"EXCLUSIVELeading Tories are calling for a referendum on UK’s membership of the ECHR to be part of the party’s manifesto"

From the original op.

My answer is that we will be in breach of the GFA.

For those who asked questions her is more info on 600 laws that will be revoked.

I can't see anything about Human Rights but if anyone wants to trawl through then knock yourself out.

I thought they’d given up on that. Didn’t Badenocke cause a furore when she announced it?

My answer is that we will be in breach of the GFA.

IMO that could become irrelevant.

Sinn Fein now have a majority in Stormont with 27 seats, (DUP has 25) so it will, IMO, only be a matter of time before they start passing legislation that moves them closer towards a united Ireland.

I can see us losing NI from the Union before we lose Scotland.😮

Notonthestairs · 03/07/2023 15:39

"IMO that could become irrelevant."

I think we should leave that to the people of NI to decide.

However, it wouldn't mean it was less of a breach now.

pointythings · 03/07/2023 16:22

A United Ireland is likely, but not imminent. Breaching the GFA in the run up will not be shrugged off by the international community - it would still be a breach of international law.

What is it with Brexiteers and their complete disregard for international law and the UK's reputation?

SerendipityJane · 03/07/2023 17:35

Notonthestairs · 03/07/2023 15:08

The GFA directly mentions it.

Rights under the ECHR can be relied upon in NI.
Rights under the ECHR must be applicable to everyone within the jurisdiction.

So if we leave we will be in breach.

Rights under the ECHR must be applicable to everyone within the jurisdiction.

So the answer is England, Scotland and Wales are withdrawn from the ECHR, and NI stays in.

That may have been the plan all along.

Notonthestairs · 03/07/2023 18:04

No - under the ECHR you have to offer ECHR to all your citizens or none.
So they can't add another border down the Irish Sea.

Notonthestairs · 03/07/2023 18:09

It's properly explained here by someone genuinely knowledgeable (rather than me!)

I'm not disagreeing !

However, it wouldn't mean it was less of a breach now.

Nothing is happening now. "Some Tories", who are not named BTW, are calling for a referendum, that's it.
People are getting their knickers in a twist about something that may never happen.

Notonthestairs · 03/07/2023 18:19

I don't think anyone's knickers are in a twist.

Its not like the Conservatives have ever brought up leaving the ECHR before have they?

I don't understand what you mean.

If NI leave the Union they will no longer be British Citizens, they'll be Irish Citizens.

What has the UK/Irish border got to do with it?

Notonthestairs · 03/07/2023 18:24

But they haven't left.
So any move by the Conservatives to pull out of the ECHR will be in breach of the GFA.

I disagree.

Judging by some of the emotive responses on this thread, some peeps have got their knickers well and truly wrapped around their necks about an idea that isn't even on paper yet.

And it's not like Labour hasn't brought up controversial stuff is it?

Here's a small taste :-

Five terrible Labour policy ideas for the dustbin (thanks Richard Burgon)

Some Labour leadership and deputy leadership candidates are promoting policies that will do even more damage to the party's comeback chances. Here, GQ picks five absolute stinkers.

I'm not arguing with you !

No, NI haven't left the Union.

And UK hasn't left the ECHR.

And neither are likely to happen during the term of this Parliament.

So it's all a case of 'what if ?'

You know that article is from 2020 right?

Haven't we had 3 prime ministers since then?
