Help! Who is in the wrong me or my boss!

So. I need help. Very long post...

Scared to give all of the details as quite outing but necessary for context.

Worked for a company for 11 months. In that time 3 staff have left. Heard lots of stories about staff retention being generally awful but we are left with a team of 5.

2nd week of being with the company.. boss: oh you live by another colleague can you bring them into work and drop them home? Me eager to please says yes. I have done this every day that we are both in the office which is DRAINING, draining to talk, draining to not be able to call friends as I used to on my commute.

Due to Covid also, cleaner for the office was cancelled. Can we guess who took on the responsibility?

Grew really close with my team, love them so so much but couldn't help but feel the job wasn't for me. I couldn't focus and really didn't enjoy it. I find I am often the motivator of everyone with little input from my boss. She has no idea how her team feels at all.

I started the role on antidepressants and became determined that this would be the year I work on my MH for me and my family. I have been off medication for a number of months.

With this new clarity I decided to look for another job. In this time ANOTHER colleague hands in their notice. In doing so they were offered a pay rise, access to a pool car and to WFH.

I handed my notice in 3 weeks later to be told I am a disappointment for doing so. My reasons of family issues with childcare were null, and it wasn't a good time for my boss or the business. I have been told that despite my colleague being there longer and working 4 weeks notice. I have an 8 week notice and generally the conversation wasn't very pleasant. I left the room stating I would try and see what my new company would accommodate.

HERE IS MY ISSUE.

My contract does show a 2 month notice; for them to give me should they wish to terminate my contract. Further down it states that I am to give them one week.

Everyone I have spoken to says that clearly she is wrong but I don't want to leave leaving a sour taste, I am not a bad person and to say I am anxious about tomorrow's follow up would be an understatement. How do I comprise and how do I make this right? The sense of dread I have had all weekend is awful. I don't want to leave my team in limbo but this is a great opportunity!!

Tomorrow I would email my resignation and take the week off as sick leave tbh.
This way you don't have to deal with them in person and you have evidence that you handed in your notice. If they come back and say 8 weeks, send an attachment with the relevant bit highlighted.

If you have already handed in your notice and it's near or gone passed the week, email to ask when you can come into the office to collect your things and hand any of their property back. If she lies and. says its. 8 weeks, email your contract with the relevant bits highlighted.

You haven’t answered the question OP - what date did you hand your notice in & have you then in effect worked your weeks notice?

Sorry! I went in to hand it in and discuss it with her Friday morning. I handed in my notice then but was sure it was a weeks notice. She then told me it was two months and that it should technically be three as she needs to recruit and find a replacement. I said to her that I don’t think my new company would wait that long and I needed to ask how long they would wait for me and left the conversation shocked and upset at her reaction. I had my contract at the end of the day and realised the wording of it Friday evening so I am going to discuss it with her tomorrow and tell her it’s a week.

Good luck op be strong take your contract in with you when you talk to her . If they say no it’s 8 weeks say no it’s 1 week as per my contract hand your notice with your leave days and end conversation. They can’t do anything they are just trying to bully you . It’s not your problem they need to recruit, you don’t stay on until they find a replacement unless that’s what you agree .

I would take the contract with you and say “sorry I think you’ve read the wrong bit- the employer needs to give 8 weeks however I only need to give one, here is my resignation letter reconfirming the date of my last day”

And follow up with an email “as per our conversation today my last day as per my contract will be on x date”

Also make sure they pay you for any holidays outstanding.

I had this once.
Contract was zero notice either side in the first month.
I gave one week and was told I needed to cover new ur as boss was abroad.
Said I was a disappointment to not do at least 3 weeks.
Became unwell after 3 days and didn't bother going back.
I never put it on my cv and despite threats it wouldn't look good I never looked back.

I assume they wrote your contract - it's their contract essentially - so embarrassing for them to get it wrong

Ignore the scribbles, I sent it to numerous people to see if they spotted an issue and it’s what my best friend sent back with a lot of swear words and agreed with me 😂 but this is the wording of said contract

Sounds like you are well out of there. Go in tomorrow with your letter already written and include the wording "i hereby give one weeks notice to terminate my contract as per section ?? of my contract of employment". You don't need to explain yourself or give a reason why you're leaving. They don't own you, it really is just a job. Good luck in your new path!

I would send her an email, tonight if that's possible. In it I would write:

As per my resignation letter handed to (her name) on Friday (date), I have checked my contract which states that (copy exactly as stated in the contract, the bit about the company has to give you 8 weeks notice, but you only have to give them 1 week) I am therefore writing to confirm that I will be leaving the company's employ on Friday 13th August.

If you can email it, not only do you have a paper trail which she can't refute in any way, but it also saves you having to do any explaining in person, as you will have already pointed out the situation in the email.

Yes you've read it correctly, they didn't proofread what they write. Do not hand over the copy you have if it is the only one.

You are not going in to have a discussion with her. You are going in to tell her the contractual obligation and that your one week notice started on x and your last day is y.

Thats is all you need to say, your informing her, its not a discussion. End of.

And her staffing issue doesn't give her the right to state you have to give 2 months notice period. What a cheeky cow.

well done on getting the new job!
If they say they are disappointed in you, just think (or even say!) that you are disappointed in them, their bad communication, their inappropriate requests and expectations of staff, their lack of staff welfare, etc!
If she says there's a mistake in the contract, that is their problem. You signed the contract they gave you and that's the one that applies particularly seeing as you have a print and electronic version saying the same thing!
I would also either go sick for the last week, or if I did work, work to rule - definitely no cleaning, nor giving the other person a lift - could say you're going out to celebrate leaving every evening Grin.

Stand your ground. Their not friends and they would happily fire you if you did wrong so tell them straight they have 2 weeks an that's you been a nice person. Take it or leave it.

This is pretty much word for word what I was going to suggest. Send it as an email, now if you’ll feel better for having sent it, then you have a paper trail and don’t have to have a meeting.

If she does try to speak to you about it, “my contract states I need to give one week’s notice. I will be leaving on [date]” / “that doesn’t work for me” / repeat.

How long have you been there? As the image you just put up says 6months to a year 2 months. Have you been there over 6 months?

@FunMcCool - it says the company needs to give her two months notice, she needs to give them one week.

You said you've worked there eleven months - it says on that screenshot that if you've worked there between 6 -12 months your notice period is 2 months.

So you do have a 2 month notice period.
