For being angry at our neighbours parking?

Hi all!

We live in a terraced house on an estate that has designated parking for those without driveways. Infront and to the left of our house is where our neighbour parks his van as that is his space. However recently he has taken to parking his second car and encouraging his visitors to park infront of it and therefore directly over our pathway. I have asked nicely a few times and its still happening. To me that is clearly an obstruction? We have to go onto our neighbours property to get around. I have had to carry my wheelchair bound friend OVER the gravel on new years eve because his friends had parked there. What route do I need to take with this??

So the house with the blue door, that's not even his?! Isn't he blocking their street access too?

(and not being pedantic but by demised do you mean designated, not sure if typo or something specific to your estate)

So the house with the blue door behind his car has its own private driveway down the side and a small garden infront so he's not blocking them as their path goes sideways. His door isn't even in the picture, its three doors down...

Can you move your 3 bins so that he can't open his car door if he parks there?

He moves them and normally steps on our land to get out.

It is the most ridiculous set up I have ever seen on an estate. It makes no sense that our car parking space is over the road and the house three doors down is right infront of us. So many thinks about this estate irk me, I can't wait to move!!

Speak to the management company, or the council if they’re in charge of the road. Get them to put a concrete bollard in front of your property to prevent parked cars blocking your access. Or you could put a massive heavy planter full of rocks and soil on the road next to the end of your path. Make it too heavy for him to move.

Yes, they have said its immoveable as it weight at least 1 ton 🙃
They won't budge on moving it.
Estate management company have said its not their land as its demised to all the homeowners who use it so we each own a bit of the access that is now unusable..

There is an easement in our title deeds regarding the shared access and i'm sure theres an easement about unobstructed access to the front of the property.

Bully for them. I’d be tempted to walk through it to enforce my right of way. Presumably it’s only a ton filled up.

Put a fence up - he won't be able to get out of his car so won't be able to park there.

Have you checked whether the van has tax and MOT? if not, report it.

Can you advertise the hot tub on marketplace - free to anyone who can take it away.... it's on your land, so it's yours???

It's only partly on our shared land. Essentially the four houses in the middle have a gate at the back which leads into a shared alley, goes down the back and side of the end house for access. They have taken their fence and moved it back and removed the gate. And moved the fence out to the side so they've taken that bit of land as their own.

With no back access, i'm sure you can imagine how much hassle we had getting our garden landscaped!

Thank god the neighbour on the other side is a delight. He's told us if there's ever a fire at the front of the house we can jump into his garden 🙃🙃🙃🙃

Shouldn't even be something that needs offering!!

That would block in another neighbours car who has a space on the other end and we would never block someone's access. It's like tetris round here...

Apparently its a ton when it's empty 🙃 it's huge with a big gazebo over the top.

While the car at the front is causing you the most problems, it's the hot tub at the back which is likely to cause legal issues if you ever want to sell.

I know, but with the estate management and neighbour refusing to budge, we are going to deal with it legally. Just not sure we have the time, energy and financial freedom to do so at the moment.

Also, the shared alleyway has clearly been used as a dumping ground by the previous owners of the houses (us plus the two houses to the left of us are all new to the estate (last year or two). It is completely impassable and filled with all sorts so we would also need to pay to get that gutted out first.

And do get onto the GardenLaw forum that has lots of advice on this. It is not hopeless.
