careful that by allowing them to use the hot tub space for years whether it might mean they can claim adverse possession. I have no idea if this can be applied to a shared row

Not a clue, the nice neighbour on our left has been there a few years and said they had it installed a couple of years back but the houses in the middle were selling up so noone bothered to fight them on it.

Are the spaces marked bays OP? If they are then to those saying it's fine because there are no double yellows, how would you feel if I double parked my partners car at a supermarket blocking the walkway to the shops because there wasn't a double yellow there. Parking where it is allocated should be in the designated space and I can fully see why the OP is annoyed.

They used to be TeresaCrowd but over the years the paint has come off and there are no markings left. I'm not sure what kind of markings were there to start with, whether it was just the house numbers perhaps. That is what is on our parking space.

Do you have a mortgage? I've no idea, but presumably your deeds show you as having the rear access and your house was valued as such. Any chance they could help with legalities of getting it restored (I know, I know, v.v. Unlikely, onus is prob on borrower to maintain it as per deeds or something).

As inconsiderate and annoying as that is, it isn’t illegal I am afraid, and as such the op won’t be able to stop him, the supermarket analogy is very different, it also isnt illegal but the owner of the land ie the supermarket can tell you to move. The op doesn’t own it she can’t,

the right of way is a different issue, I personally would be contacting everyone impacted ie all other neighbours and see if fhey are willing to fight it.

Two birds with one stone here. Get a skip delivered to where he usually parks and fill it with the crap that is blocking up your back alley.

It's only partly on our shared land. Essentially the four houses in the middle have a gate at the back which leads into a shared alley, goes down the back and side of the end house for access. They have taken their fence and moved it back and removed the gate. And moved the fence out to the side so they've taken that bit of land as their own.

With no back access, i'm sure you can imagine how much hassle we had getting our garden landscaped!

Thank god the neighbour on the other side is a delight. He's told us if there's ever a fire at the front of the house we can jump into his garden 🙃🙃🙃🙃

Oh this is worse than the parking issue! They will eventually be able to claim adverse possession which means they legally own that piece of land and you no longer have access at the back. Which will reduce the value of your house. You need a solicitor.

If the management company don’t do anything about all the issues, a group of you can take the management company to court, citing that failures, and a judge should order them to sort it out or lose the rights to manage - they will pull their finger out then

Basically you need hatched lines to be painted there to indicate no parking and it's essentially a turning circle.

It's annoying but he's not really doing anything wrong as nothing says he can't park

If it's shared access at the back and a neighbour has fenced it you can pursue through the court

One of those impacted neighbours is parking guy! Have a feeling he won’t be on my side as they’re buddies!

I wouldn't recommend putting cat food on the offending cars, as it attracts birds and they make a terrible mess, so definitely don't do that.

All I can suggest is what others have said, try to get some support and keep pestering the management company. It's their responsibility, it's what you've paid them for. Speak to the Citizens Advice, if you can't afford a solicitor and if they come down on your side, quote the advice to the management company and make out it was from a solicitor.

Heres the picture, so the black line is the back alley that the four middle terraced houses should be able to use (primarily for taking bins in and out and for emergency access, as you can see all our bins have to live out the front. smells lovely in summer.) Each garden has a gate into that alley. The yellow part circled is the now fenced area that used to be a gate, he has pushed his fence all the way back so no alley now exists past that point. And the other circled area is his gazebo which ironically seems to have fallen down today… karmic justice perhaps or maybe hes got a new one coming 🙄

This is my worry, maybe I just need to put up and shut up and change what I am able to, i.e make the raised beds smaller and reroute the path. Just crap that we have to go to that extent because someone is inconsiderate

I might accidentally scratch his car trying to get a large delivery of some sort up the path or perhaps a friend with a buggy. Not on purpose of course.

I would keep escalating it to the management company. To the extent of solicitors letters if needs be. That might make them take some notice.
I would also be pushing for a white line to be painted in front of the path. Knock on their door every time and keep knocking till they move it.

If all else fails a heavy planter either side of the pathway making parking their difficult. Or park your own car there. When he whinges about being blocked in play him at his own game!

The land grab in the alleyway is far more concerning TBH. I have a similar set up, but it's an older house, there is an actual lane with car access and all of us have garages at the end of our gardens. Someone moved in up the road, and tried the same thing as your neighbour. We are not a private estate area, but the council got involved as the lane backs on to the park and has access at various points.

We were bloody livid at this person's absolute cheek in claiming the land. But he was outdone by the council and has moved. Thankfully. So I know how mad it can make you.

Re the parking, I'm stumped, but fight fire with fire discreetly maybe?

Are you 100% sure the management co don't own the back alley? Might be worth a look at your deeds to confirm ownership vs access. If it is owned by a property company or the managing agent, I'd expect it would be quite a simple job for them to get a very official solicitors letter to give the land back.
