To not want to pay for my wedding dress right now?

My wedding dress was due in early March. With the situation in China, it was delayed, and finally arrived on Monday night. I was asked to collect it at 7am on Tuesday, wearing gloves and a mask, and try it on at home under the circumstances.

Then we went into lockdown. Wedding was cancelled. We've put a claim in with our wedding insurance, who have told us that we'll invalidate the claim if we make any further payments while they are investigating. They also told us that my dress is not currently covered, as they only cover wedding attire once you've collected it and it's in your possession.

The shop have sent me a video message today asking me to bank transfer the 50% remaining, pointing to a T&C which says that the remaining moneys are due on collection or 7 days after the dress arrives in any event. I replied saying I'd believed I needed to pay on collection and wasn't aware of this term when I bought as the T&Cs are only available on the back of my receipt, but they've said these are unprecedented times for everyone but I need to pay.

Things are tight right now. Fiancé was laid off the day before the support kicked in. My business is struggling. We need the insurance money to be able to get married again. We feel very stuck, and I'm really emotional (rightly or wrongly!). I've also got bipolar; which is not coping great with the current situation.

Is it unreasonable to respond and ask to pay when I collect the dress when we're allowed out again and insurance is all sorted?

I think you should pay only if they are offering a way for you recieve the dress, ie, pick up or delivery.

Although I don't understand how insurance can have a say in it - you don't need to claim on the dress as you can still use it, unlike the venue etc which is date specific. The insurance company cannot invalidate a claim based on you buying clothes totally seperate to the claim.

If you haven't received it I wouldn't be giving them any money either? They haven't fulfilled their side of the sale?

Don't pay if it means you're insurance won't cover it! And don't pay for it if you haven't even seen it.

Insurance probably 'have a say' as they would legitimately have an interest in the potential liability not increasing so would probably have the right to have the OP not make further payments and bookings and commitments.

I agree you shouldn't pay without the dress. If the shop goes bankrupt the liquidators will sort out the shops assets and you may well not get the dress th a you have paid for. I think this is what the insurers are getting at with the dress. If you pay now and never receive it then they won't honour a claim for the dress as they told you not to pay, I can't see what it's got to do with the rest of your claim though.

I think the fair thing to do would be to tell the shop if they will deliver it, and it is correct, then you will pay for it. If they won't arrange for you to take possession then you can't pay for it at this point as you can't afford to risk that money and the insurance have said they won't cover it. The ball is then in their court. If they want the money they need to get the dress to you.

I would think If the insurance doesn't cover the dress, surely the purchase of it can't invalidate your policy?

So the shop has bought the dress from China, would the shop not post it on to your house where you can deal with it there and decide if you want it or not?
Apologies if I have missed something.

If you pay, put it on a credit card. So you can get the money back from the credit card company regardless of what happens to the shop.

I wouldn't pay. They've shut and won't give it to you. I would tell them they can courier it to me if they want payment now. Hope you get it all sorted and have a wonderful day when it's rearranged.

I certainly wouldn’t be paying for a dress I hadn’t seen yet. Presumably the time to pay would be when you go to try it out and make sure it fits etc. The shop is shut so that can’t happen. When it reopens you can go to try it on and pay then

You absolutely should not pay if it will invalidate your insurance. I would speak to them about what to do. Ideally you would be able to pay for it now, but you need confirmation from them that you can do so first

Is it a lot of money? I read your op as 'because of the situation in China' it had only just arrived. Did the dress come from China? Generally dresses from China are less expensive. Just wondering if you are only talking about £50.00 or something like that.

If paying for it, no matter how much, invalidates your insurance then you can't pay it.
