For being angry at our neighbours parking?

Hi all!

We live in a terraced house on an estate that has designated parking for those without driveways. Infront and to the left of our house is where our neighbour parks his van as that is his space. However recently he has taken to parking his second car and encouraging his visitors to park infront of it and therefore directly over our pathway. I have asked nicely a few times and its still happening. To me that is clearly an obstruction? We have to go onto our neighbours property to get around. I have had to carry my wheelchair bound friend OVER the gravel on new years eve because his friends had parked there. What route do I need to take with this??

Cold you park in front of the white car in the photo blocking it in? DO t often enough and it should stop the nonsense. I'd definitely complain to the managment company about the blocked rear access.

Perhaps have this moved over to the legal board to see if anyone has any suggestions on what you might be able to do? Have you tried talking to the police non-emergency number as to whether it's some sort of harassment?

For crying out loud you seriously want the OP to call the police because someone is legally parked in an inconvenient way 😂. No wonder public services are struggling so much if people are straight on the phone to police every time something annoys them.

OP, it looks highly annoying what he’s doing and of course he shouldn’t be blocking access. Unfortunately I don’t think there’s much you can do if it’s on a public road. Have you tried asking him to leave sufficient space for access if he’s going to insist on parking there?

Well this sounds like something you need to get resolved.

It seems the issue is partly the raised beds at the front of yours. That car is parked legally, so if he won't move - and he doesn't have to - you might want to look at that bed.

So it looks like he has an extra deep parking space due to the curved shape and he sees the space in front of his car as parking as the tarmac extends. I can see why he feels that way. It's not clear cut tbh. It's not like he is parking on a pavement. It's tricky

True. Is it possible that is his space? Have you seen the deeds? If it's not his, then who does it belong to?

Well this sounds like something you need to get resolved.

We have tried to mediate with the neighbour and also spoke to the management company but neither will budge so the only option is to tackle it legally and we can't afford that at the moment. We have a terminally ill dog who has sadly costs us thousands over the last two months.

I would have to dig them back out again but i'm sure the deeds only showed the back section as his car parking space.

For arguments sake, even if that whole section was his, is that not still an obstruction if he parks right up against the sleepers? The raised beds were there when we bought the house and half of it belongs to our neighbours. On old photos it looks like it used to be turfed and lined with hedges when the estate was built so it would have been even harder to get access.

It's just so frustrating!

Of course it's an obstruction it's ridiculous.

The management company sounds useless. Maybe it's them you should be complaining about? In legal.

He is actually two doors down so no problem getting out of his house...

People regularly walk across our land though including the posties to take shortcuts. That's another annoyance for another day haha.

It’s irritating for sure but as others have pointed out, he’s not actually parked illegally, so there’s no legal recourse. No dropped curb, no double yellow lines, not blocking a driveway etc means that as long as the vehicles are appropriately taxed/MOT/insured then he is able to park there, although it’s inconvenient it’s not illegal.

Your only option would be to speak to him and ask for him to be more considerate and frankly I don’t think it’s a big ask for him to give a bit more thought to his parking, but ultimately if he doesn’t agree then your hands are tied and he’s not actually doing anything wrong.

You must have right of way over that bit of space to access your property. Which should mean he can't block your right of way.

Do your deeds say "right of way" anywhere?

Post on GardenLaw as a right of way issue.

I would probably become one of THOSE people who ever time I saw somebody park there went out to knock on his door and get them to move. Every time they did it when I wasn't home, I'd leave a note or pin tacks underneath the wheels at night - even it it wasn't fixing it I would try to be a big enough PITA that it was just less hassle for them to park elsewhere.

Whilst I can see why this would drive you mad, I’m not sure what you can legally do unless there is something in the deeds about this space being right of way or specifies the need to be kept clear.

I would be kicking off more about the hot tub too.

He has a smaller van now so his second car stops just short of the neighbours path. So only us affected. He parks it bumper to bumper with his white van.
