To keep their deposit!!

DH and I have a couple of properties we rent out. We have been renting to a young couple who always seemed like good tenants. We gave them notice a couple of months ago as we are going to start renting on AirBnB instead as DH thinks we will get more money (don't get me started).

Anyway, they moved out on Saturday and everything seemed fine. Today I went to get everything cleaned and I found (what I think to be) weed residue next to the sink. I'm Furious. I feel completely violated and uncomfortable being inside the property. I'm sick with worry that they have been using illegal drugs in my home and what the legal ramifications could be!!

Obviously we have their deposit. I was planning to refund it this week. After my discovery today, I now feel incredibly reluctant to make any sort of refund. The idea of supporting/funding their lifestyle makes me very uncomfortable. And they never would have been given permission to abuse my property in this way.

DH seems to think none of this is a problem and seems to completely miss the point - it isn't about cleaning it up - it's about the abuse of our trust.

@Strugglingthroughitall it probably wouldn’t have made a difference - the deposit scheme is weighed heavily in favour of tenants. I had a tenant break a door because he punched it and there was a big fist shaped hole in the door. I submitted before picture but because the tenant said he didn’t do it and he doesn’t know who did I had to pay out!!

@TrishIsMySpiritAnimal Yep - I figured that! So focused my energy just on getting my house back to normal again and anything I might get would just be a bonus towards paying for the repair work. Gross though - who leaves a bucket of vomit? 😥I actually know who these people are too - one of them owns/runs a local restaurant. Somewhere I would never eat from…….

That’s not a valid reason to keep deposit.
The deposit protection scheme is there for a reason and if they haven’t damaged the property or been behind on rent you can’t keep it because you’re offended.

I actually don’t think you can even use it for rent arrears can you?

I could understand your hysterics if you had found remnants of a Class A drug such as heroine...but weed?? And you're not even sure whether it is or not!

To put it into perspective, my 21 year old DS takes marajuana. He has a medical excemption certificate and it's prescribed to him legally.

You seriously need to stop being so ridiculous. And return their deposit.

You're upset about the tenants? You'll get a whole world of shock at the kinds of things people do in short term lets.

Also you broke the law too by not putting their deposit in a proper scheme.

This is totally batshit. All logic gone out the window. I really think the OP should not be renting out a property on any kind of basis given so many red flags about her behaviour so far. I say this as someone who hates marijuana - I wouldn't be happy about it but they have already left and no damage actually appears to have been done relating to (possible but unconfirmed) use of marijuana. Really one of the craziest posts I've ever seen on here.

I'd get that deposit back to them pronto. If they pursue for not lodging it properly you will have 3 x the deposit to pay back to them.

Didn't read everything, but why do you think it's weed? Loose leaf tea perhaps? (As an aside, some of the posh brands of loose leaf tea are really nice).

I'm going to hazard a guess that the OP isn't that familiar with weed and couldn't distinguish between weed "residue" and hundreds of other substances if her life depended on it.

You're an amateur landlord totally clueless playing in a big pond.
Have you got a gas safety certificate?
Have you had the electrics professionally checked?
Have you got 3rd party public liability insurance?
Have you got any insurance?
If the property is mortgaged does the mortgage company know you are renting it?
Of course you must do a thorough end of tenancy clean at your own expense. ffs
Of course the deposit is due back.
I don't see what trouble you perceive yourselves to be in from some vegetable or herb waste left in the sink.
Grow up.
You must put the deposit in the proper scheme.
You will be breaking the law and if shit happens could be sued.
Please get clued up.

I'm very doubtful about any of this.
How can you possibly own several properties to rent out and be completely unaware of the rental deposit schemes.
You are setting yourself up for a significant financial loss. Pay the money ASAP and hope you don't get reported.
Then check out all the other basic legislation you need to follow to legally rent a property out.
But I can't actually see how you could be this clueless.

You are being incredibly unreasonable and are the only people who have definitely not followed the terms of a legal tenancy with your deposit nonsense.
