The underlying argument for de-regulation and small government, ie not having laws to regulate behaviour in advance, is that if people say or do something badly wrong there are still laws to pick them up afterwards. Laws which mean the action is taken by companies and private individuals, rather than by government, fit this model particularly well.

I've seen this stated explicitly about Health & Safety regs ("if the device kills someone, their family can sue afterwards").Hmm

Without getting into the merits of this approach, it does have as an essential ingredient the "can sue afterwards." Something Fox and others seem to have overlooked.

They are now being reminded.

I'm always a bit twitchy about libel, slander and defamation laws, because they're problematic regarding where one draws the line.

However there has to be some defence against people who knowingly lie to harm others for their own benefit.

I will be very interested to watch this shake down.

I wonder what a company ought to do about phosphorus-polluted water. I mean, what would be the thing that could be done to get rid of the phosphorus, or rather, have started to be done thirty years ago and more for this particular place? The only really effective way I have heard of is long-winded and difficult, involving many stoneroller minnows, and probably costs a lot too, particularly for millions of gallons of water.
