AIBU to think that downloading hundreds of sexual and abusive images of children should mean jail?

Spend your spare time watching children being raped? Oh well, you were in a dark space, and unfortunately there are just too many men who like watching children being raped to fit in prison, so a few months probation will have to do.

Behind each one of those images is a young victim and I cannot imagine how they face life after what they go through.

Prison does nothing for them except put them with other like minded individuals and hone their craft. I do not believe pedophiles can be rehabilitated. Chemical castration may help.

Being trans has nothing to do with it.

People are correct it's sentencing guidelines that are the real issue here. Even if trans status does get taken into consideration there a raft of other factors that also get looked at.

I worked with someone found guilty of possessing hundreds of CSA images. They rank them in severity (imagine the poor police officers who have to do that 🙁) and he had most in the 'mid' range and only a 'few' at the worst. And it was his first offence. So that all counted.

He was also a white, middle aged, middle class senior professional with a nice house in some little Home Counties village. I'm sure that helped. He got a suspended sentence, 5 years on the sex offenders register and some sort of court ordered counselling. So nothing much really.

Apparently and unbelievably his wife stayed with him but I heard his children cut him off from seeing the grandkids.

Child sex offenders, including those who download these vile images are the lowest of the low - they ALL repeat offend. Anyone who thinks they don’t are being ridiculously naive.

It's well known that having a good support network around you helps prevent reoffending for a lot of crimes. That is not a particularly odd comment from the judge.

Your opinion on whether mental health should be taken into account or not specifically in relation to child sex offences is irrelevant - at the moment a person's mental health will be taken into account by the judge when passing sentencing guidelines. So it's not an odd thing for the judge to comment on either re the "very dark place" line.

It was a magistrates court and the remarks were made in mitigation by the defence.

A very dark place is not a mental health diagnosis as far as I'm aware.

There is no acceptable mitigation for watching children being raped as far as I'm concerned and our sentencing should be geared towards making it near enough impossible for them to reoffend. I quite like the idea of penal colonies.

@Babdoc one of my friends works in this field and I agree, there's so many people who fall into this category they can't even keep up with the numbers, the huge amount of digital data and then put them all in prison, there's no room. Horrific but just unmanageable.

Whoever the remarks were made by, the fact remains that a good support network helps stop reoffending.

"A very dark place" is not a diagnosis but it tells us there was clearly discussion of his mental state in court, which I would have thought was obvious.

There will always be mitigation no matter how heinous the crime. That's the defence's job and they'd be doing a poor job if they didn't.

I'm sure I'll be accused of transphobia by at least one poster here but this is wrong. Apart from the fact that crime is horrific crime stats are being skewed because apparently this piece of male bodied scum believes he is a woman and the system seems happy to take his word for it.

No I don't think downloading should mean jail. I think producing should mean jail, sharing should mean jail but not downloading.
I know someone who downloaded by accident through file sharing large amounts of files and since then I take a different view, I think it's too grey with the internet as unregulated as it is.

I agree. It's frustrating when crimes - particularly when they are sex crimes - committed by transwomen are noted as being committed by women.

Could you explain what you consider deranged? Because the defence of a paedophile seems like a weird thing to prioritize here, and you do seem to be feeling very defensive of them. From reading the OP, it sounds like being transgender was a factor given during sentencing in not giving a custodial sentence. But I guess you can prioritize the gendering of a paedophile if that's your thing.
