Can my employer ban me from the office?

Anothercovidthread · 05/11/2021 23:23

NC.
I have recently started a new job. It is a non customer facing office job, based in Scotland. The company is very large. I have been working from home since I began the job due to covid restrictions. Today, we were told that we will return to the office towards the end of the month and going forwards we will do 3 days in, and 2 days from home. However, to enter the office, you must show proof of having had 2 covid vaccines. My employer will not store details of who has been vaccinated, you just need to show the info to enter. If you have not had the vaccine you are not allowed in the office unless special circumstances and permissions are agreed directly with HR.

I'm still in probation so very concerned about kicking up a fuss but I think this is very wrong.

 1. Why should I have to share medical information with reception staff on a daily basis for the foreseeable?
 2. Can the company legally ban people from the office for not having a non mandatory vaccine?
 3. Assuming that if you have some kind of non vax agreement with HR, you are provided with some other documentation allowing entry to the office, is the company allowed to insist that its shown on a daily basis to whoever is on reception?

AIBU, the employer is just taking steps to keep people safe?

Thank you @numbertheory and @blancheb , I don't no why but the thought of sharing what I consider private information, is causing me to become quite anxious. I appreciate your comments.

Perhaps I am old fashioned but I find it very strange that so many are so open with their medical records

And again, you are not being asked to be open with your ‘medical records’, merely to explain, to your HR department, confidentially, why you are unable or unwilling to comply with a health and safety measure.

It’s unreasonable to expect an employer to make adjustments for your disability if you won’t disclose to them that you have one.

BoredZelda · 06/11/2021 00:50

My employer is not in the health care industry though

Neither is my husband

we don't have clients visiting and my team and I perform a non critical function.

Doesn't matter, there is no distinction between employers or industries or individual roles when it comes to the law on it. They can insist you are vaccinated.

ChaToilLeam · 06/11/2021 00:51

It’s a vaccination certificate, not your whole medical history. They are not asking for your smear test results. Honestly, what a ridiculous fuss in the middle of a pandemic.

Anothercovidthread · 06/11/2021 00:52

@ldfdyjxzyjkv thank you for the link however, it is dated Jan 2021 and much of the info is out of date. I have tried Googling but cannot find definitive answers.

One thing covid has shown is all of a sudden, non disabled people think having to do the kind of stuff disabled people have had to do for decades is entirely unacceptable. I'd love to think this will lead to a change in how we treat disabled people but I expect it won't.

Anothercovidthread · 06/11/2021 00:55

@boredzelda perhaps you are correct. I would have thought it would have been a condition of employment or an update to current terms if that was the case.

No they can't just because they want to, they need to be able to prove good reason. ico.org.uk/global/data-protection-and-coronavirus-information-hub/coronavirus-recovery-data-protection-advice-for-organisations/vaccination-and-covid-pass-checks/

FranceTeam · 06/11/2021 00:56

They can’t force you to have a vaccine unless you work in the care sector, and soon the NHS a will enforce this too.

But get the vaccine, don’t be so stupid not to.

BoredZelda · 06/11/2021 00:58

Your link is about the collection and processing of the data, not the act of requiring people to be vaccinated.

Mantlemoose · 06/11/2021 00:58

Also loving all these people getting their knickers in a twist about someone who dares to question.

Anothercovidthread · 06/11/2021 00:58

@chatoilleam I can't get my head around the difference. Neither will stop transmission sadly.
@burnto I really don't feel comfortable sharing the information. If it was a one off and the details could be added to my pass then I could maybe understand but to have to show the information 3 times a week to different people, I just don't see that its anyones business. If the vaccine was mandatory then fair enough but its not. In Scotland, care staff do not have to have it either, thats only England as far as I'm aware.
You're not comfortable because you haven't been vaccinated. No such fuss would be made if you were.

PonyPals · 06/11/2021 01:00

It is absolutely mandatory, here in Melbourne Australia, to show proof of vaccine. You can't do anything without it especially go in the office.
I don't understand people like you. What do you think people will do with your "medical information"?
Frankly my dear, no one gives a damn

They are asking for proof of vaccination and unless they can prove why they need this which comes under your personal medical information OP does not have to provide this information because they have to have a reason for wanting it. Swings and roundabouts.
Anothercovidthread · 06/11/2021 01:03

@franceteam in Scotland, there is no requirement for care staff to be vaccinated. This is a rule affecting England.

If that is what you surmised from reading that link, your comprehension skills need a bit of a brush up.

Anothercovidthread · 06/11/2021 01:07

@ponypals they don't plan to store the data so they are not going to do anything with it however, for some reason they give a damn enough to want me to waive it around 3x per week.

The situation in Melbourne appears very restrictive from how it is being reported on UK news. I would not think it best to take tips from a country in such dire circumstances approaching 2 years into a pandemic.

OP posts:
Newmum29 · 06/11/2021 01:07

Not sure what the problem is. In Australia you have to show proof of vaccine to enter anywhere (restaurant, supermarket, office).

You are only making a fuss because you're not vaccinated.

You would not be posting this if you were vaccinated and you wouldn't care about "waiving" it around (what a stupidly dramatic thing to say) either.

So, why aren't you vaccinated? Or do you not want to say why on an anonymous forum, because you know it's confidential.

Not take tips from Australia? Remind me how many they've lost to COVID?

Thanks 👍🏻

DriftingBlue · 06/11/2021 01:16

It would just be more efficient to cancel the passes or anyone who has not provided proof of vaccination or a valid medical exemption. Once a person provides the documentation to HR, they can have the pass reinstated.
