Breeder refusing to give me puppy or my money back

Ownerofsmallpeople · 14/01/2020 18:30

I’m not sure if I’m being u or where I stand on this.
DH and I have decided to get a puppy early feb. We have a 2 year old and another on the way but not due til summer. We have wanted a dog for ages and decided now is the best time as my DC has just started full time nursery, I’m not in work so I have plenty of time during the day to train and spend time with the puppy. For a few weeks after I give birth DH will be taking over walks but I will still be doing the training during the day and newborn will be joining me on school runs etc so my routine doesn’t change really. I’ve raised puppies before so I know what it entails and also obviously had a newborn before so I don’t see any great issues.
We went to view some puppies a couple of weeks ago with DC, chose a specific puppy, breeder was happy discussing diet and training etc and then asked for a deposit. I paid the deposit via bank transfer the next morning. She has now text me last night and said she had one of her friends (who is also friends with me via Facebook) to have a look at my Facebook profile and show her what was on it and she has seen that I’m pregnant and now is telling me I’m “deceitful” and she “can’t trust me with her puppy”. I didn’t think it was a huge deal and I was required to tell her I was pregnant? Obviously the puppy is going to a good home with us so I don’t see an issue. I completely understand wanting your puppies to go to a good home that will look after them but I wouldn’t have thought having a baby 6 months after purchasing a puppy was a big deal.
The conversation went on for about 20 minutes of her basically patronising me and saying that in 6 months I would be calling her to take the dog back. I eventually said to her to either tell me she’s happy for the puppy to come to us or she’s not happy for the puppy to come to us, she replied “I’ll speak to my partner and decide”. I have not heard from her yet so I text her again saying she needs to let me know or send me my money back, she has read the message and ignored it.
Am I in the wrong? What would you do?

Oh God, lesson learned Op. Sad I just think you've been a bit naive. You just don't expect people to be like this.

It's bullshit that the refund is non returnable unless stated beforehand isn't it? Hindsight is a wonderful thing. She was very quick on taking your money at the first communication.

It's always galling when you put your trust in someone and they turn out to be an arsehole.

The saving grace is that you're local and have friends in common . Surely she won't shot on her own doorstep Confused

SmileyClare · 16/01/2020 19:31

*shit on her own doorstep !

SmileyClare · 16/01/2020 19:43

she told me to get off my fucking high horse

Maybe she should have told her friend's Chihuahua to get off his high horse when she let him mate her bulldog.
The mind boggles.

Broken2020 · 16/01/2020 19:49

@happycamper11 How on earth is it me that is sounding silly?! She is implying that all Bulldogs are huge! You clown!

GabsAlot · 16/01/2020 19:56

Message one more time and state if itsnot in your account tomorow you will be going to small claims-i assume you have evidence you paid in the first place

JasonPollack · 16/01/2020 20:01

Hope you got your money back OP. If not its really easy to take someone to small claims court you can do it online. Most people will then just pay you when they get the court letter.

happycamper11 · 16/01/2020 20:03

@Broken2020 I don't see her say that? They are huge in comparison to a chihuahua though yes - massive in fact! All bulldogs are. No bulldog is huge compared to large breeds though. I'm really failing to see your point. My best friend has 2 huge French bulldogs though - mother and daughter. She's had a litter from both as they are big self whelping and free breathing bitches so great for the breed.

FizzAfterSix · 16/01/2020 20:04

She is incredibly irresponsible for not having her own dog speyed and is now seeking to monetarise her mistake.
She should have researched you before taking your money.
My Bichons were rescued from a couple who had bought them and then dumped them when they got pregnant so I’m not a fan of people buying dogs from irresponsible, greedy, chaotic backyard breeders.
Adopt don’t shop.

onlyjustme · 16/01/2020 20:06

I too got Shock at
pregnant by accident on a parkrun

OMG is that a thing now? I'm worried... (about ME. I don't have a dog but I have done the odd parkrun. Perhaps never again...)

DeathByPuppy · 16/01/2020 20:08

An incentive to improve your speed, if ever there was one @onlyjustme Grin

JesusInTheCabbageVan · 16/01/2020 20:09

Think of it this way, you paid £650 for a crash course on how to choose a responsible and ethical breeder. Better that than £££££ in vet bills.

