Part of the defence in the George Floyd case seems to be that he had a heart condition and had taken some drugs.

So police officers restrain people with the assumption that they are healthy, do they? Oh, well, that's OK then Hmm[anger]

Hansen was a great witness. I do think it's unfair to call it 'arguing' with counsel and the court when all she was doing was trying to explain an answer.
The judge says it's not up to her to decide when she has answered her question or words to that effect Hmm

My DH has a 'heart condition'. He's fine and dandy (and mowing the lawn at the moment!).
He wouldn't be fine if his neck was knelt on for 9 minutes. Sad

I didn't feel Hansen was 'arguing' at all. She was just trying to be sure that the defense understood that she wasn't going to back down from what she said despite them trying to change the meaning of her words or put their words in her mouth. Their treatment of her bordered on badgering as far as I'm concerned. And I certainly didn't see her arguing with the judge.

I wonder if that judge is a Republican/Doofus supporter. He certainly acts like it. I've noticed him sitting there resting his chin on his hand looking bored or half asleep during witness testimony describing the brutal treatment. V disrespectful and gives the impression that he doesn't consider the testimony worthy of one's full attention. What message does that send the jury, I wonder!

The Matt Gaetz situation has me a bit gleeful. DH said he read an article that said that this whole thing is the result of a different (unrelated) investigation that was started by Barr at Doofus' behest.

A $25m 'extortion' attempt by a former DoJ employee based on a 'false allegation'? Don't make me laugh. There might not always be fire where there's smoke, but in this case the building is already a conflagration.

Then afterwards Carlson saying he couldn't remember that at all.

I agree with you about Hansen.

With regards to Gaetz, I'm trying to figure out what the buggery is going on.

I did watch the clip of Tucker interviewing Gaetz. Gaetz trying to bring Tucker in as a witness and Tucker quickly denying any knowledge/memory of the dinner Grin

He also says that it is counsel's prerogative to ask her leading questions? Is that really the case in US courts? Over here it's a definite no-no: ask a leading question and get your wrist slapped by the judge.

The defence in this case would amount to "I didn't mean to", which is no defence in law. It goes along with "ignorance of the law is no excuse"; ignorance of his heart condition is no excuse.

Unless "I didn't mean to" is a defence in US law, which I find a bit unlikely.

I'm wary of over comparison of UK (by which I mean English) law and US law. There are some fundamental differences in philosophy.

However it does seem to exist in the US too.

The bottom line is if you do something wrong - say excessive force - then you own the consequences of that. In theory at least.

In practice I have no doubt that courts can find ways to fiddle that one if they want to let a defendant off. A uniting feature of UK and US jurisprudence.

Leading questions are generally not allowed in direct examination, but they are generally allowed in cross-examination.

In a post shared to her Instagram account, Lara Trump, who is a Fox News commentator, shared a message from Facebook officials alerting her they had removed a video teaser of an upcoming interview with her father-in-law on Fox News.

“This guidance applies to all campaign accounts and Pages, including Team Trump, other campaign messaging vehicles on our platforms, and former surrogates,” the email, posted to Instagram stated.

It added that “any further content posted in the voice of Donald Trump will be removed and result in additional limitations on the accounts”.

In that interview Gaetz didn't specifically allege that this supposed employee 'made allegations' of improper conduct, just that they would make them 'go away'. To me that implies that there are allegations there in the first place. His saying the allegations are 'false' seems to be an afterthought.

I watched a part of POTUS speech about his $2trillion 'once in a generation' infrastructure plan.

He sounded good, he welcomed input, he knows he has a helluva job in front of him to get any Repubs on board.

What I found interesting was the corporation tax rise from 21% to 28% but then it was said it was 35% before Trump came to power and he was the one who slashed it to 21% in the last 4 years.

Whilst this part might be an unholy battle for months, the next part of his plan is seriously going to rattle Repubs, the American Families Plan, due to be unveiled in the next few weeks.
