Hello, I posted yesterday for advice following an eviction and court summons.
I cant afford the rent of £950 anymore I'm a single parent on UC, I've built up rent arrears over 4 months because the amount ive been paying is the UC housing element which is £510, I tried to speak with the landlord that my children's dad doesnt contribute financially anymore and I couldn't afford the amount, anyway I've got to attend court 21st September.

This afternoon I've received an email from your move saying my landlord has asked them to come over to the house and value it for sales and rental values. What date and time is convenient for him to come over.

I dont feel comfortable with this as I'm a single parent and dont want my landlord turning up aswell.
Would I be unreasonable to say I dont feel comfortable with this and ask them to wait until I've vacated the property?
I'm trying my best to find alternative living arrangements but it's really not that easy.

You can’t start a s21 without proof of the deposit being protected with the first 30 days or the deposit having been returned.

@Nomoremoves i applied for a dhp but it was rejected, my court date is the 21st September. I have done a homeless application with the council but cannot progress without the landlord sending me the gas safety certificate and the epc

When he takes you to court if he does not have the things the council mentioned above. The court will send him away . It basically buys the council more time.

Give the landlord a break
He to has a income to cover his rental.
He requires and has given you notice of entry.
Your uncomfortable because you owe him money it's time to get responsible and let him get on with his life.
Do the right thing.
Feeling awkward,, christ the guys lost out and it's all about you.

Your landlord should have given you a copy. It’s very good news for you if there isn’t one. Get the homeless team to ask the agent.

He cannot prove you are in rent arrears for the eviction then. How long have you been in the property? Gas check should be carried out yearly by a qualified person. Have you had a gas engineer in the property in the last year?

Were you there when the gas was last serviced? Can you remember the firm? If so you can ask them directly. You could also get citizens advice/housing advice and do a joint request for the LL to produce it within a certain amount of time. It’s better than just you asking.

I was in a similar situation to yourself literally last summer! We had a landlord who would barely do any repairs on the house (kitchen ceiling came through and all sorts!!) I’ll be honest I was scared but quite relieved when I had the eviction notice because I saw it as a way out!

have you received your eviction notice yet? Ours was a section 21 (no fault eviction they wanted to sell the property).. my advice, contact shelter and any local housing associations (cheaper alternative) and ask what is available, I would contact the council and speak with the homeless prevention team and get your name down on any of the council housing list you possibly can.

in some areas it’s different, for us we was able to look around at private rent (council offered to cover deposit and up to three months rent if necessary).. if we couldn’t find anything our advise was we was to stay put until actually being removed. We was told we would expect to have balifs and that’s when we would vacate the property and that’s when the council would then find temporary accommodation..

if I was you, I would be as cooperative as possible, you won’t want to prolong this, it’s best they do this now and get it over with tbh for you to have the opportunity to some council accommodation (potentially be offered a council property).. see if the council are building any new builds aswell!

we was lucky enough to be offered a council property literally like a week before our court date was due!

do you have any medical/health conditions that could potentially get you on higher priority through the council?

I would allow them access to the property, let them know a date & let them know you’d prefer to not be present.

definitely ring the council and request more information, ask when you’ll be provided with a housing officer aswell! When looking for somewhere else they can communicate for you! Ours was brilliant and everytime we went to visit a property he would phone the estate agent and let them know they were offering to pay x amount towards everything..

you need support! Take no notice of the people on here slating, they clearly haven’t been in this position, I have, I know exactly how scary and worrying it is! Let them have access and phone council, shelter and CAB tomorrow first thing! Keep paying as much rent as you can afford for the time being x

What happens if a person defaults on their mortgage because they can't pay? Can they refuse to leave like renters do? What happens if ll can't pay their mortgage if rent not paid?
( obviously the mn consensus is to deride the eeevil ll and tell them tough luck!)

I thought exactly the same. The popular opinion on MN is all LL are bad but there are equally bad tenants.

OP if I was in your position now I'd let him carry on with the court proceedings because it sounds like the relationship between you as LL and tenant is past reconciliation on both sides. Hopefully the council will find you a property or temporary accommodation but it's the rules around not getting any help until you are actually homeless that need changing for both LL and tenants sakes.

After reading the thread on here this morning about the tenant in a HA property with no hot water for days I wouldn't bet on them being any better than a private landlord though.

If you go out make sure a friend is there in your place...... last thing you'd need is them going through cupboards or drawers. With my anxiety that'd be my fear. Sending you love and hope your rehomed as soon as possible

Not if it says in her contract that she has to allow viewings. Most landlords can't afford a month or two of an empty flat after someone has moved out to look for someone news. Especially as mortgages have gone up and op hasn't been paying the full rent.

Tough. You can insure for a situation like this. More fool the landlord if they were too cheap to do it.

Promised to have the front garden block paved since I moved in to allow more parking, never been done. Sent random family members every month to collect the rent but never sent a text saying they were coming. No gas safety certificate and no epc to forward to the homeless team to move my application forward but I'm not here complaining about any of that I was here asking for advice.

Report him, the fact the boiler has no gas service certificate is illegal. Start fighting back

So a renter can not pay rent for months and still complain about the ll not giving them a proper service?!

This. We did our fair share of rentals and I always found a time that worked for me for EAs coming round. It’s better to be cooperative in these situations.
