Someone reversed into my car - it's his fault, right?

I was driving in a car park, and a man reversed and hit the side of my car while reversing out of a parking place.

There is a dent and scuffs where he hit my car on the rear wing. He says it's not his fault and it's a no fault incident, and doesn't want to go through insurers. He said 'I will play fair if you play fair', and wants to settle outside.

I will be getting a quote from a bodyworks next week but friends are telling me to go through insurers. What would you do?

Call your insurance, its what you pay them for.
Sounds like he might have insurance on his car?

NewMoon76 · 04/02/2023 13:06

There was no damage to his car, but it was a much bigger car (Range Rover size).

I thought car parks were 50/50. Happy to be wrong.

Ah well if it's a bloke driving a Range Rover, it CAN'T be his fault...

FunkyMonks · 04/02/2023 13:13

Go through insurance he hit your car he is at fault what a twat and a chancer he has no intention of paying for the damage he has caused he is hoping by delaying you you will no longer be able to claim off his insurance so then will end up footing the bill yourself all the while he gets off.

KendrickLamaze · 04/02/2023 13:13

No such thing as a fully no fault claim. It's always someone's fault. One party has a no fault claim. Get a quote and see as it will be better for your insurance too but if he seems like a dock, go through insurance. I waited months once for someone to pay in a very similar situation and then when they did pay they handed the money to the garage and said "this should have been sorted long ago" like it was my fault. I wouldn't bother being kind again.

BurntOutGirl · 04/02/2023 13:13

Did u take photos which showed the position of the cars?

springerspanielpuppy · 04/02/2023 13:14

Insurance 100% I did this I was the one reversing and the other car swung fast over on to my side to swing into a space. I had witnesses who said it was his fault.

It wasn’t it was my fault as you have to be extra vigilant reversing it could have been a child who ran out. My insurance wouldn’t even consider joint liability or no fault.

Zippedydoo123 · 04/02/2023 13:15

I had a prang this time last year. It is ALWAYS 100% the driver behind who is at fault. The local garage told me.

springerspanielpuppy · 04/02/2023 13:16

The driver behind, do you mean the driver reversing?

springerspanielpuppy · 04/02/2023 13:18

Posted to soon, it is the driver behind if they hit you from behind but that’s not what happened here.

You're wrong.

RomansTheyGoTheHouse · 04/02/2023 13:24

It doesn't matter who is at fault in many ways: he sounds like an arse already and there is no way I'd want the hassle of dealing with him.

You've paid all those insurance premiums, time for them to earn their money :)

sallyisstarstruck · 04/02/2023 13:25

Go through your insurance. However, I had someone reverse out of a space in a carpark and hit my car. It was judged as 50:50 even though I was stationary and it was the other car that hit me.

ivykaty44 · 04/02/2023 13:27

What would you do?

I have insurance to deal with crashes and additionally I have to tell my insurance company if I have a crash

why not telephone your insurance company and tell them whats happened and ask their advice?

Shopper727 · 04/02/2023 13:27

My friend had this a woman just reversed into her as she drove behind but was 50:50 I mean how can you be partly responsible for someone else not looking and driving into your car? I don’t think it is in any way 50/50 seems bonkers

Elvis1956 · 04/02/2023 13:29

As an ex motor claims bod. Insurance all the way. People always say they will pay but you will need a car to get around for a few days. I'm fact I have just got mine repaired by my insurance little bump but 6 days to fix.
so imagine it's £30 an hour for Labour. ,£100 parts/paint.day 2 hours work that's £160 and I know I'm really under what the actual cost is.
6 days car journey £50 a day we are at a minimum of £460!
Go to your insurer. It's his fault so it shouldn't cost you anything in the end

forgettingtoremember · 04/02/2023 13:30

Insurance all the way, OP.
Did you take photos and have you got all his details, reg no etc?
He's just trying to intimidate you. He's a knob.

WetBandits · 04/02/2023 13:30

Oh insurance 10000%, that’s massively his fault!

I did the same once when I was a student/fairly new driver and admitted it straight away as I knew I’d fucked up. I could suck up the cost of repairs (and a bottle of wine and flowers!) by working extra shifts but I couldn’t imagine what my premiums would go up to. The couple whose car I reversed into were so lovely and saw how upset I was to have hit their car and offered to let me pay for the repairs. They sent me a really lovely email afterwards wishing me well with my studies 🙂

But in your case as he’s behaving like a complete arse, insurance.

So you were totally stationery and he reversed into you? How on earth could that be your fault?

whataboutsecondbreakfast · 04/02/2023 13:32

Go through your insurance.

You have to report accidents to them by law anyway, or it can invalidate your policy. Normally you have 24h unless there's a reason you can't (eg. you're in hospital).

Beenmum · 04/02/2023 13:34

An older lady reversed into me years ago , admitted she hadn’t looked and paid for the repairs - she was lovely too .

Your instincts are telling you what to do though I think this scenario is different to mine

CrescentMoons · 04/02/2023 13:34

Insurance and police here for intimidation

cctv from car park

It is his fault

This happened to me once, sort of. I was driving down a quiet road and stopped as there was a stationary car in front of me. The car then started to reverse and despite me shouting and beeping reversed right into me!
The woman then got out and started shouting that it was my fault Hmm. Luckily it happened slowly enough for there to be no damage, but how the hell she thought it was my fault I have no idea.
Actually the same thing happened to me when I was cycling, I was exactly where I was supposed to be towards the left side of the road, when a car did a 3 point turn and reversed into to me knocking me off and ruining my bike. Again they tried to blame me. I was so shocked (and sore) that I didn't get the reg number and surprise surprise she didn't answer any of my calls and texts.
Some people are just twats.
