Here for traffic. Any lawyers around?

I bought an item of clothing at a show yesterday. There were no items available to try on. I got home and it looks terrible on me. Stall holder has outright refused a refund and says there was a sign clearly stating no refunds.

I'd normally let something like this go but I run a business and bend over backwards to ensure clients are happy and this comes at the end of a run of shoddy customer service.

Does anyone know what my rights are?

Google not helping.

So you think changing rooms should be a legal requirement. Or the alternative is if you dont have a changing room you must refund anything?

Why do you think the law is different for online shopping and distance selling? Because there isn't a way of knowing the clothes would fit until you try them on at home.

Like I said, even if it isn't the law, I think it's ridiculous. That's why I would never buy from anyone who didn't have a way for me to try the items on.

No ita because you cant see the product, the quality, the feel if the material etc. Looking at a photo is different to having the item in front of you.

Alexa my point was that OP might want to "battle" for a refund because she can't afford to lose her money.
I imagine OP has learned her lesson the hard way. If there is a "no refunds" policy and nowhere to try on, avoid. Caveat emptor etc.

And employing the services of a Lawyer will cost far more than the clothing. Because that's what she'll have to do, as the stall holder has refused. It would be ridiculous to do that.

Then don't buy from a stall that says 'NO REFUNDS' and has no opportunity for trying things on Hmm

Good advice - I wouldn't buy from anyone who doesn't give refunds. I also check out any company I have dealings with on companies house to see if they folded any companies or have been made bankrupt or have been struck off as a director.

As for the rest of the comments - I don't really care, I am a legal assistant and I am married to lawyer whether or not you believe me or not is up to you. I could be married to a millionaire or a pop singer ... who knows and who cares this is just a chat forum for mums and a few dads if they dare to add to any threads.Smile

Don't you think Trip Adviser does the same? I have just given a pub a bad review on there and no one has complained but the pub has apologised and asked if I will give them another try which I will.

Perhaps there should be a site where we can give reviews for shops or stalls?

Ir are you saying you complained about nothing? I do always wonder why people dont complain at the time though.

What you were suggesting was blackmailing the woman to get a refund that she doesnt have to legally give and advised at the point if sale that she wouldnt do.

I have been asleep in bed got up to feed the cat checked out my other sites transferred some money from bank accounts to cover a mortgage because a tenant hasn't paid her rent. That's funny.

Because I watched TV with dp, replied to some work emails, had a bath, went to bed, slept. Got up, checked my work emails, checked my bank, moved money into savings, made a coffee and logged on mn while I drink it before I get ready for work.

Mn has a function called 'threads I am on', I clicked on there and, there was a reply so I looked. I dont need to sit a stare at a thread waiting for you to reply.

Is there a reason your morning routine, is perfectly fine, but my (very similar) routine isnt?

We mus have similar schedules ... I work from home managing my properties but I do go out sometimes to shop and visit family and friends. Tomorrow I will be in waiting for some furniture to be delivered. How about you?

My children have flown the nest but my husband has the kind of job you have just described. He will be on the phone all day talking to clients, lenders, builders, lawyers, solicitors and conveyancers etc. I used to work in the law 3 years ago but had to leave because of ill health ... I am fine now and I am thinking of going back part time.

Glad to here you are feeling better. I took a year off when I left exh. Sometimes you just need to. Was happy to to back.

My company has 12 divisions. I am the lucky person who gets to make sure they are all behaving and not feeding the board a pile of bollocks. And then gets to deal with the CEO pointing out which part are bollocks.

I would think you had a point, OP, if the seller hadn't made it abundantly clear that she wouldn't accept returns, when the customer decides later that they just don't like the item. You'll have to chalk it up to experience and drop the item off at a charity shop.
