To not understand why CCJs wreck your credit?

So I have a CCJ pending - not sure if that is the right term.

If I lose the case I will pay it right away - though I obviously hope I don't and believe I don't deserve to.

But if I do lose it will be held against me? How is that right?

Surely it means if you are poor you should never contest anything otherwise you are fucked if you lose??

I have 3 ccjs in my name. And no it is not because I couldn't be bothered paying anything it's because my wife took out credit in my name and hid absolutely everything from me .
She took my cash card out of my wallet and ran up a £7000 overdraft. That is one of my ccjs.
Whynotmethen I would advise you to pay it as soon as possible as my solicitor said it would cost me more to fight it than it was worth. I even had a phone bill which showed another one of the ccjs was from her mobile phone number yet everyone including citizens advice basically laughed at me.
I have bank statements showing she was transferring money from my bank account to hers and putting me in even more debt but people just don't care. I'm a male and I should of been able to stand up to this woman. Honestly I would pay it and move on. I have two years left of paying debts and 4 more years with them on my credit file but I will pay them and move on with my life.

I really hope you win this.

I paid for a ticket and always get a receipt of card payment.
Machine printed the receipt but not the ticket.
Put the receipt of payment in the window plus an explanatory note.
Got a fine stuck to screen on my return.
Disputed it - with proof of payment.
Wouldn't accept it.
Emailed back in bold red print.
It obviously made them read my email.
Charge was dropped.

They really are wankers though - all this takes a lot of time to sort out.

By the way mediation is not (to my knowledge) seen as backing down. It is see as a positive - lot's of cases are dropped if one can express the exact conditions (like you have on here), and then it can be hopefully a case of case shut.

IF, it's not shutdown it really doesn't mean that you will go onto lose.
(It didn't in my case but that's another story).

As long as you pay the amount awarded to the Claimant in the time allowed by the Court, there won't be a CCJ against you. You only get a CCJ if you don't pay.

Yep OP it’s really crap. Also the court system is rubbish. My DH had a CCJ against him- we discovered when we applied for a remortgage. He has a fairly common name, the dodgy debt company simply found someone with the same name
As the debtor and lodged it with the court (it was an old address of ours) we knew nothing about it, didn’t contest it and bam
It was awarded.

Additionally, even if it was his debt, it was 11 years old, too old to take through the court. The court awarded it without even noticing- presumably they do hundreds a day and debt companies know this.

It was easily removed when he wrote to the court but not before we lost the remortgage

Why is the fine more because it was a rental? Do you mean that the fine went to the rental company and therefore was out of the 'discounted' period by the time you knew about it?

Make as big a deal about this as you can, OP - have you got proper legal advice? Because it sounds very much like a bunch of extortionists who you should not pay, and you are being very brave to fight them. A lot of crooks like these parking companies try to intimidate people by threatening them that they will end up with CCJs and ruined credit - so that people pay up before going to court when it is extremely likely that the court will tell the parking gangsters to fuck off and people like OP will not end up with a CCJ.

You don't have a CCJ!

As has been explained, if you lose you will have to pay, but that's not a CCJ either; it just means that if you don't pay when the court has said you should, then you may end up with a CCJ against you.

By the way, as far as I understand it, now that the matter is at court the company can't charge you the extra for not paying their first offer. They are going to court to get you to pay the original 'charge' and there's no guarantee that they'll be awarded any costs.

So in summary, don't worry about rental agreements, etc. This has no bearing on any of that unless you subsequently ignore the court's decision.

HeadintheiClouds I went into a multi storey and it was full. It took me more than the allotted 10 minutes to get out and the assumption was made that I parked. I didn't. I left and went somewhere else and paid by phone. Hilariously, the second venue was owned by the same company as the first...

CastleCrasher The rental company charged me an admin fee for passing on my details to the parking company - because the parking company had to contact them first because the car was registered to them and not me.

I’m in a similar position OP, I won’t pay voluntarily because I think the car parking firm are wrong. I’ve received court forms and will submit my defence. I want a judge to tell me that I’m wrong and they are right. If a judge sides with the parking firm I’ll pay. If not, it was worth the fight. Either way I feel it’s worth £25 more in court fee costs (for me) to have at least stood up for myself and what I believe to be the case. My understanding is that if you lose and you can pay then there’s no CCJ?

some very brief info from me.

If you’ve filed a defence (within the time limit allowed) continue to comply with court time frames (you’ll have to submit certain documents at certain times - if you’re unsure how to do that, ring the court directly or contact CAB and I’m sure they’ll assist).

It’s likely you’ll have to attend court if it reaches trial stage. You’re defending a claim, you need to be present to defend it if it is listed for a trial.

If you lose, pay the judgment within 28 days (think this timeframe is correct but please double check). If paid on time, you can apply to the court for a certificate of cancellation and essentially, the CCJ will be removed. You can only get this certificate if the payment is received within the specified timeframe. If it is outside this timeframe, you can apply for a certificate of satisfaction, however, the CCJ will still show up on credit searches.

Ps - Good Luck. These parking companies are horrendous. Having had a dispute with Parking Eye under similar circumstances, I submitted to them proof that they were forced to close the car park due to not having planning permission. Check the technicalities too as it’s sometimes easier to win rather than based on the simple facts of the situation. Courts can only consider what is in front of them and though they may agree that the charge is unreasonable, they may still find for Britannia.

I got a CCJ when I was 20 (shitty landlady screwed me over. It was blatant fraud but court sided with her. I'm still bitter) but 3 years later I got a mortgage on my own no problem so I'm not sure it completely screws your credit rating.

I'm a genuine MN user, have never just taken people's posts as stories BUT I do work for a national newspaper in the UK.

@namechangeccjpost, you really should cover these scoundrels. Have a look at the Facebook page mentioned above For some shocking tales. Also look up how well the owners are doing! It is utterly outrageous. And the fact that the appeals process is so corrupt as well.

I’m currently fighting parking eye. We went through popla ( I believe they are no longer fit for purpose) and lost but I’ve not heard back from parking eye for months. I worry they are sending letters to my old address. I will go to court as well if they choose to fight me. It’s only a ccj if you don’t pay once you loose. If everyone chooses to fight these cowboys they will go bankrupt .

I’m confused, did you not see the car park was nearly full when you entered? Was it not unreasonable to think it would take some time to leave? Why would you assume that you wouldn’t be charged beyond the grace period when you were still physically in the car park?

I don’t drive but I find the sense of entitlement from some car drivers really bizarre.

Everyone dishing out the dire warnings needs to piss right off. She's clearly stated that she'll pay if she loses the case so NO SHE WON'T have a huge CCJ credit stain to follow.

As for the 'it's only 85 quid' brigade, you're just as bad. It's precisely how bastards like that get away with ripping people off day in, day out, and it's damn near robbery in many cases.

Not particularly, I’ve been a passenger in a car entering a car park and have been aware how full it is upon entering. Is the OP really saying that she didn’t realise how full a car park was when she parked or that if it had said it was nearly full that she would have parked elsewhere?
