Someone reversed into my car - it's his fault, right?

I was driving in a car park, and a man reversed and hit the side of my car while reversing out of a parking place.

There is a dent and scuffs where he hit my car on the rear wing. He says it's not his fault and it's a no fault incident, and doesn't want to go through insurers. He said 'I will play fair if you play fair', and wants to settle outside.

I will be getting a quote from a bodyworks next week but friends are telling me to go through insurers. What would you do?

Definitely go through your insurance. They'll count as as no fault on your part and claim against him.

You have to inform your insurance but you don't have to go through insurance. However, if he's saying he's not going to pay because you're equally at fault, then obviously you need to let your insurance companies sort it out.

I've twice had people ask not to go through insurance for this sort of thing - each time, after a lot of messing around - it's eventually had to be put through as an insurance claim. Plus you can invalidate your own insurance if you don't disclose it.

Of course he's at fault. He made a manoeuvre without checking his path was clear. You didn't drive into him sideways! What a dick. Bet he wouldn't try that shit if you were a male driver. (Presuming you are female...).

Absolutely go through your insurance. Don't let him pull this stunt. Do not accept responsibility for this. It's his fault 100%.

As he has hit your rear bumper there is no way you could have been at fault as surely the majority of your car would have been visible in his rear view you passed him (assuming you were driving forwards!)

Definitely insurance. Inform them today even if by some miraculous turn of events he is willing to cough up completely for your work to be done you need to inform them anyway.

What was the damage to his car like?

Absolutely go through your insurance company. You are supposed to inform them within 24 hours. He is at fault and has been trying it on.

He is absolutely at fault if he reversed out into an already moving oncoming car.

Last time I had a bump incident (my fault) the bloke was really shady and tried pushing me to pay him private. I refused and said I'd feel more comfortable letting the insurers handle it. He suddenly stopped pestering me and disappeared.

Out of curiosity I looked the reg up and it wasn't taxed or MOT'd, and was SORN.

You MUST disclose to your Insurance anyway whether or not you make a claim through them. Whether it is all his fault or there was any element that might be your fault, if you had been able to anticipate that he was reversing, and didn't I can't say. I wasn't there. But it definitely was not a 'no fault' accident. The other driver is trying it on.

GO through your Insurance and forget the bodyshop quote. Your Insurance will deal with it all, including repairs. They will also will decide Fault liability. I hope you got all the details from the other driver, including the Registration Plate? Have you checked he gave you the right information?

Go through your insurers. That's what you are paying them for. Don't contact him directly. He sounds like trouble.
