Neighbour won’t give me my parcel

I ordered some things from a friend who accidentally sent my parcel to the wrong address (she put 1 in front of my actual number).
I know the neighbour has it as it’s been signed for on Hermes, I’ve knocked and knocked and I know they’re in but they won’t answer the door to me so I can’t get my parcel.
I can’t ask the seller as they have personal things going on and a very poorly DC so it’s not fair to put this on them. Anyone know where I stand please other than mailing them an envelope full of glitter? It was a lot of money and I’m very pissed off!

@bookworming fair enough if it was a signature required parcel- I’m just trying to point out that there is a scenario where the neighbour isn’t a thieving toe rag, they just don’t want to answer the door to a stranger unnecessarily (not clear if the op actually knows them, I only know and recognise my immediate neighbours so wouldn’t have a clue who op was if the parcel had been sent to my address). I would however respond straight away to a note through my door as has been suggested, so fingers crossed that’s what will happen for op too

It doesn't matter that it was sent to their address, it's not addressed TO them, it doesn't have their name on it so it's not theirs to open. If they dont respond to the note by tomorrow then I'd just keep knocking on their window and if I could see them I'd shout (not nastily just so they could hear me) "Hi its Jane from number 2, my friend sent me some baby stuff but she accidentally addressed it to number 12, I can see you've signed for it so can I have it please, it's the one that doesn't have your name on it. I really don't want to have to ring the police but it is legally stealing to take someone elses parcel that isn't addressed to you personally. And you dont seem to respond to me..." I imagine at some point they'll worry the neighbours will hear and will actually acknowledge you.

I’m having a similar dispute at present. My house name is Lakeside, my address is 1 Nowhere Street, Anytown. M&S sent me a parcel addressed like this:

Lakeside, 1
(two lines of unnecessary blank space)

Anytown
Nowhere Street
Postcode

So Hermes assumed the delivery address was Lakeside 1. There’s no street called Lakeside but there is a Cakeside. So they delivered the parcel to number 1 Cakeside. They said it wasn’t their fault because it was addressed to Lakeside 1 and they delivered it to Cakeside 1.

The dispute is still ongoing. M&S say they printed the correct address just the layout was wrong. It was clearly an L not an C, and the postcode was clearly for my house not for Cakeside which has a different postcode. Hermes say it’s M&S’s fault for not printing the address in a sensible order. The people at number 1 Cakeside don’t care because they got a free beauty advent calendar and they have no intention of giving it back.

Surely it's illegal for them to open a parcel that's not addressed to them? If you don't have any luck after putting a note through the door, I'd put a second note through threatening police action.

You say that, but....

I've seen some absolute shockers from Hermes, we've had numerous parcels from Boden that they swear blind they delivered to our address, on days and times when we've been home and sat in a room that overlooks the front door.

Worst delivery company by a mile in our personal experience.

Well you'd think it would be beyond obvious wouldn't you which is why I'm surprised several posters seem to be trying to think of any excuse why the neighbours are not theifs.

That’s ridiculous! Even if you live in a rough area I’d say the chances of the person knocking being a serial killer or someone who means you harm are minuscule. Also what’s to stop a psychopath shouting that they are police? Mumsnet is such a fucking weird place at time , it really is. So many of you dont seem to live in the real world.

Twice in the past month I've had junkies at my door who clearly didn't know where they were. (They were meant to be going to the guy who deals who lives two floors below me.) I saw them through the peep hole and shouted through the door.

@Feetoflead the op stated in the first post it was signed for! So they did open the door, they did sign for it and they are not giving it back.

This is based on what the OP is stating, of course people will say that the Hermes driver could have signed for it themselves and thrown it, lost it etc. But that's not what the evidence says.

Still the neighbours could communicate through a window, but they're sat ignoring the OP whilst watching TV.

Yes this and leaving packages at the end of your footpath/drive and scarpering. I lost a package with £600 worth of Christmas presents, in early December. Thankfully I got a full refund after kicking up a stink with the retailer for an entire month.

I’d try my best to get the parcel back, note though the door and threaten with police etc. But if it eventually became clear they weren’t going to hand it over I’m afraid they’d get a brick through the window.
Good to see that the totally ridiculous Eastenders type reaction hasn't become a casualty of covid.

No rational person would actually do this would they? Do you have some kind of untreated anger management disorder?

What else do you suggest if it becomes clear the parcel cannot be recovered and no refund can be obtained? Just let them get off scott free while I’m out of pocket?

Well it shouldn’t be ongoing, regardless of who was in the wrong, M & S know that you, their customer, have not received the item. It’s clear cut that they should reimburse you and deal with Hermes directly. Consumer Rights Act

If you see them going out and they use a car, perhaps block it in to get their attention, if you can.

You'd be even more out of pocket paying for a new window and a court fine.

Your friend, as a retailer, needs to follow consumer regulations. She has written the wrong address. She needs to send the goods again, to the correct address which you provided, and it is up to her to recover the lost items from your neighbour or accept that she has lost the money.

Being your friend does not change the law. I would just message here and say that you've attempted to get them back but the neighbiurs wont respond so could she please send them items to the correct address or issue a refund.

Unfortunately, when you buy from friends you need to sometimes put that aside and speak to them as a retailer. Your friend, if she is any good at her job, will understand and will be professional in regards to this.

You would genuinely go and find a brick and stand in front of a neighbours house and throw it through the window, seriously? Then is addition to being out of pocket you'd face a police charge.

Those are not the actions of a normal person, can you not see that?

Hermes aren't taking signatures at the moment. Was there a photo? Was it definitely delivered to those neighbours?

M&S are completely wrong. They need to issue a refund.

Your contract is with them. They must get the order to you. They can do that however they like, but if they contract out to a courier then that is their choice. If it goes wrong, it is their responsibility. They cannot leave you waiting. They must refund you and they can continue to fight hermes for the compensation payment but that is nothing to do with you.

Use the resolver website. They'll get it sorted out for you quickly and it's free

Hope things work out with the note. I'd keep at it if it doesn't change things and ask the delivering company about the signature or photo they took. If it was the neighbours who took it and they're not giving it up then I'd report it to the police.

Your only recourse is to the seller who wrongly addressed the parcel.

Hermes delivered it to the address on it so have fulfilled their contract.

The neighbours have taken delivery of unsolicited mail addressed to their property meaning they are allowed to keep it.

Your contract is with the seller. The seller made a mistake. They have to correct it.

If you don’t want to bother them that is your choice but then you have to take the loss.
