AIBU knowingly not refunding all the money

I had a nightmare lodger who I kicked out. Basically she was worried about her family members catching covid and started to be intrusive about my personal life. Cat vomited on the sofa (not the first vomit) and she decided to berate me about not taking pics/telling her. Final straw came when my bubble weren’t allowed in my back garden for birthday cake - yet she broke the lockdown laws by seeing her boyfriend all the time, and he would stay every other weekend.

Anyways, she wanted her deposit/rent back - which she asked for via email stating “I deem 7 days to be enough time and forward me receipts for any deposit money taken” told her to read the agreement (that she wanted) which meant I would send via cheque within 3 weeks.

The money went out of my account, however the amount is £100 lower than what I owe her. I didn’t take a pic of the filled in cheque and she’s not contact me.

I’m sure the banks didn’t make an error and she’s the type to follow up the money.
AUBU by just ignoring the short money?

this is very odd, OP. Why use cheques (really, they are not a thing in most of the world any more). There's no way the bank made a mistake. Cough up and transfer the remainder.

Read my post the process for credit cheques to the recipients bank account and debiting from the payer is separate. So it is possible that there has been a mistake made in the debiting process.
You can always get a copy of a cheque. It is an audit requirement for a bank or building society to keep images of a cheque paid in or cheque withdrawn for a number of years that’s not an internal requirement - it’s set by the regulator. Contact your bank again. Don’t contact your former lodger as she may not be involved in this mistake at all.

OP, you are coming off really poorly. Passive agressive, positively gleeful at your 'bint' of an ex lodger, when everything she complained about sounded completely reasonable in my eyes. It's ironic you've said she is the kind of person who always has to be right, when it is clear to see from your responses that is actually you. Your lodger is probably glad to be rid of you and thinks the £100 isn't worth the aggro from you.

Would you contact your lodger who was a hint when the right amount didn’t go out of your bank account? By the very fact I’ve made this post shows I want to fully explore my opinion.

I’m curious why you would wait a week though? You either want to pay it back to her or you don’t. It would take a few seconds to send a text asking her to confirm how much the cheque was cashed for. 🤷🏻‍♀️

16 years working for a financial institution they do 100% make mistakes. The actual cheque crediting and debiting process is separate so it is entirely possible that she has received the full amount of money and you have been debited the wrong amount.

I will see if she messages me :)

I don't know why you need to keep referring to her as a "bint". Is it necessary? I can see the lodger not contacting you re the £100 missing. I'd probably take the loss if I were her.

You admitted you knowingly didn't refund the full amount owed to her. So yes YABU.

But the lodger is the winner here for getting away from you.

@slashlover if you’re referring to me I am not actually agreeing with the OP i have said that banks make mistakes and that it is possible that the lodger has been paid correctly but she has been debited incorrectly. I have said contact the bank as they have to hold copies of the cheque. I would never suggest that she withholds the additional money if she owes it. That would be completely out of order. But why aggravate a bad situation if she doesn’t have to.

The reality is either she wrote the cheque for the correct amount and there has been an error (at least at her end) or she made a mistake writing out the cheque. I very much doubt the latter or the unpleasant former lodger would no doubt have been straight back on to you to complain.

In the circumstances I would wait until she contacts you as it may be she has received the full amount and there is no need to give her any additional money at all. If she does say it appears to be short then you know that you can check with the bank at that stage and send her more if need be.

Whatever has happened it has not made the OP a thief as suggested above.
