I can’t cope with PIP Tribunal.

I applied for PIP on December 24th 2021. Was declined and did a mandatory reconsideration which also was declined. I appealed to the tribunal on 1st July last year, was told 25 week wait. I’m appearing via phone due to agoraphobia and mental health conditions and I am dreading it. I’m still waiting on a date for tribunal, I phoned to enquire and was told they’d put it through to the listing team but nothings come of it. The thought of going through this is making me more unwell. I’m waking up in the night with panic attacks, vomiting and my hair is starting to fall out. I feel like withdrawing this appeal because it’s making me poorly. I don’t know what to do.

So the DWP tried to give you not a penny and the tribunal overturned it?

That's something and well done for seeing it through. It's not everything you want, and it's a fucking scandal it took 15 months of the DWP unlawfully paying you nothing. But it's all done now, you are vindicated to an extent, and yes it is better than nothing. And like Zebedee55 said, any PIP award makes you eligible for a whole bunch of other stuff, if any of it is useful to you.

If you're on UC (but not ESA) you'll get a disability premium and that can be backdated along with the PIP, and that's more than you get from the PIP itself.

Argh that must be so frustrating, as it seems you were only 3 points off an award for care? But you got standard mobility.

As PPs mentioned look into other aspects of what you can be awarded - at renewal maybe you can gain the extra points.

It will be a new claim not a renewal.

There is no disability premium on UC for being awarded PIP. You can apply to be assessed for work capability but that is nothing to do with PIP. If you are already on old style income related ESA and you are awarded PIP then you can get a severe disability premium under some circumstances.

At least you got something

A measley £24.45 per week for standard mobility and it doesn't really passport you to anything else like standard daily living does such as someone being able to claim carers allowance for you or Uc carers element. You need standard daily living really to benefit much from PIP.

I stand corrected. I'm not sure why I got that confused, but sorry for the bad information.

LakieLady · 10/03/2023 00:29

Really sorry to hear that, OP, you must be gutted.

Give it a year and try again if you're no better. Although LCWRA and PIP have completely different criteria, I find that if clients are unwell enough to get LCWRA they are usually unwell enough to get DLC for PIP, so I don't doubt that you're entitled to it.

And try and get help from a benefit adviser when you do the form, if they're anything like me they'll be doing loads of applications and know what works a nd what doesn't.

The system is utterly corrupt, so many people get turned down when they shouldn't and a lot give up at that point. The govt know that, it's just a numbers game to them, and a brutal one at that. And the process is so soul-destroying.

CAB or similar may be able to help with your debts, so it's worth trying to get an appointment when you're feeling a bit better. Some debt solutions can get debt written off, but criteria vary.

Please don't feel it's your fault, it really isn't, the process is stacked against applicants. 💐

Bless your heart. Similar circumstances to me. I waited 17 months from applying to appeal date. Had the appeal yesterday over the phone and I was obviously in a right state. Just take your time, breathe when you need to, if you need a break ask. They have to make sure they are getting the information from you that usually pip have missed, remember you’re doing nothing wrong, just be honest about how your condition affects you but they do need to know details otherwise everyone would be applying. There was a nurse at mine that was lovely. It’s tough but not as bad as you think, they ask questions as only you know how your condition affects you. I got awarded care and High rate mobility by the way. With 17 months back pay. Don’t give up x
