Someone reversed into my car - it's his fault, right?

I was driving in a car park, and a man reversed and hit the side of my car while reversing out of a parking place.

There is a dent and scuffs where he hit my car on the rear wing. He says it's not his fault and it's a no fault incident, and doesn't want to go through insurers. He said 'I will play fair if you play fair', and wants to settle outside.

I will be getting a quote from a bodyworks next week but friends are telling me to go through insurers. What would you do?

He's certainly at fault. No question about it.

Near in mind that if you inform your insurance, your renewal price will almost certainly go up, possibly significantly. You can try it out if you want to see for yourself by getting an online quote. If you put that you were in an accident, regardless of fault, your quote will be higher.

In the other hand if you get your car fixed without going through any insurers, nobody will be the wiser.

Personally I would get a quote and give the other person a chance to pay cash. If they do so hassle free, it'll be cheaper for you too come renewal time. But if they mess around, just do an insurance claim.

No. I had exactly the same situation as you, identical in terms of position of damage. The idiot who reversed into me refused to admit liability, my insurers persisted, asked if I'd go to court if necessary (of course) and eventually his insurers gave up and paid.

Your insurance will still go up. Totally unfair but how they spun it to me was if you are in an accident, then you are the type of person who puts themselves in this position. Stupid logic, but still put my insurance up.

It's not necessarily rubbish when it comes to private car parks.

Many end up being "knock for knock" because there's no legal priority like there is on public roads.

Several hits in my family only once our fault tho...but all been sorted without insurance. Got addresses,phone numbers etc quotes and the people paid straight away. The reason people quite often ask to do it that way these days is if you claim your payments will go up and so will theres. I've never said no for small things dints etc. Only for 2 bigger things when the whole back end of my car was smashed by a reverser and could tell straight away it wasn't gona be hundreds to fix

That's nonsense. She was past him when he hit her, the damage was to the rear wing.

Go through your insurance you have to inform them anyway
Your car was stationary I hope you took photos at the time

Who was in the right or wrong really doesn't matter. The bigger issue is that if you decide to sort it out privately it can go wrong for you in so many different ways that it's just not worth it. Inform your insurance, let them deal with it and have no further direct contact with the other driver.

INSURANCE! Definitely. You should not be reversing out of a parking space or anywhere else without ensuring it is safe to do so and this may mean crawling out at a snail's pace because you can't see anything, if he has reversed into you as you were passing he clearly pulled out too fast.

In the past I’ve accepted cash off people instead of going through insurance. But that is when they admitted fault.
in his case he is at fault even though he wont admit it so absolutely go through insurers
