To not understand why CCJs wreck your credit?

So I have a CCJ pending - not sure if that is the right term.

If I lose the case I will pay it right away - though I obviously hope I don't and believe I don't deserve to.

But if I do lose it will be held against me? How is that right?

Surely it means if you are poor you should never contest anything otherwise you are fucked if you lose??

No it doesn't. You just didn't know how CCJ and small claims courts worked.

If I was you, I would look carefully around the signage and build my case around that.

I that is genuinely nice the case then you turn up to court and tell them what happened. It is not all robes and legal speak - it is possible that the other side will back down if they see you there. Stand up for yourself! And if it goes against you and you then pay no ccj is awarded.

This was my understanding I’m in scotland but it’s similar here. If you pay up quickly after losing the case it should be fine. It’s unsafisfied court judgments that are more of a problem.

bellinsurge there was a massive queue - unless I ould reverse out over the roofs of a queue of cars I couldn't get out. you may not believe that, but wtf would I stay in there for 40 mins for shits and giggles? And of course there are no shitty parking companies in this country are there? Only nasty scroungers/liars like me?

@DinoGreen is correct. You have a month to pay a CCJ without it being recorded.

So worse case you go to court, you lose and you pay within the month and it won’t effect your credit.

What I have done is entered into a full carpark that was not labelled as such. It was then impossible to get out within their 'grace period' so I incurred a fee

When did this happen? They have six years to chase it. Do you still have all the paperwork? Are the parking company members of the BPA or IPC??

Op, was there not a number to call or a person on site you could have spoken to. And yes, if it meant waiting 40 mins to get it sorted, why wouldn't you?

I think the issue for the courts will be that you ignored the charge letters rather than contested it at the time. Do you have any evidence to back up what happened? I second getting some legal help asap from fb forum.

I don't see what's so unbelievable about @whynotmethen not being able to get back out before charges started to be incurred by automated number plate recognition. This is what's wrong with checking people in and out at entry and exit at busy times. If there's traffic on the route through a car park it's not like you can just nip out

OP. Was it a multi storey. Would there be CCTV. If so can you not just ask that they prove you parked by showing your car on the CCTV in the space you occupied. As you didn't it'll just show you slowly moving round a one way system.

Honestly. If you have a way to get out of the CCJ being on your file, pay the fine. Pay the fine pay the fine pay the fine. I work in a field which checks this stuff and every single time you apply for rent, mortgage, home insurance, car insurance, credit cards etc you will likely be declined or offered the most horrific interest rates. It will follow you for years and years and a brief moment of 'i stuck it to the man' will mean your life SUCKS for a very long time. It's crap that it's not your fault but chalk it up to experience and don't ruin your life over something like this.

I was charged £85 for this and obviously didn't pay it (who would?). Having gone through all the correct channels I am now being taken to court and am terrified that it will affect my next rental (I may have to leave this property within a year).

Honestly? If it had the potential to leave me homeless, I would have just paid the fine. It would have been less if you paid it within X amount of days.

Not much point fighting a small problem when it may leave you with a bloody massive problem in the future

And i also suggest not getting so angry and swearing in court when you hear something you don't agree with. Calm and reasonable is the way to go.

What a nasty comment. I did have a pic in the relevant local paper actually as they are running a campaign against this company (Britannia). It wasn't sad face though as I only communicated with the paper by email and only had holiday pics to send them so ut was quite smiley.

I love MN (name-changed for this) but this is mean. I'm worried I may not be able to secure another home for my family. I have never failed to pay anything owed - rent, tv licence, council tax, bills... I was unfairly charged and contested it. I have recourse to justice in a civilised society, and these parking companies are notorious. I post under a different name on a forum I have received a wealth of advice and support from over the years and receive a completely different response from usual. Wow. Not a good feeling.

If it’s a private car parking company it isn’t a fine. Only council & police tickets are fines.

OP has already said she will pay the fine if the judgement goes against her. Multi-storey car parks can be horrible at times and I can't see why she's getting a hard time here for having the bad luck to be caught up in a crowded car park.

Have you named the driver or appealed as the registered keeper? Did you appeal via POPLA??

If a CCJ is registered against your credit file it will impact your rating dramatically. A lot of creditors/lenders will exclude you straight away in the basic eligibility criteria. Effectively they mean you’ve no paid a debt you’ve been found liable for- therefore you’re not reliable and much more of a risk. They don’t drop off for six years

It can affect your ability to rent as most agency’s, and even private landlords these days (if they have the sense) ask to see your credit file when doing pre tenancy checks.

I know you disagree with the whole parking charge, but you could you genuinely not afford to pay the £85 at the time or is this about the principle? If it’s the later it’s a massive mark to put on your file potentially for £85

OP. My apologies I reread and see that you did try to go through the proper channels, so obviously did not ignore. Please see if you can get an advocate from one of the anti-parking fines organisations to go with you. And perhaps a journalist from the paper that has already covered the story.