Ownerofsmallpeople · 16/01/2020 20:10

I find it unbelievable that she even let her dog off the lead on heat. I’ve previously had lab boys that aren’t neutered (potential studs but then decided against) and I walked them off the lead in large grass areas - occasionally did come across a bitch in season but their owners always had them on a tight lead and I would put my boy on the lead to pass and for a few mins after

And yet you don’t know that when you view a puppy you need to know what breed of dog the mother is...

Come on.

yellowallpaper · 16/01/2020 20:18

DH and I bred a single litter of puppies from our springer spaniel and we took one of the last ones to a family who fell in love with him. They didn't have a garden or a car, however but swore he would be taken to the 'park' every day. DH and I took the deposit, but had reservations re the garden etc, so we went to look at the 'park' and it was basically a tiny inner city park which was all pretty flowers and nowhere to let a dog run.

We agonised over it as they clearly loved the dog but in the end refunded the money and pup went to live with a young lad on a farm where I'm sure he has a lovely life.

Moral of the story is a non professional owner of a litter of pups sees them all as their children and won't give them to anyone they regard as providing sub optimal care .

Personally I'd wait until baby is 6 months old

yellowallpaper · 16/01/2020 20:20

Just seen she hasn't returned the money! You can sue in the small claims court. That's disgusting.

Ownerofsmallpeople · 16/01/2020 20:24

She’s also been uploading photos of the puppy on her social media saying he’s still looking for a home. I feel like commenting “but you’ve already taken (and kept) a deposit for him haven’t you?”

What is stopping you OP? Shame her Flowers

happycamper11 · 16/01/2020 20:28

I'd do that OP - leave it til later so she doesn't see it til the morning

carly2803 · 16/01/2020 20:29

shes a bit of a dick isnt she OP

id comment too but i bet she blocks you - i woudl comment saying waiting for my deposit to be returned as you changed your mind in selling me a dog.
I expect it in my account in the next 30 mins.

SmileyClare · 16/01/2020 20:34

Ha ha pregnant by accident on park run I can see this on the front of Take a Break onlyjustme Grin

strawberry2017 · 16/01/2020 20:58

I think she's spent the money and you won't get it until the puppy is reserved by someone else. X

Laiste · 16/01/2020 21:10

I'd be knocking on her door OP.

Sometimes these people rely on others not having the bollocks to do a bit of face to face.

By the way - a quick google shows the French Bullhaha (sp?) mix has been a thing for about a decade dogable.net/french-bulldog-chihuahua-mix/

Nothing accidental about this mating.

AlrightyyThen · 16/01/2020 21:36

Tell her you want it back tomorrow or you’ll be filing with small claims court, that sales pulled out of by the seller cannot have non-refundable deposits and that if it gets to that point you will be putting all the evidence including her crazy message onto FB and she will find it impossible to sell the puppies as people will know she is a scam.

She’s either spent it or is “punishing” you but you don’t have to put up with it.

I had a puppy while pregnant, then subsequently whilst having a 1yo and a 4yo at the same time. Because I’m a SAHM it didn’t make a difference, in fact the puppy grew up more well rounded than the dog I had before the children

YANBU

Ownerofsmallpeople · 16/01/2020 21:52

I’ve messaged her and said that I’ve been patient enough and I expect the money in my account by the time I finish my school run in the morning as I pass the post office on the way home and will be filing a claim to the small claims court and then reporting her to the police. I’ve already reported her advert on pets4homes.
She replied “non refundable deposit” so I reminded her that’s true if the buyer drops out which isn’t the case as we were happy to take the puppy, it was her who dropped out. I also explained to her that i wasn’t required by law to disclose my pregnancy to her and that if it was a big deal she would have asked to which I would have openly admitted I’m pregnant.
I repeated my bank details to her again and the fact that I was ready to put the small claim in. After a few messages rabitting on about how she was happy with the sale before she found out I was deceitful and the welfare of the puppy was compromised etc etc she said she would pay the money “when she got to the bank” tomorrow which is what she’s been saying for the last two days. I think she’s saying that line as a sort of joke because she’s said it about ten times. THEN she said that she was willing to give me my money back although she shouldn’t because apparently I have fucked her around and unfortunately it had to fit in with her day not mine, so again she would make the transfer “when she had time”.
I reminded her that she could potentially receive a ccj for the claim so she said she was doing her aunts hair in the morning but would stop in the bank on the way home and send the money back. If this doesn’t happen I’m just going to file the claim

bluebluezoo · 16/01/2020 21:59

Did she actually say the deposit was non refundable at the time?
