Mitigating factors could also be brought into this though.

The RTA is about the control of motor vehicles (etc) and will not allow an individual to avoid responsibility when the individual has a duty under the act to be in control, the DPA is about the control of data and will not allow an individual to avoid responsibility when the individual has a duty under the act to be in control.

Why would legislation allow an individual have the ability to claim that although they have a duty to control they can not be responsibility with failure to control?

They are not failing to control if they use software which is fully DPA compliant.

You have just reasoned out why software can not be deemed in control of driving why is software in control of data different?

Basic principles are not.
But as your employer has allowed a training gap it would be understandable why you may be having difficulties.

They get security clearance off the person responsible for security access for that specific area.

Its the same way we get cleaning staff, or painters, or new carpets, or vehicle recovery for any broken down police cars at the station. etc etc

Most police stations are PFI buildings.

As Capita control the building, they will have control on who has access to it.

Its a PFI building. The building maintenance and its security is down to Capita.
Capita in essence own the building.

I have held this belief ever since we moved into the building.

For example, my car parking pass for me to get into the car park has to be applied for through Capita.
