To keep parking in front of this "drive"?

Sorry it's a long one. I'll start off by saying that due to mobility issues I do drive my children to school which is about 1.5 miles from our house. I do not however qualify for a blue badge.

There are several residential streets near the school where people park to take kids to the school. I imagine it is annoying for the people who live there but there are no restrictions on the road in terms of yellow lines etc and generally I'd say people are respectful of the residents. There are a couple of cars who park overhanging the yellow zigzags and some on bends but for the most part people park at the side of the road and don't block driveways. Dropped kerbs are marked with white lines so it is clear where it is ok to park.

I tend to park on the street one up from the school as usually it is quieter and there's more chance of getting a space. Until recently there was a house on the street that had fallen into disrepair with an overgrown front garden. Over the last couple of months there have been tradespeople coming and doing up the house and now the front garden has been paved over. About 2 weeks ago I parked in front of this house and a man came running out of the house opposite shouting at me that I couldn't park there as I was blocking a drive. I had my kids with me and told him I did not appreciate being shouted at in front of them especially as there was no dropped kerb so it wasn't a driveway. There wasn't a car parked on it either. He stormed off back into his house.

A few days later I saw the space was available and as it was raining there were a lot of extra cars on the school run so spots were at a premium. I parked there again and returned to a note on my car not to block driveways.

I don't park there every time as there are other spaces available often before I get to that spot but last week I was running late for pick up and noticed the space was free again - I was feeling a bit petty too by this point. However, there was a police officer speaking to drivers about their parking to ensure it was safe as it was near a school. I parked there and the police officer stopped me and said she'd had a complaint about people blocking the drive. I pointed out there was no dropped kerb and she immediately said, "Oh, you're absolutely right. Carry on."

This morning it was again the only available space but today there was a car on the drive and seemingly new residents. I parked up as usual to find the man from the house opposite screaming at me again in front of my kids that I was blocking the drive and now the new resident of the house coming out to join in. I tried to keep my cool but it is quite intimidating having 2 men shouting at you in public especially with young children. I said I needed to get the kids to school but they were misinformed if they thought it was a drive as it didn't have a dropped kerb and actually he was in the wrong for driving his car over the pedestrian footpath. Neither of them were listening though as they just kept shouting over the top of me.

When I came back to my car he had taken a photo of it and then a photo of me and told me he was reporting me to the police. I again tried to explain about the lack of dropped kerb and he flat out told me that was not true, that he had the right to create a driveway whereever he wanted and that actually parking on the street full stop (driveway or no driveway) was against the law and he should know because he is a lawyer. I told him he was speaking rubbish and to look on the council website as it is very clear.

Up to now I've parked in other spots if they have been available but AIBU to keep parking in front of this "drive" just to make a point because they have pissed me off?

Blocking someone in isn't obeying the law. I hope you don't drive.

It's not against the law to park where there is not a dropped kerb even if you are blocking someone in. I mean, it's potentially a dick move but it's not illegal.

What is against the law is driving a car in and out of a driveway if you don't have a dropped kerb.

"If you do not have dropped kerb, you must not drive over the footway. If you do so, you are breaking the law and enforcement action could be taken to prevent such practice. Furthermore:

You may become liable from a collision with a pedestrian

You may become liable for damage to the footway

You may face considerable costs as a result of damage to any utility apparatus under the footway"

I’m with you OP. You had every right to park there and as you’re clearly doing a school run and won’t be there long, these people are crazy to think they had any reason to shout at you.

Any sympathy I’d have had for residents thinking they had a driveway when they don’t have a legal right to get to it is dissolved by the fact that you were being shouted at even before they had a car there to block in.

I doubt they would have been quite so aggressive if you were a 6f4 bloke.

The fact is that parking across a non-dropped kerb access to a driveway is not illegal. Not getting a dropped kerb potentially is.

You can argue the toss all you like but that's the fact of the matter.

Good god, isn't there another patch of road you can park on?

It is obvious they've paved the front garden so that they can park off-road, clearing cars from the street.

It's also obvious that they need access to it.

They may have already asked the council. drop the kerb. It isn't expensive but there's a long wait in our area.

They asked reasonable, left a note, asked the police to come and talk to motorists about considerate parking and are now at boiling point. The council told my neighbour to get little wedge things do that they could drive over the kerb while waiting.

You may not be legally doing anything wrong but wouldn't this annoy you if it was your house?

You are parking on a public road and you are not blocking anyone's drive because he doesn't fucking have one!

I would avoid it only because he sounds like someone who would damage your car but you are doing nothing wrong!

You aren't entitled or any of the other bollocks that's been chucked at you.

If you had the time you could park there and when he starts, ask him to call the police and you'll wait. I bet anything he'll back down.

IIRC you have to have permission for a dropped kerb, so whilst there isn't one there now, it could be soon. What will you do then...and if you have a solution for that then why aren't you doing it now?

Actually in the last instance the op was wrong because it is an offence to block a car from accessing the highway, the dropped kerb is irrelevant, that's a different offence but if a car is on the 'drive' don't park there

But he shouldn't drive over the pavement so shouldn't be "accessing the highway" from his garden anyway.

Then you don't pay a fortune for your front garden to be paved over, and you park on the road instead.
Not having to money to legally make your front garden a driveway is no excuse to keep using it and demanding that others don't park in a perfectly legal parking space on the road.

You're being an inconsiderate arse. There's a reason why that 'space' is free even when it's busy - everyone else has the common decency not to park there. It might well be that they are waiting on the local council to approve/install a dropped kerb there. If they haven't already then I'm sure you're actions will prompt them.

Erm I haven’t paid anything for anything thanks. Our drives come with our houses attached to the garages across the road.

Would the people saying it's a driveway whether legal or not be as courteous if the resident had simply painted themselves a parking bay outside their house? You can't claim something that doesn't belong to you and get pissed off when people don't agree. Buy a house with a legal bloody driveway or apply for one! If every resident did this noone would be able to park anywhere other than car parks.

Even though there is no dropped curb if you’re blocking access to a highway you are breaking the law.

I'd be really interested to learn what other illegal things those people defending the person with the not-drive would be OK with, even to the point that they seem to be having a go at a person who is behaving perfectly legally?
