Phone dropped in the North Sea? Everything 'unfortunately' wiped from devices?

YABU - those things really were totally coincidental that happened just after they were told to hand them in

YANBU yeah ...right...

So is this like losing a pawn early in the game? Now CR has to show that one or either of them sold stories?

DrSbaitso · 15/02/2022 08:16

@thebellagio

Can anyone explain why CR lost part of her battle yesterday and cannot include the PR agent in the legal claim? I’m not sure I understand it - I just read that CR had to pay the PR agent £65k?

CR is the only one coming out with any dignity with all of this

She didn't pay the agent £65k, she paid £65k towards the agent's costs. She had tried to bring a case against the agent for misuse of private information but it was thrown out.

She's been given permission to amend her defence to include alleging that Vardy leaked to the Sun via Watt. In essence, to say that her original claim was substantially true even if Vardy wasn't the one who actually pressed send; to say that she was the leak is near enough to the truth.

Given the text messages that have been revealed, and the unfortunate destruction of court-ordered evidence, I don't see how Vardy can win now. But I'm not an expert, and this case keeps changing, so who knows.

UserBotLurking9to5 · 15/02/2022 08:22

I hope colleen wins.

Vardy seems like a narcissist.

UserBotLurking9to5 · 15/02/2022 08:23

But legally, i know that's not relevant

Essentially, adding the agent at this stage would either delay the case or give the agent insufficient time to prepare. The judge's view was that, if she wanted to include Watt, Rooney could and should have applied to do so earlier.

Not being able to claim against the agent doesn't really affect Rooney's defence. She has always had to show that either Vardy was leaking or someone was leaking on Vardy's behalf. She does not have to show that stories were sold, just that they were being passed to the papers.
UserBotLurking9to5 · 15/02/2022 08:27

So including watts will lead to a delay?

UserBotLurking9to5 · 15/02/2022 08:29

But the judge allowed her to add Watts, so the judges view that cr should initially have included watts doesnt matter?

It's about whether it's true that Vardy leaked stories, directly or through someone else acting for her. Who that person is isn't really relevant to the case.
thebellagio · 15/02/2022 09:39

Thanks for the explanation @DrSbaitso

I think what threw me was I saw the headline on The Sun, who as we know, are firmly in the pro-Vardy camp which distorted the whole story.

Honestly, this whole case is fascinating. And even if Vardy wins, her and Watts are finished because their true colours have now been shown.

No WAG will want to go near her, no brands would want to work with her and as for Watts, no client would ever touch her with a bargepole either. Not if thats how they talk about people behind their backs...

anotherdaynotanotherdollar · 15/02/2022 09:47

@prh47bridge I'm very glad you're on this thread. Gives a lawyers pov which is interesting to read.

So including watts will lead to a delay?

Including Watt as a defendant by allowing Rooney to bring a claim against her for misuse of private information to be heard at the same time as the libel case would delay the case by 6-12 months as Watt would need time to prepare her defence. The judge decided that, if Rooney wanted to take action against Watt as part of this case, she should have done so earlier.

But the judge allowed her to add Watts, so the judges view that cr should initially have included watts doesnt matter?

Rooney has been allowed to amend her defence to allege that Vardy leaked through Watt. That doesn't make Watt a defendant so wouldn't delay the case.

nauticant · 15/02/2022 11:02

The Sun, who as we know, are firmly in the pro-Vardy camp which distorted the whole story.

I see The Sun playing a different game. By "defending" Vardy The Sun are stirring things up to generate more heat than light while creating content for the paper. As a source Vardy's value is less than it was.

Aderyn21 · 15/02/2022 11:47

Having the Sun on your side is hardly a help, I wouldn't think!

It's likely to be the most widely read newspaper in the UK. If it isn't, it's certainly near the top.

You shouldn't be. It's a very easy and entertaining read.
TheWernethWife · 15/02/2022 12:23

These two women have spent bloody thousand on this case, why don't they grow up and do a Marcus Rashford, use their wealth for good instead of ego.

Itsalmostanaccessory · 15/02/2022 12:36

@TheWernethWife
Coleen doesnt really have a choice. Vardy is suing her. Did you want her to just bend over and not defend herself?

LoseLooseLucy · 15/02/2022 12:41

Oh I agree with "easy to read" alright, entertaining I'll pass on.

I don't agree with this. CR could have said publicly that she was not accusing RV directly but just that it was her account and someone could have hacked it. That was what RV was maintaining so she would have been happy with that. And subsequently CR tried to sell that same line to the judge that that was what she had meant. So unless you're saying the CR was lying to the court, she could have cleared up this mess before court proceedings.

Itsalmostanaccessory · 15/02/2022 13:12

@Louisianagumbo

RV wanted a public apology and for Rooney to say that Vardy didnt do anything wrong.
In my book, that's bending over and not defending herself.

Rooney did say that she wasnt accusing Vardy herself, but that it came from her account so it was someone with access to that account. The judge rejected that because the public would assume from her post that she thought it was Vardy. I dont agree with that ruling but it is what it is.

So again, Coleen had the option of publicly saying Vardy did nothing wrong (which she doesnt believe and why should she?) or she could defend herself. So she is.

And from what has come out, it is clear that Vardy did it. There is a high burden in court of course so it may go against Coleen but the public have seen who Vardy really is. I think Coleen would call that a win.
