I'm currently 23 weeks pregnant and suffering with bad spd which is mainly felt in my lower back. Our sofa was on its way out so on the 27th December we went and ordered a new large sofa and snuggle chair from a local place (not a big chain) and were told it'd be 4-6 weeks but pretty much guaranteed it'd be first week of feb. There was discount on and we'd calculated for both it'd be £970. We paid 50% and the lady said the total bill was £720 so we paid £360. I was obviously confused as it sounded too cheap but on our invoice it had '£250 discount' so I assumed it was an extra, albeit poorly advertised discount.

We went back in the shop 2 weeks later and got a mattress which was £400 and when we were paying I mentioned we'd ordered a sofa with them too and the woman looked us up and said there was an error on our last invoice and our total for the sofa was actually £970. I was obviously annoyed and really wanted to argue the point but with pregnancy hormones and this bloody pain I didn't push it and just said it was a bad mistake to make and had we not gone in for the mattress we'd have probably only been told about the mistake when the sofa was actually in.

Anyway fast forward to this morning and they ring me to say they're currently chasing the supplier and waiting on a call back. I was mad again cos I thought she'd be saying it was ready (I'm not normally so easily angered it's my hormones honest!) she then said 'there's delivery slots tomorrow my to which I said yes but we don't know the sofa is ready yet so no point getting excited it might be tomorrow.

She's just rang me again and said it'll be ready 24th if feb and delivery can be a few days after!! I'm LIVID!! I cannot sit on our sofa for more than 15 minutes at a time and if I lie on the bed to watch tv I really really struggle to walk when I get up. I've just very firmly told the lady I'm really really unhappy and I would like a call in the morning from the manager. I've told her I am NOT paying full price for this sofa, given the ridiculous mistake with the cost AND the fact it's another 3 weeks!! I'm so annoyed, where do I stand though when the manager calls?? We owe them £610 which we need to pay when the sofa is ready for delivery but I don't see why we should pay the full amount?? I don't want to cut my nose on and say stick it because we won't get it for this price anywhere else and I don't know if we'd be able to get the deposit back anyway if we did do that?? Please help!! What would u do?

Knowing you were under-invoiced initially. If I were the manager, my choice would be to offer a small discount, maybe £50, or offer to cancel the order and refund the deposit. Either way, it's unlikely they'll deliver before you sign something agreeing the correct, or newly agreed price.

It's the shops fault for getting the invoice wrong. Are they that stupid they can't check prices and discounts before doing a finalised invoice? It's a fair amount of money to get wrong. Hmm They are meant to be trained and competent at their jobs, it seems they aren't. If it was a computer error, again, their fault. Whoever inputs the data should have done a better job. Curry's do this a lot, accidentally 'sell' ipads or whatever for £100 instead of £1000. But they have it in the ts&cs that they can take back any sales made in error. Guess this company would need to check if they did that or not.

The delivery time given was false advertisement too. They gave you a date, and now can't make it. Compensation should be due for that.

To be honest though by now, I'd have lost faith in them, cancelled the order and got a refund.

You didn't query the discount at the time because you assumed it was to your benefit.

Now it's not, you're 'FUMING'. Stop being a drama llama and just pay the cost of the sofa. Annoying that is being delivered a bit later than planned but shit happens...

YANBU - if the original invoice states total bill is £720, then the mistake was made their end and you do not have to pay the extra. Their mistake - they need to sort it. They should provide the assistant with a calculator!.
You don't have to pay for their mistake - check out Sale of Goods act.

Hi OP.

So, they've invoiced you for an amount that is incorrect. I can't see how they can make you pay more. However, if you went along with their error, fully aware but keeping quiet in order to take full advantage of their mistake, thats pretty reprehensible. You may be legally right, but as a pp said, this requires some mental gymnastics to convince yourself you are morally in the right. You might have the law on your side, but you should probably have an issue sleeping at night.

Delivery is a separate issue. Poor service, a bit disapointing, but fuming?!?! I hope you never come across any real adversity in your life, otherwise you may well get yourself into a pickle. Fuming is for when your sister runs off with your husband, or a builder makes you an extention without foundations. Not a late delivery of a nice new piece of furniture.

It’s clearly their error. They gave you a discount at the point of sale, albeit in error, it’s questionable to try to charge full price now.

The delivery delay is also their error, granted that these things are fairly common and they probably have a small print disclaimer on their website & paper work.

You are perfectly within your rights to point these things out — they are trying to increase the charge for an item they are now delivering outside the agreed time frame. I think I would expect them either to honour the documented discount as a goodwill gesture for the delay, or to charge a percentage of it and pull their finger out re getting the sofa delivered.

If really peeved, you could just take your pregnant self down to the shop and sit on the comfortable sofas in the showroom until yours arrives. You could talk to customers about your experience whilst there....

I'm confused by this thread: my understanding is that they have to give you the price of the sofa as stated on the invoice but you would need to check this with trading standards and the company's terms and conditions.

I would take issue with the delivery issues as it's not on and they have inconvenienced you SPD or not.

If you knew what the actually cost of the sofa was and the £970 is stated on the invoice then you don't have a leg to stand on.
