So apparently it's the 2017 amendment to Obamacare that makes it unconstitutional. Which is a nice trick of the Republican Congress to play.

Still to be appealed though.

Sitting in Fort Worth, US District Judge Reed O'Connor noted that a $1.5tn tax bill passed by Congress in 2017 eliminated the tax penalties which anyone who failed to obtain health insurance had to pay. He ruled that the individual mandate was now unconstitutional.

As the individual mandate was an "essential" element of the ACA, the whole of Obamacare was therefore unconstitutional, Judge O'Connor said.

He said his ruling was concerned with the intentions of the 2010 and 2017 Congresses. "The former enacted the ACA. The latter sawed off the last leg it stood on."

Scoop: Ryan Zinke has notified the White House he intends to step down as interior secretary.

Concern about legal costs and scrutiny of his travel, political activity and potential conflicts of interest were factors in Zinke’s decision, I’m told.

Plan is to announce Wednesday.

Yep, that Esquire piece sounds about right.

I know I've missed specific slices of the rise of rightwing extremism, such as the search engine optimisation that Carole Cadwalladr turned the spotlight on. But I've been aware of a rising hum of it over the last few years in the UK and elsewhere.

Often by people whose goal is very specific, eg cutting disability support, or Brexit, but who have been cheerfully drawing on extreme authoritarianism's favourite tools (eg dehumanisation) to get them there. Then they're surprised when the beast they've roused doesn't go back to sleep once they're done with it.Hmm

If Rudy is in charge, the cases will be over quite quickly when they actually reach court.
He'll give away all the evidence the prosecutors need in the opening statements.

I think its pointing out whats wrong in America, but, unfortunately some are more interested in politicising this under the resistance hashtag rather than asking for real change

Trump makes unannounced visit to Arlington National Cemetery

President Trump made an unscheduled visit to Arlington National Cemetery on a rainy Saturday, following weeks of criticism for skipping ceremonial visits in the United States and abroad that other presidents have made and for his lack of meetings with U.S. troops in combat zones.

The president spent 15 minutes at the storied Virginia cemetery, walking with two military officers dressed in camouflage and a tour guide, looking at the thousands of grave markers that had been decorated with holiday wreaths. The visit was not on Trump’s public schedule, which often signals a last-minute decision.

“They’re doing a great job,” Trump said, before saying that he wanted to expand the cemetery so more service members could be buried in the hallowed grounds. He said little else publicly, appearing to intently listen to his tour guide.

He did not lay a wreath but walked along a long row of tombstones, appearing to examine them while holding a large black umbrella. He appeared to be wearing waterproof boots as he traipsed the muddy grounds that have been the resting place for the nation’s honored dead since the Civil War.

He visited on Wreaths Across America Day, when thousands of volunteers in the United States visit graves at military cemeteries.

Thank God Zinke's out of there. I can't think of adjectives bad enough to describe his desecration of our federal lands, national parks, and wildlife!

Of course, it puts one on high alert for who might come next. And it pays to remember that cabinet secretaries are approved by the Senate only. And the Senate is still controlled by the Repugs. So I'm not singing hallelujah just yet.

I will say that I am allowing myself to enjoy the shitty swamp water swirling around Scrotus. The level does seem to be rising. Again, I'm not hoping for impeachment, even a resignation. All I'm allowing myself to think about is a legislative neutering. And lots of House investigations to keep him occupied.
