To think I have effectively been dismissed?

I worked at an office less than 5 mins walk from a major transport hub. The firm then moved to an office with no easily accessible public transport but the arrangement at the time (or so i thought) was that staff with cars would pick me up from the old office. With staff changes this is no longer happening and I cannot get to work without an hour long journey on public transport plus a 1.5 mile walk which is not feasible.

The bosses have basically reneged on the deal and said it is my problem so it would seem i am out of a job. Can I claim constructive dismissal?

OP be honest, are you being fair to the team you work with?

LIZS · 06/12/2018 11:59

Did you warn/ask your manager if it was ok to get in for 10? What time do you intend to leave, or will you be able to ask someone to take you back to the tram?

GhostSauce · 06/12/2018 12:18

@SillySallySingsSongs I caught the bipolar part, but wasn't sure why it prevented OP considering the various options I'd raised.

I assumed there was something additional to bipolar.

GhostSauce · 06/12/2018 12:21

And I'm not criticising or judging. I too have had severe MH issues that prevented me using several modes of transportation for 11 years and only in my mid 30s learned to drive. I also have to take several types of medication in order to function.

Just curious as to why BP may prevent someone using a bike/trike/ebike/moped.

Autumnwindinthewillows · 06/12/2018 12:23

I have contacted A2W and am awaiting a return call.
I intend to leave at 6.30pm and no I won't be expecting a lift home
The only thing I have not done is physically sat down with the boss but I know from experience he will be happy with the interim position if he has not come back with an issue
I will be updating my cv in my lunch hour- being on mn is not an issue as i never take a lunch hour so even adding the time I take today to update my cv will be less than an hour

I regularly work over my hours so the flexibility goes both ways

Again you are not answering majority of questions. Can't believe you wont even sit down and speak with you boss like a mature adult should. This thread is just a losing battle as OP is not getting the answer she wants....

Schuyler · 06/12/2018 12:31

It sounds like you’re getting very anxious and jumping the gun. You say you like your job and AtW funding may very well mean you can remain in your job. Hang in there. Perhaps give them a chase call if you don’t hear anything by next week?

PengAly · 06/12/2018 12:31

Can you just explain exactly what your BP disorder is preventing you form doing and why? You could actually receive some useful advise on here if you'd just answer some questions honestly

Autumnwindinthewillows · 06/12/2018 12:32

I cant drive a moped - previously checked with DVLA and because my licence is revoked it covers all forms of transport for which you need a licence.
I could practice more on the bike but you cant take bikes (or trikes) on the tram or bus so not much help. I even considered leaving the bike at the tram stop overnight but given the theft rates in the area I dont think it would stay there very long. Biking from home would be too far.
And as for leaving earlier that would mean travelling in rush hour which I cannot do or if i go before rush hour getting to the office an hour before it opens
I have considered lots of things before getting to the stage where the office move looks terminal to my job
Access to work does seem an option and I am waiting for them to call me back

what about a taxi for the 1.5 miles from old office to new? that wouldn't be £10 / day would it?

PengAly · 06/12/2018 12:37

"And as for leaving earlier that would mean travelling in rush hour which I cannot do"

OP, can you please give some explanation why you cannot travel during rush hour? I understand you are bipolar but most workers have to travel during rush hour

Bringbackbertha · 06/12/2018 12:40

In some areas there is a website that offers lift sharing schemes..that might be worth exploring

ReflectentMonatomism · 06/12/2018 12:41

In some areas there is a website that offers lift sharing schemes

No-one is going to lift-share with a non-driver who isn't willing to pay fuel. That's not lift-sharing, that's being an unpaid taxi.

Autumnwindinthewillows · 06/12/2018 12:51

Dh lives 150 miles away so cant help. We did consider that ds will be 17 in 12 months so might be able to help then
Schuyler you are right I am very anxious about all of this as feeling I no longer have a job is hard as it affects ds too.
How about if I ask my boss if I can work flexible hours over the next month to work out timings with a core time of 10am to 5.30pm? By then I will hopefully have heard from Access to work and also know the best travel options.

AnchorDownDeepBreath · 06/12/2018 12:55

@Autumnwindinthewillows was your license revoked because of your bipolar, directly?

Autumnwindinthewillows · 06/12/2018 13:04

Anchor - yes revoked because of my MH issue.

OP posts:
PengAly · 06/12/2018 13:05

OP, please do not make your son your personal taxi, that is very unfair to him. Yes, speak to your boss about flexi hours (like we have been telling you to do for 19 pages!). Stop saying you no longer have a job, you DO still have a job- you are not thinking clearly and need to take responsibility for the situation you are in and take steps to improve that if you want to stay working there. If you do not want to work there then find a good short term solution (such as a taxi) and look for another job in the meantime. (Again, like we have all been telling you!)

If your son will be 17 soon are you going to pay for his lessons and his car? If so, than why cant you afford £10 a day for a taxi?

GhostSauce · 06/12/2018 13:07

You cannot have your license revoked for having bipolar specifically. Only if you do not declare it with the M1 form or whichever it is, though usually you would only get fined for not declaring.

Or if there were MH issues that did not stop you from driving but were potentially an issue they would put a restriction on you so you have to have a black box and only travel to work and back etc.

GhostSauce · 06/12/2018 13:08

They can't revoke your license only because you have BPD.

On what basis did they revoke it? Was it just a time limited restriction?

Schuyler · 06/12/2018 13:10

I think your thread would have gone differently if you’d said at the start how much anxiety and stress this is causing you. Flowers I know it’s hard to work with a disability. I find it a struggle and change makes it even harder. Don’t give up, this isn’t insurmountable.

PengAly · 06/12/2018 13:10

Op can you also please answer why you cant travel during rush hour? A lot of wht you are saying doesnt make sense.

Oldbutstillgotit · 06/12/2018 13:11

I will try again ? Do you have the Mobility component of DLA/PIP ? If not you should apply . Also , what if you offer your colleague (s) fuel money to collectcyou from the old office ?

GhostSauce · 06/12/2018 13:18

That's a good idea re the Mobility component of DLA/PIP. I hadn't thought of that.

Bringbackbertha · 06/12/2018 13:34

You could offer 45p a mile for someone to give you a lift. That is the general cost for a.company. that covers petrol and wear and tear on their vehicle.

Perhaps on a local Facebook group see if anyone is able to help you out, maybe they go the same way and willing to give you a lift some of the time if you pay.

You do seem to be ignoring alot of posts which if answered means people could give you a more constructive response.
