To not want a dog in shared garden?

We have a shared yard at the back of our house that is shared with 2 others neighbours. A new neighbour recently moved in and has a dog. The dog uses the garden space as a toilet, he does now pick up poo after many discussions but the dog pees everywhere and in everything. We can have anything out as he just lets it pee on whatever, including my back door!

AIBU to not want a dog using the back garden at all, it’s very small and the dog is big, is it just me?

I would HATE this. It;s totally unfair for someone to inflict their pet on others. You love your dog, fine we get it. Just don't expect us to love it too, or accept it with joy into our spaces.

And clean up its shit.

Is there no way you can perhaps section a small piece off for the dog to use. My ndn has done just that and the dogs know to pee/shit there.

OP, astounded at the replies.

I would be furious at the outside shared space being used by a dog owner.

Anyone with even the slightest bit of consideration for others would know that puddles of piss is going to be most unpleasant.

The character of the owner is clear in that you had to insist that he cleaned up the dog mess.

I certainly would not be letting that go.
Your children can't use it for sanitary reasons and the dog is not on a leash.

I would be onto his landlord everyday.
Pissing on your door and pots...make it the landlords problem...not just yours.

Definitely not on.

This is because dogs are animals, the property of people.

Absolutely not! The problem isn't a dog; it's an uncontrolled dog. This is YOUR space too, and you are entitled to use it unmolested.

OP..YANBU but unless the LL stops it you are wasting time. A lot of dog owners seem to think their wonderful, friendly delightful and clean friend takes priority over everyone else. See it when out walking currently with loads of dogs off the lead, running up and jumping up. I had a row last week when said dog jumped up, she did nothing to stop except say oh he's just being friendly until I kicked her dog away as I couldn't get him off me ....then I'm cruel!

Just 1 thought for everyone saying that they should walk the dog/ take it out to do its business you do all remember that we are in lockdown so the dog can only be walked once a day

YANBU - one of the three households is effectively making the garden unusable to the other two. It's hard to see what you can do as the owner is clearly unpleasant and selfish and the landlord doesn't care. I hope you find something in your deeds!

I am a dog lover and this would really make me angry. I would be furious that the landlord isn't doing anything about it. Hope you acn find a solution.

Cabin the RSPCA is saying you can take a dog out to toilet plus take it walks. Not sure how that marries up with the law but that seems to be the guidance.

I think some of the comments are a bit unreasonable and go too far. It’s a shared garden. Shared. Everyone is entitled to use it - including your neighbour that has a dog. I do however think it would be polite to prevent the dog going to the loo in the garden if possible or being careful about cleaning. It’s not always possible to know when a dog is going to pee so not always avoidable. The thing is, when you’re sharing spaces you all need to make allowances - OP you may not want to have a dog in the garden, but it’s not your garden. It’s a shared space. The neighbour needs to be more considerate than he might be if it was his own private garden. Everyone needs to just make some allowances.

That's nice math but as above, it's a shared space. That means everyone making compromises as you're all paying for it. So no one residents needs trump another. The dog owner needs to clean up, but otherwise it's a free for all.

Why not? Unless it's expressly forbidden by the factor, if he is cleaning it up (which he should be, I'm not disputing that in the slightest, its grim) then he has as much right to use it for what he wants as the other tenants with kids do.

That’s disgusting OP. But if the landlord and the owner of the pupper/furbaby/littlesweetums don’t care, there’s not much you can do other than move. Piss and dogshit revolt me anywhere, but in my yard? Why would I want an outside area smelling like an uncleared toilet, with puddles of urine waiting for the sun?
Is there a really strong-smelling disinfectant you could use in the yard that the dog would hate?

Can you fence your section? Definitely check your deeds but I doubt it mentions dogs. I wouldn't be happy if I was you though.

Ask the landlord for a reduction in the rent as you can’t enjoy the outside area, or hang your laundry safely.

As a dog owner, there is no way I would let my dogs toilet in a shared garden, and certainly no way anybody would have to have a conversation with me to get me to pick their poo up!

In theory he has a right to use the garden as he wishes, but in reality he should be considerate. I'd be contacting the landlord or letting agent to complain personally, it's really not on that his use of the shared space is ruining it for you. The landlord is not going to want a dispute with the neighbours, so should be receptive to asking his tenant to be more considerate.

I think if you buy a property with a shared garden then you can’t expect to control the use of it. He has just as much right to be there and his dog and you.

I’d expect him to clean up obviously after his pet but if landlords allow pets then he’s doing nothing wrong.
