Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

Guessing but wouldnt be surprised to find that CF neighbour is one of those acquisitive types who see something unattended and take it for themselves.

It is then left to the true owner to track down their posessions and claim them back. CF will demand proof of ownership and will make wild claims that whatever they took had been abandoned and CF has made lots of improvements to item taken.

The fencing was probably acquired in a similar fashion - true owner had abandoned fencing by leaving it standing upright round a field.

When challenged CF often claim innocence and that they were doing people a favour

I can summon a whole camp-worth of historical reenactors if you want to make a destination of the place! On the promise they pitch on CF's land and leave nice neighbours in peace.

This isn't going to be resolved immediately. Solicitors take time, people take time to respond etc. If anything it shows that the OP is genuine - sometimes situations like this that unfold over the space of a few hours/days are questionable....

Actually OP, if the high winds we have here are with you, we can hope that Mother Nature herself will lend a helping hand with those pesky fences.

Just to update I've been made redundant (at 12 weeks pregnant and unfortunately I am already showing as this isn't my first). So priority now is to job hunt asap.

Sister is still taking care of everything but she's away on holiday soon.

Dad has said he will help out where he can with all this.

Someone did suggest, on my redundancy thread, that perhaps we should sell the woodland if I'm now struggling for money. It has to be a considered option but the I doubt we would get enough for it to be worth losing this wood anyway, especially for my sister.

Flowers awful news you have been made redundant and good luck on job hunting x. My late great aunt had a large estate and she often hired out her woodland and small pond to people making movies ( not naughty movies lol) but movies that needed to be filmed in woodland etc maybe you could make some extra cash that way Smile

@TwittleBee: I'm so sorry to hear that. Did your company know that you are pregnant? I could be wrong, but aren't they under an obligation to help you keep the job/ help when you're pregnant?

Oh I am so sorry to hear that OP. As if you needed more stress! I hope the redundancy payment will go some way to covering things for you whilst you look for another job. If the CF’s are so keen on your woodland, you could always offer to sell it to them at a vastly inflated price!!
