To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

There were lots of cheese advent calendars in our huge Asda on Saturday sparkling My husband got very excited but I wouldn't let him buy one, mainly because I'll sit and scoff the lot before he gets home from work Monday evening Grin

You’re annoyed, I get that but there is nothing for you to sue for. Usually loss of earnings etc but you’re not that hurt. I suggest you put in a written complaint to Asda directly and hope that they respond and change their procedures and perhaps retraining. That would be the best outcome in this scenario

My DM hit her head on a sign but did not sue the local council as it was her fault for not noting the step up . Its left her with headaches and neck problems, there is a name for it but I forget what it is, but she accepts it , again, as her problem .
Too much of this Suing going on .
I myself had a gangrene infected appendix with an abscess round it last year . Had been told it was a water infection and given tablets that may have woresened the appendix . I did not Sue . The NHS need their money .

Again this could have been a simple accident and I decry suing culture BUT damages for personal injury are NOT limited to loss of earnings as suggested above. They are in 2 broad categories PSLA (pain suffering and loss of amenity - ie for the injury itself and result of injury) and consequential losses (earnings often the bulk of this bit).

From your further posts OP I disagree with what a lot of posters have put on. I think you should try and follow it up with one of those no fee slip trip agencies but first get yourself to a dr.

Slightly off topic but this thread reminds me of my time working for a big supermarket, and how U customers can be.

Best two stories from then...

  1. The bloke who asked for a refund and compo after he drank a bottle of brandy. He said it gave him a headache and he'd never had that with competitors version.
  1. Bloke has heart attack in the bog roll aisle. Ambulance called, and folk doing CPR. We blocked off the aisle to give privacy and dignity to a guy we thought may well be dying. So, we had two customers asking us how we intended for them to buy toilet roll, and when exactly did we expect it to open again (21:30 on a Saturday, i.e. closing in 30 mins). They thought our priority should be allowing them to complete their shopping, not saving a life and affording dignity.

OP, i'm sorry you hurt yourself, but surely if you want compo, you have to have lost out, i.e. loss of earnings, medical bills etc. Even if ASDA are legally liable (and a gift card to get you to F off quietly and come back again in future with good will does not admit said liability) I highly doubt you can demonstrate any losses, other than perhaps a packet of frozen peas and a couple of paracetamol.

Personally, I don't think you have grounds to be slightly annoyed. They seemed to be doing what they could to sort out the mess. Slips happen, its not always someones fault. You wrangled a gift card. If i was the store manager I'd have given you nothing but a lecture on the dangers of ignoring warning signs.

The sign legally covers them and you would only possibly have a case if you were seriously injured... a small bruise doesn’t count.

My friend got thousands from Asda, even though she had an under lying condition.
It took about 4 years, but made a difference to her life.
She has fibro and other related conditions and fell on the plastic used to wrap milk cages. it shouldn't have been left on the floor and wasn't visible.
My friend can't walk unaided now though, so different situation.

I'm interested in what extra training would prevent this happening again.

Perhaps Asda need to invest in a Hogwarts style training scheme so when staff come across a spill they can guard it whilst summoning the equipment they need?
Or possibly telepathy training to telepathically communicate with another member of staff to get the equipment needed to clean up a spill.

Probably a cheaper and more realistic way though would be that when a staff member comes across a spill they go and get the nearest sign to warn people the spill is there, then go and get the equipment needed to clean it up.
Because it's totally unreasonable to expect someone to be in two places at once or communicate the need for cleaning materials to a colleague who's out of ear shot isn't it? Or expect miracles because you're a customer and they're a member of staff.......

Oh wait...... 🤔

People talking about sue this that and the other but do they really know what it means? Are you personally going to litigate or will you employ a high street lawyer? That will cost big money,,they love it.

Thinking of a conditional fee arrangement ? Well thats the acid test of a good case. If they think it will fly and there is an earner it it for them,they will run the case. If not,,well its probably a loser.

Incidentally i read recently of the sort of sums paid out for whiplash claims in Ireland. As usual the Brits are being mugged off. Apparently typical whiplash claims in Ireland can be of the order 15 to 20,000 euro wheres insurance cos over here mug you off with £3k ish.

As i posted previously, I do hope you went to A&e last night to document your injury for your claim, otherwise I doubt you'd be able to reasonably claim much.

If you haven't, guess you really don't have much to claim for.

Of course solicitors letters are pretty much worthless until they back them up with the initiation of legal proceedings. Do they feel lucky?

I'm sorry you've hurt yourself but really? It's just a bruise from a slip! These things happen.

You haven't broken a bone, or needed medical treatment. I doubt you would get much suing
