To be angry with bike shop for selling me a second hand bike as new?

I bought an expensive bike last week from a well known National bike shop chain. Bike was reduced from £2700 to £2200 as I was told it was last year’s model. It’s a seriously well specced bike.

Turned up for a club ride yesterday and people there recognised the bike, it’s had custom bar tape put on it which makes it distinctive. Someone who works at the bike shop was there and made a comment about how the bike had won a National Grand Prix. I didn’t click at first and thought he meant that make/model. But later on other people were saying oh that’s x’s old bike. I’ve now found public posts from x on the bike shops fb page dated from 2019 with photos of her with the bike saying how she’s entered numerous races with the bike.

I tried to register it with the manufacturer yesterday on their registration scheme and can’t register it as it’s already registered.

So they’ve basically sold me a 2yo second hand bike and pretended it’s new. Don’t get me wrong…it looks in good condition, they’ve obviously cleaned it well, possibly they’ve put a new chain/cassette on 🤷‍♀️ But I wouldn’t have paid that amount of money for a second hand bike. At the end of the 2019 season another National chain were selling them new for £1900!

I’m going back to the bike shop today to attempt some serious price negotiation but not sure how far I’m going to get. If they don’t budge on price I think I will have to insist on a refund as it’s just making me angry now. A similar spec bike in this year’s models is about 4k though as the bike model has been seriously redesigned and upgraded (disc brakes from rim brakes) and I can’t afford 4k. They’re also all out of stock.

A friend was with me when I bought it and she’s as shocked as me, says she also thought it was a new bike. It was lined up with this year’s bikes.

You need cash back. Definitely contact watchdog or the R4 money program they love cases like this.

They have already offered her a full cash refund.

Yes, that is true but it's a theoretical point only - she's never going to get a full refund plus damages for the inconvenience of having sold her own bike unless she takes them to court.

Well, after reading this I can honestly say that I won't ever be buying a bike from this manufacturer and will advise everyone I,know to avoid them like.the plague!

That is absolutely disgusting service.

I would go public and properly name and shame, although I worked it out from the info you've given as have many others from what I can see.

I wouldn't let it drop either. I would be posting on forums and tweeting, etc.

I wouldn't accept the bike I'd take the refund they said they replaced something scuffed how did it get scuffed? Sounds like the bike has been in an accident? No way is it worth what you paid. And they lied to you about it being new which is illegal.

If you bought a different bike instead of this one, would there have been one in your size and price range at that time? Has purchasing this bike meant you've lost out on purchasing others? Is the reason you're reluctant to accept the refund because you have a cycling holiday booked and no bike? Can you hire a bike?

No need to answer the questions here.

Does your home insurance have any legal advice included? Can you get legal advice some other way?

I think you could have grounds to accept a refund on the bike and take them to small claims court for the loss of money on hire bike/cancelled holiday/extra cost of replacing the bike with something equivalent and New now if you wouldn't have incurred that cost earlier in the year. Or keep the bike, take them to court, and ask the judge to award an equivalent replacement bike that's New, which is what you were supposedly sold.

What about those no win no fee lawyers? I can imagine they'd take this case on as the company has broken the law so it'd be an easy job for them?

Have they offered a full refund or vouchers? Vouchers isn't a full refund, and that is what you are entitled to. Get your money back, don't give the fuckers your money.

This would be too small for that type of lawyer. No win no fee is generally for personal injury work or large commercial disputes.

I can see you are screwed and will probably have to accept the offer in order to go on your cycling holiday holiday, but I would still refer this to trading standards. It's good they have a record of this fraudulent practice. Copy the shop and head office in on your report. It's too late for you but it might help future buyers.

I'd take the bike on holiday (meanwhile tell them you're considering your next steps.... appointment with solicitor, etc) then deal with it when you get back. It's second hand so unless you really scuff it up bad, how will they know you have used it? (Disclaimer, not a cyclist so no idea if this is possible)

I've figured out which bike brand it is. I don't spend that sort of cash on bikes, but I do need to sort out bikes for teenagers this year. I have no brand loyalty to bikes but I'd discount that one purely because they are defrauding and ignoring a woman.

I haven’t time to RTFT, but tell them you will contact Anna Tims, the ‘Your Problems’ person at the Guardian, if they don’t budge. She will love this, as so many consumer laws have been broken!
If they still don’t budge, do it!
She gets results, and they will get a whole lot of very bad publicity.
But give them the chance to do the right thing first.

If they are going to offer you a full refund and take the bike back, will they be trying to flog it to someone else as "New" or "As-New" or "Nearly New" I'd wonder? They can't sell it as a new bike as it isn't, it's had two careful owners.
They can't sell it as "As New" or "Nearly New" as neither of those descriptions fit either. They would have to sell it as at best "Second hand" which you say they don't do in this branch @YellowBellyCat or more accurately "Two previous careful owners".

I'd tackle them on how they plan to resell the bike and with your refund, if they reduce the price, buy it back!

Your situation won't have changed. You've still been sold a secondhand bike as new and at higher price than you would have paid had you known it had done thousands of miles and been ridden hard in competition. It's still a bike that comes without a manufacturer"s warranty.

All the info is in the thread.... If you read it you will see that the reason the OP is annoyed is because she got rid of her old bike when she bought her (not) new bike. If she gives the (not) new bike back for a refund she will be left without a bike. There is a huge shortage of bikes so she can't find another bike to buy that would be the correct type and size. She has a biking holiday coming up so needs to have a bike.

Cheeky bastards. Totally chanced their arm and have lied through their teeth about you getting a secondhand bike. Tell them you’re planning spread it all over social media and around local forums/cycling groups and see if that might change their mind
