AIBU knowingly not refunding all the money

I had a nightmare lodger who I kicked out. Basically she was worried about her family members catching covid and started to be intrusive about my personal life. Cat vomited on the sofa (not the first vomit) and she decided to berate me about not taking pics/telling her. Final straw came when my bubble weren’t allowed in my back garden for birthday cake - yet she broke the lockdown laws by seeing her boyfriend all the time, and he would stay every other weekend.

Anyways, she wanted her deposit/rent back - which she asked for via email stating “I deem 7 days to be enough time and forward me receipts for any deposit money taken” told her to read the agreement (that she wanted) which meant I would send via cheque within 3 weeks.

The money went out of my account, however the amount is £100 lower than what I owe her. I didn’t take a pic of the filled in cheque and she’s not contact me.

I’m sure the banks didn’t make an error and she’s the type to follow up the money.
AUBU by just ignoring the short money?

I would ask my bank for a copy of the cheque, for my own peace of mind. Plus, should she come back to you, you will have all the details at your fingertips.

Request from whom? Banks hold the cheques once they've been cashed. You can always get photos of cheques.

I recently wrote a cheque for £50 and £500 went out of my account. The recipient contacted me and we got a copy of the cheque clearly stating £50 in figures and words. Banks do make mistakes

The bank should be able to provide a copy of the cheque. I'd go back and query that with them again. I worked in a bank some years ago when cheques were sent back to the branch once processed. That stopped and all cheques were held centrally somewhere, but we could still get a copy on our system if needed.

I thought a deposit had to be held in a Deposit Protection Scheme? Or is that only for tenants?

Kicked out? Bint? Cow? Knowingly not refunding her money? Because she didn't want to sit in cat sick or you having birthday parties? You're obviously not going to refund her money so not sure why you posted this in the first place.

I would say if it's a bank error then she needs to sort it out, by going into the bank and showing them. if you write out a cheque for the missing £100, she could then go to the bank and do the above and then you'd be £100 short.

@DesEx reread the thread. I wrote a check out for the right amount (in my mind) just less has come out. So either bank error or my error. Either way I don’t know why ex lodger hasn’t contacted me

I read the thread and your OP.

I had a lodger who, unfortunately, I had to evict. As per the tenancy agreement I refunded her deposit by cheque but £100 less has come out of my account that the amount on the cheque and the lodger hadn't contacted me. What should I do?

Leave it; if she's £100 short I'm sure she'll contact you. And you can then request she speaks to the bank as to obtaining confirmation on the amount on the cheque. She obviously banked the cheque and if the amount on it was £100 less then I'd have thought she'd have contacted you then so likely a banking error.

YABVU for not contacting her to confirm she's recieved the correct amount and is happy with what has been received, as you acknowledge you very well may have made a mistake.

No idea why you've posted on AIBU if you're so defensive about what you've knowingly done.

@slashlover no, I need to make sure the person knows that it’s withdrawal bleed, not a period. Therefore if she’s not having a withdrawal bleed, doesn’t mean she’s pregnant. Big difference darling,

I’d contact her and pay the £100. She sounds like an annoying lodger and I don’t blame you for ending the arrangement. Regardless of how little you think of her I think it would be wrong of you to pocket the money. It’s ‘her’ money not yours. 🤷🏻‍♀️ I know lots of people would just keep it but I know I couldn’t as it would feel wrong to me and I’d feel cheep if I did.

@StellaDendrite that’s what I felt like doing as soon as I knew. But at the same time I find it weird she’s not contacted me, so I’m thinking the bank did make a mistake. I think I’ll leave it a week and ask her if I sent the cheque for the right amount.
