To not want a dog in shared garden?

We have a shared yard at the back of our house that is shared with 2 others neighbours. A new neighbour recently moved in and has a dog. The dog uses the garden space as a toilet, he does now pick up poo after many discussions but the dog pees everywhere and in everything. We can have anything out as he just lets it pee on whatever, including my back door!

AIBU to not want a dog using the back garden at all, it’s very small and the dog is big, is it just me?

Why do kids get precedence? He should pick up the poo, but other than that it's a shared garden, others kids dont trump someone's dog.
This. If you had kids would you not let them out if it annoyed your neighbours??it’s tough living somewhere you have to share. I don’t think it makes any difference you own and he rents but check the rules if he’s allowed you can’t do anything other than ask him to clean up after the dog

I like dogs but they need to be walked. I’d move house.

Of course the neighbour is entitled to use the yard with his dog. But it’s shitty of him to use it as the ONLY place where his big dog exercises, pisses and shits. There is a limit.

If he cleaned up the piss and ensured it didn't piss on others peoples property then it wouldn't be an issue!!

What a horrible situation, I have a small pack of large dogs and a shared garden and his behavior is awful! We are all tenants and the LL is a dog lover so dogs are very much allowed and all but 1 neighbor has them, but it is made very clear when people rent dogs are present so if you don't like them its not the housing for you and 2 if you have pets you are responsible for keeping them under control any accidental damage is to be paid for, mess cleaned and any sign of aggression and you're evicted. It sounds like both your neighbor and their landlord are dicks.
Is the space shared with others? could you get them on side and complain collectively to the LL? also if the dog is genuinely aggressive you can use that as a point to complain to the council/police?

To those saying the breed makes zero difference—I really don’t believe that is true. It’s not only the likelihood of the animal to be aggressive, it’s the potential harm it could do. A child getting a nip from a dog is horrible, but not remotely comparable to the actual deaths caused by some animals.

Check out the deaths in the UK caused by dogs: other than for babies, the dogs involved are Staffordshire’s, pit bulls, various bull dogs. Also the occasional guard dog type (Doberman, Alsatian, Rottweiler).

You’re living on another planet if you think a Labrador is the same actual risk to a child as a pit bull. As far as I can find, there actually hasn’t been a death in the UK by a labrador. Absolutely zero chance I would treat them as equivalent, they are not. I have seen serious attacks by pit bull types, they are in no way comparable to a Labrador or JRT bite. Yes JRTs are very snappy—I have been bitten by them—but they are not a serious hazard to anyone but babies.

I don't know many parents who would let their kids shit and piss all over other peoples belongings and garden, let alone get aggressive when confronted about it

I came from a house with a shared garden where there was also dogs and there was absolutely nothing at all like this.

These posts are what make me very happy to have the means to own my own house and garden. What next? Birds crap on gardens, do you want to cover the garden with a huge tarpaulin to prevent that? Heaven forbid a fox comes along and shits there.

Have a shared garden and you have to compromise. You can’t have ultimate control over that space. As for the dog, unless it’s aggressive which isn’t likely you could with the right attitude actually quite like it.

Typical mumsnet dog phobia.

Of course kids trump someone's dog. It's a dog. You might see it as some sort of anthropomorphised super special being with rights on a par with humans but it's a dog.

There is ONE Doberman in that whole list and if you read the circumstances the dog was confused by its owner having an epileptic fit and tried to pick her up by the scruff of her neck. She was not bitten anywhere else and there was a young child untouched in the same room. I won’t have the Dobermann breed lumped together with “dangerous breeds”. Misinformation!!!!

My dh used to be out on 's#$t' patrol very regularly in our paved garden. I used to shut the dogs and cat in while I sprayed neat bleach or Jeyes fluid before hosing down, every night in hot weather, less often in wet weather. So I wouldn't be happy about an uncleaned yard outside my back door. I certainly wouldn't want to step out with a large dog about to jump up. So I would be looking at the practicality of putting a gate up with temp fencing outside the back door.

OP i am amazed by others comments. I do not believe shared use of a space entitles a tenant to allow their pet to piss in that space as that spoils it for others. It's disgusting for others who are not dog owners and have not chosen this.

Tbh I'm amazed a renter is allowed a dog, most landlords simply don't allow them. Check he's actually allowed a dog.

Yes his backdoor is right on the courtyard as is mines. At the beginning when he wasn’t cleaning up, I asked, I didn’t tell him and he told me he would do it when he likes. He does do it now but in the odd occasion will leave poo for a few hours tops. For pee, this is never cleaned up, at the moment he is completely unapproachable and I fear the more I get at him the more he deliberately lets the dog control the yard. It most likely is a no win situation just very frustrating that we are thinking of selling our home!
This is absolutely disgusting!

Unfortunately, the landlord has nothing to do with this. I tried to help my tenant when the neighbour was being an arsehole and was told it was nothing to do with me. The ll knows there’s a dog there, isn’t bothered so there isn’t much you can do bar cover everything, hose down yourself. It’s really unfair and the tenant sounds like a complete arse.

As a landlord if your tenant is causing issues then it is your problem.

If your tenant is on the receiving end then it isn't.

Potentially the LL is at fault as dogs may not be permitted to be loose in the shared yard.

Can anyone tell me if I can approach the LL and ask what the rules are regarding pets in shared paced yard without a lead and using it as a toilet?

I have tried to get info before but can not get past the office staff!

Last night there were 3 dogs out, neighbours and family was round. One dog did a pee so the other 2 got involved with marking territory.

Yard is like an ice rink today.

I would feel exactly the same! Sorry but I would not want a dog / dogs in a shared garden.

You have every right to speak to the landlord, and also if the property is managed by the agent then they have a legal obligation to deal with this too.

(10 years experience in lettings and property management- I know what I'm talking about!).

If the agent does not 'manage' the property then they do not have any obligation to deal with this complaint.

I would politely approach the landlord and explain that you are unhappy about this and state your reasons why. You may come across a landlord who is very understanding, or you may not but until you speak to them you won't know. If it's the latter and he's not very helpful then I would suggest looking at your deeds / contact your solicitor if need be around the rules concerning the communal garden (also inform him you are going to do this). 9/10 in situations like this landlords are very helpful and it doesn't have to go this far.

But you are not being unreasonable not wanting a dog in the shared garden.
