Who is right!?

I'm currently going back and forth with my HR department and GP.

Date on the sick note runs until 11th March, HR saying I only have until the 10th then expected back in work on 11th

GP saying no, I'm covered all day Monday 11th then I'm to go in on the 12th where they will extend until maternity leave begins

I'm so confused and to be honest stressed out with it all. I'm already suffering from antenatal depression and just want this sorting.

If your sick no is dated 11th then that means your covered for the whole day and back on the 12th

Can I ask why you are off? For the depression?

That's frustrating they aren't listening but I would be telling them again regarding the date and you are to see your GP so not to expect you in!
Hopefully someone else can give you better advise but your covered so don't think they have a leg to stand on with you not being in work

Even if your note ran out on the 10th, they can be applied retrospectively, so there would be no need to go in on the 11th. You could get one any day next week and have it to apply from the day the old one expired. So you don’t need to go in at all.

I know it's so stupid, my first thought was GP was correct, told HR and all she said was it expires on the 10th. That's not even a working day!

I no it's hard to say not to worry but honestly it's fine. I had a sick note December that went into my annual leave. They just cancelled my holiday that I had booked for sick leave upto the day it run out then following day was straight onto annual leave.hope this puts your mind at rest

It’s fine. Your HR advisor should consult with a colleague or a superior. It’s not open for interpretation.

As others have said - GP is correct. Hope you manage to sort it & start to feel a bit better / brighter soon.

It's frustrating how incompetent they actually are. Not to mention inconsiderate.

Off topic, but does sick note have to specifically mention antenatal depression? Or can they not do anything anyway because I'm pregnant?

Ask HR what day you’d be back if you’d booked annual leave 1st -11th March. Answer will be 12th, proving GP is right.

Unless it specifically states on the fit note that the 11th is the date you are to return to work, GP is correct.

I'm not sure on that but if it's noted pregnancy related then I don't think they could do anything about it

Tbh, don’t even argue anymore. Your GP is right. So HR decide you have an unauthorised absence for 1 day in the end. What are they going to do about it? Practically, nothing. Relax. Try not to stress. Good luck with the new baby.
