Roundabout collision - who is at fault? With diagram

Notcheekyvimto · 18/02/2024 11:59

Involved in a collision today at a roundabout.

Both lanes go straight on. The left lane leads to a left turn only shortly afterwards hence lots of people use the right lane to go straight, road markings are clear both lanes permit going straight.

Left hand exit is a car park for a local park marked in green ‘park’.

Red car travels in the right lane to go straight on, indicates left and starts to pull off.

Blue car comes from the park and intends to turn straight or right, into the path of red car.

Red car brakes but cannot stop in time and blue car is damaged on the drivers side, red car on the passengers corner side.

Who is at fault?

Blue car pulled out when the road wasn’t clear so blue car I think.

AtomicBlondeRose · 18/02/2024 12:01

Seems clear it’s blue - drivers on the roundabout have priority and it’s the responsibility of people joining to make sure they have space to do so safely.

Usernamesarenoteasy · 18/02/2024 12:02

Blue car. If they are not sure which exit red car is taking they should have waited to pull out.
Also if red car was not indicating right, it should be assumed they are going straight over.

BigDogEnergy · 18/02/2024 12:02

Blue car didn't give way to tred car already on the roundabout by the sounds of things.

IndependentExaminer · 18/02/2024 12:03

I would guess the blue car is at fault as the red car was already on the roundabout and signalling their intention to leave.

Mumof2NDers · 18/02/2024 12:03

Red car takes priority. Blue car should’ve waited.

PrueRamsay · 18/02/2024 12:03

Blue car should have waited until road was clear before joining roundabout.

Spookymormonhelldream · 18/02/2024 12:04

Cars already on the roundabout have priority so sorry Blue Car, it's on you!

DistingusedSocialCommentator · 18/02/2024 12:05

Clearly the blue car and I've seen many do that, some on purpose and others new to the area/lost/etc.

From what I have read, often the insurance takes a 50/50 hit unless the other driver admits fault.

Importantly and in my judgment, the blue driver is at fault, no ifs, no buts.

shielder · 18/02/2024 12:05

wasn’t the lane clear when the blue car joined though?

Sellingbedtime · 18/02/2024 12:05

Blue car - they should give way to traffic on the right

jeaux90 · 18/02/2024 12:05

Blue car messed up

Clariana · 18/02/2024 12:06

Blue car as others have said

FeatherBlack · 18/02/2024 12:08

Blue car was wrong.

MyGooseisTotallyLoose · 18/02/2024 12:08

Joining the blue call!

Mothership4two · 18/02/2024 12:09

Blue

FUPAgirl · 18/02/2024 12:09

I agree blue is at fault

Pegasusforme · 18/02/2024 12:10

It will be 50/50.

Only exit a ra if it’s safe to do so after doing your observations.

What if blue car was a cyclist? Could have been fatal.

kitsuneghost · 18/02/2024 12:10

Despite what is normally done (and I get it) the red car has effectively not checked the lane was clear. The blue car shouldn't have pulled out but from an insurance point of view red has gone into blue.
What we're your indicators saying to the blue car?

MrsRobinsonsHandprints · 18/02/2024 12:11

I don't think it is that clear cut.

I'm going for both at fault

Red car should have checked mirrors when cutting across the lane, providing the arrows allow the blue car to continue on.

A Google maps view of the roundabout would be helpful

shielder · 18/02/2024 12:11

It will be 50/50.

that’s what I thought. Looks like blue car is in the wrong lane but red car should have looked before coming off.

shielder · 18/02/2024 12:12

agree

Fameinaframe · 18/02/2024 12:13

Blue car will be classed as "at fault"

I think this. Blue car was presumably already on the roundabout, the issue is it was in the wrong lane.

bumtrumpet · 18/02/2024 12:15

Blue, although it'll most likely go 50/50 as red had a responsibility to check the exit was clear too
