Example:
Married 25 years, no mortgage both work.
2 adult children in University still living at home.(both working part time).
Widowed MIL dies. DH inherits £200,000
Is this family pot money?
DH Money?
DH and DW money?
DH ans DC money?

What happens on divorce is key to the question of whether marital assets are joint.

It’s not. It’s the starting point of a process of separation. Even then it’s not joint money, it’s fair allocation of the combined assets held by two people - which could be entirely separate for the duration of the marriage.

Combined assets is joint money. Assets that have been held separately for the duration of the marriage, even ring-fenced assets, will be considered as part of the joint marital pot to achieve fair distribution on divorce.

As I said, neither statement was correct - both were partly true.

From my situation - my inheritance is mine and mine alone. Some of it went to clear DH debt and some of it went on family holidays.

The rest is mine for retirement
