AIBU to think that downloading hundreds of sexual and abusive images of children should mean jail?

YABU - there should not be jail time for some who download hundreds of images of child abuse

YANBU - downloading hundreds of images of sexual abuse of children should mean jail

The magistrates said "the offences "would normally attract immediate custody" but "But they said they had decided to suspend a 12 month jail term, something they conceded was "unusual".

But yes, in principle, if this doesn't get you out in prison, god knows what will.

Because it was a crime committed by a 'trans woman'. By the way the crime is sexual against children and listed as being committed by a woman. A woman! A woman!

I knew someone caught with tens of thousands of images who wasn’t sent to jail. That meant he could move to a new area with his family and keep it very secret.

There’s something wrong with our legal system when it comes to sex offences.

Indeed why are these sex offenders not punished by jail? Apparently the transwomen did it because they were in a dark place at the time. I mean seriously that is a cop out. I was unhappy so I looked at abusive images of children. CHILDREN> do children come after transwomen and their 'feelings'.

"Damien Moore, mitigating, said: "This case has attracted publicity that has inevitably had consequences for her in her personal life.
“It’s very, very clear that she will forever more have to live with the shame and embarrassment that these offences bring upon someone".
Mr Moore said Howes, who has no previous convictions, pleaded guilty at the first opportunity and had shown a "high level of cooperation" to the probation service.
He added that at the time of these offences Howes was "in a very dark place" but was now in a "stable, loving relationship" and has the "full support of her children".
Howes was also ordered to carry out up to 30 days Rehabilitation Activity Requirement (RAR), pay £145 costs and a £149 victim surcharge.
She was also made the subject of a 10-year Sexual Harm Prevention Order (SHPO) and put on the sex offenders register for 10 years. "

I don't think it does generally mean jail time but I agree it SHOULD do.

These pictures depict children being raped and sexually abused. Why the fuck are our courts not sending the people who access and supply these images a strong message EVERY DAMN TIME one is caught?

This isn't to do with them being trans. I believe under sentencing guidelines the maximum custodial sentence that would be passed for possession of the most serious category of images is just 3 years.

Assuming this didn't meet the threshold to pass the highest sentence then we might have been looking at something like 6 months to a year custodial sentence.

I don't know how long the trial has been ongoing, but any time already spent in custody is deducted from the sentence. I also see that this person plead guilty, which would usually also reduce the sentence.

I don't agree with such short sentences for these crimes, but this is to do with sentencing guidelines, not his trans status.

@Flickersy it was to do with waiting for the special transgender board to decide what to do with 'it'. They took a long time because they have to carefully consider where to put 'its' that commit serious crimes and the crime was committed by 'it' in 2020. No probation in prison. Apparently 'it' has been a good 'it' since then (or so they believe) and 'it' has now found a partner so all good and dandy. So 'it' is free to go about living "it's best life"

Nothing to do with being trans. I have read the same sort of story where the perpetrator was not trans but with the same ridiculous 'sentencing' thousands of times.

You mean the special transgender board consider the sentences of people who are non trans - no they don't - they were set up to consider trans only

It feels like a massive injustice is being carried out against children and women and many people look away.

I think the sentencing guidelines are way to.low for anyone committing these types of crimes but I'm not sure that being Trans is the issue here

It's not - it's the sentencing guidelines that are the problem. They are way too low

However given OPs posts I suspect she has her own agenda about trans people and the crime is a bit secondary to that... Not sure she's interested in a serious discussion about unfit sentencing guidelines and criminal law.

It should mean jail, but it doesn't. One of the reasons is we do not have the capacity in our prisons. They are another sector that has been woefully underfunded by our ridiculous government, who don't give a shit about women, children or law and order.

I wonder what else the judge has seen to give that sentence. Its like he/she has got away with a lot, but, on a scale of things that people have done to children, perhaps the judge considers it to be lesser.

US studies have shown 4% of adult men have viewed child abuse images in their lifetime

and that’s the ones who admit it

So, reading between the lines, did the Transgender Case Board conclude that they were in a very sticky situation re. where to put this individual should they receive a custodial sentence. The case of Isla Bryson (transgender rapist put in a women’s prison in Scotland) would have been fresh in their minds.

So was it decided that, because they were remorseful, and had been in a bad place, and were very compliant with the police, they could justify not locking them up?

Hmm.
