To be angry with bike shop for selling me a second hand bike as new?

I bought an expensive bike last week from a well known National bike shop chain. Bike was reduced from £2700 to £2200 as I was told it was last year’s model. It’s a seriously well specced bike.

Turned up for a club ride yesterday and people there recognised the bike, it’s had custom bar tape put on it which makes it distinctive. Someone who works at the bike shop was there and made a comment about how the bike had won a National Grand Prix. I didn’t click at first and thought he meant that make/model. But later on other people were saying oh that’s x’s old bike. I’ve now found public posts from x on the bike shops fb page dated from 2019 with photos of her with the bike saying how she’s entered numerous races with the bike.

I tried to register it with the manufacturer yesterday on their registration scheme and can’t register it as it’s already registered.

So they’ve basically sold me a 2yo second hand bike and pretended it’s new. Don’t get me wrong…it looks in good condition, they’ve obviously cleaned it well, possibly they’ve put a new chain/cassette on 🤷‍♀️ But I wouldn’t have paid that amount of money for a second hand bike. At the end of the 2019 season another National chain were selling them new for £1900!

I’m going back to the bike shop today to attempt some serious price negotiation but not sure how far I’m going to get. If they don’t budge on price I think I will have to insist on a refund as it’s just making me angry now. A similar spec bike in this year’s models is about 4k though as the bike model has been seriously redesigned and upgraded (disc brakes from rim brakes) and I can’t afford 4k. They’re also all out of stock.

A friend was with me when I bought it and she’s as shocked as me, says she also thought it was a new bike. It was lined up with this year’s bikes.

I would say that you want a replacement NEW bike of the same spec ie what you were sold and to retain the old bike until the new one is available. As the current bike is well used, using it a bit more will not significantly reduce its value.

To compensate you got the sheer faff of their behaviour, they should throw in a couple of free services/vouchers for goods. I would want this agreement in writing.

It might, if (as I suspect) they offered a full refund because they know perfectly well they can re-sell it as new yet again

There's only so much wear and tear before replacing bits to fake a "new bike" isn't worth it any more - though at these prices they'll probably try harder than if it was a cheapie

I would tell the Manager exactly what you want and I would tell him that he can let the public decide if having a staff member use a bike in races constitutes a second hand bike.

Get onto Trading Standards for full clarification.

IMO this is a story for the papers.

I think is is disgraceful dishonest behaviour.

His denial is so dishonest and I am always grateful when dishonest practices in businesses are flagged to the consumer.

Whatever the outcome, I think it should be published.

Since they’re so certain it’s a non-issue I’m sure they won’t mind you going to the press to let their customers know that any bike they purchase that isn’t current season could actually be heavily used. After all, there’s nothing wrong with it, right?

£200 store credit is an utter pisstake. Go over their heads.

I hope you have assembled copies of the photos from FB.

They have absolutely committed a fraud in selling that bike and lying about it not being in competition and heavily used.

Is there any way you can order another bike and keep this one for your cycling holiday?
Tell them you’ll return it for a full refund when the new one arrives? Or after holiday?
I can’t see why it would be a problem if they’ve been happy for their staff to ride it for the past 2 years and then sell it as new? (Albeit refurbed )

Totally bizarre, never known any other retail chain have that MO. Also a lengthy piece on how they don't have to stick to the rrp and can charge what prices they like.

They're actually quite right that they can "charge whatever they want", but what they can't do is misrepresent things

At least not legally, but unfortunately that doesn't seem to bother them at the moment, so you'll have to make them bothered

I suspect Giant the manufacturer have a rather loose relationship with their "flagship" stores who are often independent bike shops, for example the Rutland one is a branch of Rutland Cycling. It's not like Marks and Spencer.
Definitely a "speak to the manager" moment if you haven't already.

Is is perhaps a franchise operation?

Regardless, you are being shoddily treated, OP, and I think perhaps it is time to report to trading standards/the police/get the press involved.
