legacy benefits court case

Its for the 20 pounds uplift that universal credit claimants got and people on legacy benefits didn't get..the case started yesterday and ends today.

I'm watching this case with interest as I'm on ESA and as such didn't benefit from the uplift. I admire the people who have sought justice for this. I can't imagine that the DWP have any reasonable defence (I'm aware they're blaming their software being incapable of adding the uplift to legacy beneficiaries and also their argument that we could have switched to UC if we believed we would be better off - because we are all capable of doing that, aren't we? It took 18m for me to receive ESA and I lost my house because of the delay so moving to UC wasn't worth the risk.).

I hope by close of today the case is successful and legacy beneficiaries are reimbursed rightfully.

I am on the old style system of income support I’m a carer for My disabled child and I was very annoyed not to receive the extra, and whilst I have sympathy for it being stopped now some of us never received it to begin with. I’m glad someone has challenged this it did seem wrong.

This is my situation and feelings as well. I'm glad it has been challenged.

I am too on income support and have a disabled child, I used food banks every week during the pandemic, I hope this goes our way too.. we deserve to be treated the same... It has always been down to DWP to transfer legacy benefits to universal credit.. and as far as I'm aware, I can't afford to wait up to 6 weeks for a decision during the pandemic let alone now too.

I was discussing this with my sister this morning,

She is in the same situation as several PP’s,
Claiming legacy benefits and not willing to risk the uncertainty of a switch to UC.

She spoke to someone at the job centre about it a during an appointment a couple of days ago and they are expecting a one off payment to be issued to people on legacy benefits, but nowhere near the £1500 uplift UC claimants received.

Which I think is absolutely ridiculous.

People who are in exactly the same situation should not be entitled to more money just because they claimed at a different time and happen to be in a different system, it makes no sense.
I understand that it maybe wasn’t possible to do the £20 uplift as a regular add on payment, but I'm pretty certain they could easily have set something up to work around it.
It’s like they treated it as a penalty for not getting on board with their stupid UC system.

My sister said she’s had several people at the job centre give her the hard sell trying to get her to switch over, despite her being financially worse off on UC, they use the ‘it’s going to happen eventually, wouldn’t you rather have control over when it happens’ argument with her.
I think it’s probably because it’s easier for them to manage UC claimants that legacy benefit claimants.

I know a out of work (never worked not claiming for any disability) adult male on universal credit Previously job seekers allowance, who got the 20 pounds uplift. My sister who has a severe disabled child is on income support and got nothing 😢 how is that fair 🤷‍♀️

Does anyone know what Benefits this court case covers? I am a carer for my son, we get Carers and Child Tax Credits, I’m not sure if that is income support?

The benefits involved in the court case are:
-Income-related Employment and Support Allowance (ESA)
-Income Support
-Income-based Jobseeker's Allowance (JSA)

Anyone know when the judgement/ruling is due?

Sorry @Amar8989 - I just re-read your post. As far as I know, CTC and carers are not the same thing as income support.

Fingers crossed here too but doubt it. On ESA can’t see it happening. It’s hard when a disabled people are routinely let down on purpose. There no really reason why couldn’t been included. The Gov couldn’t afford give me £20 week that bridge to far but you could been furloughed and got second job and had 2 incomes and this was total fine

The argument that the legacy It system wouldn't be able to facilitate the increase is nonsensical. They can apply the annual uplift (when one is given), so no reason why this couldn't be done in exactly that same way.

Just read article as well oh dear it’s to complicated card ha ha. As if some poor person at DWP would have to go through and Change the amounts on each person. They seem mange fine for pennies on any uplift or our fantastic £10 Xmas bonus or even cold weather payment which triggered “automatically” when your local area drops below 0c for 7 days in row. There is computer program for that ….

It's estimated that the business bounce back loans will cost the government £27 billion due to fraud, businesses gone bust, and money that has just disappeared. Yet people are more bothered about those on the lowest incomes, getting an extra £20 a week.

My Money is on poor government everyone is picking on them only doing their best and no rules were broken rubbish. But because they are so amazing caring they give everyone on legacy benefits £100 and half society will think we are money grabbing some scum bags and spent it all on fags. Grin

Ah, thanks for the reply, it’s all very confusing as the people involved in the court case are ESA, JSA and income support, however I wasn’t sure if they didn’t have representation for Carers, as some articles refer to Carers but most don’t 🤔
