To not understand why CCJs wreck your credit?

So I have a CCJ pending - not sure if that is the right term.

If I lose the case I will pay it right away - though I obviously hope I don't and believe I don't deserve to.

But if I do lose it will be held against me? How is that right?

Surely it means if you are poor you should never contest anything otherwise you are fucked if you lose??

I think it’s because finding against you is basically that you defaulted in a fair debt. I know what you mean though, a legal wrangle with a provider should be a different category than a default

herculepoirot2 · 15/08/2019 21:15

Because it means you failed to pay a debt that was owed.

SoyDora · 15/08/2019 21:15

I thought you got a CCJ for failing to repay debt? So that’s why it’s held against you for credit purposes. Or have i got it completely wrong?

Bunnyfuller · 15/08/2019 21:16

Without a bit more background it’s hard to say whether you abu or not.

Davidbowiestrousers · 15/08/2019 21:16

Pay your debts, problem solved

whynotmethen · 15/08/2019 21:17

My potential CCJ is not a debt - it's for a charge that I believe (know) I do not owe in any fair society.

OP posts:
Youmadorwhat · 15/08/2019 21:17

Because the reason the ccj was brought against you is because you didn’t pay the debt in the first place! Which is why it effects your credit rating!

bouncingraindrops · 15/08/2019 21:17

You are getting the CCJ because you didn't pay something you were supposed to pay.

ApocalypseNowt · 15/08/2019 21:18

What is the charge?

Youmadorwhat · 15/08/2019 21:18

@whynotmethen you need to be more specific??

whynotmethen · 15/08/2019 21:18

Oh really! What if you contest a debt!

OP posts:
BrightYellowDaffodil · 15/08/2019 21:18

It's because a CCJ is a court ruling that you didn't pay a debt you owed, therefore you're a bad credit risk.

IIRC the effect on your credit rating differs if you pay immediately (I believe this means the CCJ is set aside but I'd check with the CAB or other legal bods in this area) but if you think you'll end up paying anyway why not pay now and save the hassle of going to court?

chomalungma · 15/08/2019 21:18

Would you lend money to someone who has been taken to County Court for debt and had a judgement made against you for that debt?

It is going to affect anyone's credit rating if they end up in such a position. CCJ's don't just happen.

SoyDora · 15/08/2019 21:19

Ah ok. Well I suppose it’s held against you if you lose because the court has judged that it’s a charge you do owe.

TitianaTitsling · 15/08/2019 21:19

TV licence / council tax?

chomalungma · 15/08/2019 21:19

My potential CCJ is not a debt - it's for a charge that I believe (know) I do not owe in any fair society

In that case, you'll win th CCJ and nothing will happen to you.

herculepoirot2 · 15/08/2019 21:19

What if you contest a debt!

Then like you say, if you win, it doesn’t affect you.

WhatisFreddoingnow · 15/08/2019 21:19

Doesn't work like that.

Presumably you have been summoned to small claims court for unpaid debt. If awarded in the other company's favour, you will be given a set amount of days to pay or installment plan and amount to pay.

If you don't keep up your side of the bargain, you then have a CCJ against your name and it can be enforced through baillifs.

If a CCJ was automatically awarded then it wouldn't be fair.

herculepoirot2 · 15/08/2019 21:20

Come on, OP, what is it?

WhatisFreddoingnow · 15/08/2019 21:21

If you do keep up your side of the bargain e.g pay within a set time, it won't leave any trace and the court will be satisfied.

TitianaTitsling · 15/08/2019 21:21

My thinking re council tax/TV licence was re 'fair society' comment.

whynotmethen · 15/08/2019 21:23

What I have done is entered into a full carpark that was not labelled as such. It was then impossible to get out within their 'grace period' so I incurred a fee. I was charged £85 for this and obviously didn't pay it (who would?). Having gone through all the correct channels I am now being taken to court and am terrified that it will affect my next rental (I may have to leave this property within a year).

I have never missed any payments on anything in my life. I've done nothing wrong. This fucking country stinks.

OP posts:
bellinisurge · 15/08/2019 21:24

What's the debt? Is it like Lauren Hill allegedly saying African Americans like her shouldn't be liable for tax. That kind of "fair society " debt.

SoyDora · 15/08/2019 21:24

That does sound pretty shit OP.

bellinisurge · 15/08/2019 21:25

Why was it impossible to get out during their grace period? Were you detained against your will?
Sorry, op, not feeling sympathy with half a story here.
