Was I involved in this car accident? (attempt 2)

I was at the bottom of a hill turning right onto a main road. Turned right when clear then heard a loud noise. Looked in my mirror to see a wing mirror shattering and debris in the air. Pull over a little way up the road and go and see if I can help.

The lady is really shaken up. I ask what happened and she tells me that she just looked up and I was in front of her!

There is zero damage to my car. I have checked it three times but can only find mud BlushShe has damage to her drivers wing mirror and drivers front wheel arch.

I’ve rung my insurance company, and they have got the information on file ready but it just all seems a bit bizarre.

Anyone been in a similar situation?

Sorry crossed with your post. I don't know how her car could have so much damage and yours none but the face you heard and saw the damage yourself seems to say you hit her.

By the time I heard the noise I was quite a way in front of this lady. If I’m at fault I would 100% put my hands up but I didn’t feel an impact. I continued to travel in a straight line. I have no damage or paint or anything to suggest I hit someone.

From your diagram it looks like your fault.

I wouldn’t rule out her fraudulently claiming. As much as we expect others to be honest, some people aren’t. Your insurance company will be able to examine her car and check whether it’s new damage and feasible to have been caused by your car in the circumstances described.

Is she saying she hit you? Or swerved to avoid you and hit something else?

So she would have been slightly downhill from the point of you joining the main road, on the side of the road you wanted to join.
You looked both ways and there was nothing coming as you pulled out. I wonder if she was speeding.

Thanks to the posters who are coming up with ideas rather than insinuating that I just carelessly pulled out in front of someone. I agree with the idea that potentially as I pulled out she looked up and didn’t realise my proximity and swerved and caught the passenger rear?

What kind of car do you drive, op? A Sherman tank??

It all seems very odd. If she scraped you, then perhaps you wouldn't feel it, but there is quite some damage to her car. Were there any other cars around she could have hit instead??

How was visibility on both sides? How fast was she going?

So many times yet still you haven't answered- what is she saying happened? That you hit her? That she swerved and hit something else?

2020Better- The OP says she saw the wing mirror shattering and debris flying in the air so it’s clearly not old damage.

@Branster one of the first things she said was “I just looked up and saw the back of your car” then “I was only doing 30mph”. She also said “you know when you try to put your foot on the break but you just can’t move”. I’ve written all this down just in case.

Her road was flat and straight.

Yes but the diagram is only for understanding the setup of the junction. In reality, based on OP’s posts, the other car wasn’t that close to the junction when OP turned right because OP did not see the car or anything else there otherwise she wouldn’t have started moving into the main road.

If you heard the noise, and there was debris on the road, the damage must have happened then... Any other witnesses?

From the diagram it looks like it's your fault. As if you have pulled out when it wasn't clear. Is there a bend in the road or was she possibly driving faster than you anticipated?

Sorry @teentree I said to her “what happened” and she said she wasn’t sure. She just looked up and saw the back of my car.

Is it possible she clipped another car and they’ve carried on driving? You said you were quite a way front when you heard the noise.

As they didn’t stop she’s trying to pin it on you?

Nope the road is completely level. Also if I’d pulled out last minute surely I would have t-boned her, felt the impact and ended up in a different position on the road?

So we can maybe guess that she may have needed to slow to avoid hitting you, doable if paying attention but she was distracted as you pulled out and only looked up as you completed the manoeuvre.

@VivaLeBeaver this is what a friend suggested. Another idea is that someone else pulled out behind me and caught her and drove on.

So she doesn’t know what happened.

So she can’t hand on heart say she hit you or you hit her. Sounds like she wasn’t paying attention. You have no damage. I reckon there was a third car.

Hmm. Sounds like she was speeding and not paying attention... If she knew there was a junction on the right, she should have been alert to drivers possibly pulling out from there. You're always meant to be looking ahead and anticipating. And not looking down!!
