Someone reversed into my car - it's his fault, right?

I was driving in a car park, and a man reversed and hit the side of my car while reversing out of a parking place.

There is a dent and scuffs where he hit my car on the rear wing. He says it's not his fault and it's a no fault incident, and doesn't want to go through insurers. He said 'I will play fair if you play fair', and wants to settle outside.

I will be getting a quote from a bodyworks next week but friends are telling me to go through insurers. What would you do?

Someone reversed into us in a car park. We were in a space and stationary. Went through insurance. The costs of repair to our car was over 1k. Go through insurance!

This happened to me except I was the person reversing. I did look before I started reversing but there was a huge van next to me and I couldn’t see much. Was going extremely slowly. Anyway I think I accepted fault and it all went through insurance.

I always advise “never take legal advice from your opponent”. If they say it’s a no fault incident, ignore them.

A man reversed into DS car as a new driver. He didn't go through insurance, the guy paid up promptly after being given a quote and even rounded up the cost giving DS an extra £60 for the inconvenience.
Insurance never informed as it would likely put DS premium up, even as no fault.
Morally and legally the wrong thing to do though, but was all settled very quickly.

Go through insurance. You were established on the road. He was setting off from a parked position without due care and attention. It is 100% his fault.

You need to inform your insurers immediately. My parked car was hit by someone who works in the area on a Monday evening. She left the scene and had caused extensive damage. My neighbour had witnessed it and informed me - and was particularly angry as the person who had done the 'hit and run' was a solicitor. The next day she parked back on our road, and just went to work. I left a note on her car to advise that she had been witnessed and to knock on our door to discuss. She didn't. She just left.

I called 101 to report the hit and run, and said I knew where she worked as a solicitor. They said I needed to report in the nearest town 10 miles away. However - a PCSO turned up 2hrs later..... took the details and said they would give her 2 more days to make contact. Very much got the impression they were well aware of her. On the Thursday, the PCSO contacted her and advised that she was being reported for a hit and run. She finally knocked on the Friday evening - and informed me she was a very busy lady and did not have time to deal with this! Was adamant it was not to go through insurance and send her the bill.

Took it to a garage - quote for £900. Sent it to her - she said No, I want 3 quotes.

I called my insurance company - they said this was a typical way to get out if it. They get you to take it to the garage, so the works are contracted in your name. Whilst you can ask them to reimburse you - technically the contract for the works is in your name. So you owe the garage that did the work and rely on them to pay you. They often don't. He said it was particularly concerning as she was a partner at a law firm.

I emailed her to let her know I 'did not have time to waste on this' etc, so the insurance company was dealing with it. She wrote the nastiest email back - so I replied, cc in the PCSO.

I believe she no longer has a licence.

Not for Tarzan to come swinging in on his Range Rover telling you that you are woman so you must be partially at fault (for not having a penis).

I can see why people opt not to go through insurance. Because even a no fault claim will almost definitely put up your insurance.

A van reversed into me. The driver asked to pay for the damage and no involve insurance. I got a quote and he paid up. But I can see this is not without risk.

It's really annoying! A driver pulled out of a side street into the side of me - claimed it was my fault as he couldn't see Hmm - but obviously it was his fault. My insurance still doubled this time.

Of course you had right of way, you were on the equivalent of a road, he reversed out of a parking bay. He could have killed a child, inconsiderate twat.
Do not contact him, he may deny all knowledge, claim it’s another car on false plates etc… go through your insurance.

I had this once, I was the one that was reversing out when another driver decided they would try and squeeze round past me as they were too impatient to wait 30 seconds for me to finish the manoeuvre. Insurance said it was their fault.

Insurance. I was hit in a car park recently. Person drove off. I’ve been quoted £5,000 😩. Not had it fixed.

This happened to me in a Royal Mail cat park. The other party refused to give me their details. The police weren't interested as it happened on private land apparently and RM refused to share the security video footage as they said it's only for their own use.

Which all seems wrong. The guy who reversed into my car had no repercussions at all while the police put me on a producer so I had to make a further visit there to show them all my documents.

As others have said, you need to disclose even if you don’t go through your insurance - you’ll invalidate it otherwise. Are you absolutely sure he’s insured, since he seems adamant to do things in cash ? All the more reason to go through your insurance.

My friend had this a woman just reversed into her as she drove behind but was 50:50 I mean how can you be partly responsible for someone else not looking and driving into your car? I don’t think it is in any way 50/50 seems bonkers

depends on the speed you are driving at in a car park, so it is not always 100% the reversing cars fault.

I'll put my neck out and say I haven't always gone through insurer's. I hit a parked car shortly after I passed my test and thankfully the owner was kind enough to let me just pay for all the repairs (£570) . Had it gone through insurance it would have cost me thousands at renewal at the age I was. BUT I admitted fault and immediately transferred exactly what she asked me for for the repair. I know lots of people who sort things out privately even if it is against policy.

In ops situation I think you have to go insurance though,because he's proven himself to be shyster.
