To think this isn't sexual assault...

I saw a story on the BBC about Jenni Hermoso testifying in a sexual assault case about her kiss with Luis Rubiales. Not having seen the kiss, I decided to look at a video of it, a link of which I've put below.

Firstly, i need to say I think sexual assault is extremely serious, and it's appalling how low the conviction rate is for sexual crimes. Men get away with far too much, and it's sickening.

However, in all honesty, i wouldn't class the kiss here as sexual assault. This is a lengthy full body embrace followed by a very brief peck of a kiss.

If something like this is classed as sexual assault, then it surely makes it impossible to initiate anything physical at all without explicit verbal consent.

Surely there's much more to this... i reckon she hated the guy before this incident and this was a way to get him back for other shitty and belittling treatment from him over the years.

I think it will make men in authority less trusting of women in general. And women in authority already distrust women so the net effect of ridiculous allegations like these is very negative for women.

In this case the woman couldn’t simply say “please don’t touch me again” because he’d already done it and moved on.

I 100% would bat an eyelid at any man who complained that they had been kissed without their consent.

Only in your opinion. Society only changes when people speak up. I'm sure the suffragettes were also mocked by the equivalent term of drama queens in their day.

I actually find it pretty disgusting that you call someone being kissed on the lips so they can't move against their will a non-event. The irony is you complain about it being done to you.

It must be extremely difficult for many posters on this thread to accept that they are thick misogynistic goady women haters. It can't be a nice place to be. It's difficult to admit that you are a woman but you fucking hate them. Also it's difficult to accept that you've been sexually assaulted by all of your female relatives over the last 40/50 years. You poor sad, sick, mentally unwell people.

Wonder how you'd feel if your daughter was blinded and facially disfigured at work by a political activist, or killed while at the theatre?

Yes that's what happens when thousands of people feel aggrieved at an individual. Look at JK Rowling and many others who've fallen foul of public opinion. I don't think male football fans will be the most sympathetic tbh.

It's really not difficult. You take it slow, pay attention to the other person and if they aren't clearly enjoying it then you stop. I genuinely don't understand why that is in any way challenging to understand or practice.

I agree it's not that difficult, and what you are describing relates to the vast majority of physics encounters I've had. However, it's nonetheless possible to misread cues, and I don't think minor misunderstandings should be criminalised... Things have sometimes gone further than I wanted - nothing major, and thankfully they have always quickly responded when I have told or indicated as such to them. For instance the guy went in for a kiss at the end of a date when I wasn't interested wasn't a sexual criminal - they just misjudged, and immediately stopped when I pulled away.

The question for me is where the line should be drawn between an innocent misunderstanding and criminal behaviour.

That's the difference here, you were able to pull away. This woman wasn't given that opportunity. A man in a position of power grabbed her by the head and forced her to kiss him.

More than that, he used the fact that they we're on a huge public stage to ensure that she wouldn't be able to make a scene. Can you imagine what would have happened if say, she kicked him in the nuts to try and get away at that moment?

It's not a straw man. They used tactics akin to Al Queda and had they been better at making bombs (i.e. had they actually detonated) they'd have committed atrocities akin to the Manchester Arena Bombing. Not people that should be idolised no matter their goals.

And their contribution is debatable as women getting the vote was more due to the war effort.

She has used the entire global media to whip up sentiment against him. How come it’s ok for her to do that? He has said virtually nothing.

if I were her employer, the Spanish FA, I would also be aggrieved at her for not following standard protocol. Instead of raining a complain with HR or the Police she took her complaint to the worldwide media, making any kind of untainted investigation impossible. I have no doubt she has breached her Code of conduct and policies governing her actions as an employee.

I hope he is acquitted and goes after her for the Spanish equivalent of defamation.
