Parking ticket

Was on my way back from doctors appointment, 6 months pregnant having issues with low blood pressure. Felt unusually faint so pulled over by the McDonald's which is opposite subway to nip into subway for a bottle of water. Didn't realise half car was over a disabled bay. 30 seconds later whilst in subway looked out to see parking warden, so ran straight out. He told me to step away from the car to issue me a ticket so he could take pictures and ignored anything I had to say. On the ticket it says observed from 17:16 to 17:16 so less than a minute! I know it wasn't right to park in the bay but I would have been far more vigilant if I hadn't of had to pull over so quickly

Wow! Some people on this thread are beyond. My husband is a traffic warden for the council and the amount of people that disregard parking rules are insane and j live in an area that has quite a high number of times free parking bays. There are a minority who think they are above the rules and park where ever they want and lie to get out of tickets. How do you suggest to tackle this problem then? In my area traffic wardens can use their discretion to a certain degree but they can’t just believe every story they are being told is true that is why there is an appeals process. If in your area you have issue with a specific traffic warden then make a complaint about them, if there is insufficient parking speak to your council and see what they are doing to address the situation. Don’t attack traffic wardens for enforcing the rules that some people choose to ignore.

OnlyFoolsnMothers I'm not perfect, i just hate to see people getting away with free stuff that i've had to pay for. Getting caught out is not misfortune, it's justice.

Not really...vast majority of the people they are fining are working... round where I live a parking ticket is about £60 if you pay early! Over £100 if you don't...that could be someone's food shopping for the week? You know, to feed their kids.

I'm rather confused here. Nobody is forcing anyone to park illegally, get a fine and not be able to feed their kids 

It's a choice. (Generic) you choose where to park. Don't blame the enforcement team for your actions.

I agree that a pregnant woman about to faint at the wheel should pull up in the nearest safe space.

But when she starts feeling well enough to walk to a shop, notice she is about to be ticketed and rush back to argue with the traffic warden, then she's well enough to move her car first.

Certain crimes are inherently and morally wrong...murder, theft, abuse etc

Parking during restricted hours...not so much.

greendale17 so you think everyone who gets a parking ticket is a CF, you dont believe that sometimes circumstances outside their control force them to overstay their time etc- and you believe the appeal's process is 100% fair??

Hey I just know I've forked out a fortune for parking in the past, and don't like seeing people acting like the rules don't apply to them. When I say 'justice' yeah that was hyperbole. Bit like seeing the boy racer who overtook you at 100mph pulled over by police a mile up the road.

That being said, I feel a bit bad for OP. I don't think she was being a CF, just a bit slap dash. Understandable under the circumstances. Although I'd tentatively suggest that in her condition maybe being behind the wheel of a car wasn't necessarily the wisest idea?

So much bad advice regarding parking tickets on here. As advised above, get on to MSE where you can get proper advice without the moralising.

But in summary, assuming this is private land then there is nothing 'illegal' about parking across a space. (Even a disabled parking space has no special legal status in a private car park). The only reason you can be 'fined' if for breach of contract. But to enter into the contract you have to be able to review the terms of said contract. As such, there is normally a 5 minute grace period so you can check what the terms are and move away if you do not agree. If the ticket has stated that the OP was only observed for a minute then that could be deemed insufficient time for the contract to have been agreed. I'm sure if you get some proper advice they will be able to say how you should approach it and how to counter the claim. That is assuming that you can be bothered to fight it rather than just paying the 60 quid.

There is no such thing as a grace period if no ticket has been purchased as I learned recently with a ticket I had
The only grace they give is to walk from a pay2park machine and back

Was that om private land? They have to show that a contract has been formed. How are you to know what the terms are until you've had chance to read the signs?

I love traffic wardens.

I have a blue badge and the only reason I can get parked in Edinburgh city centre is because of traffic wardens doing their job.

Plus they’ve always been very helpful when we’ve been unsure where it’s okay to park (if no disabled bays) and told us where nearby proper parking is, or which yellow lines we're okay to park on.

OP, so you half parked in a normal bay and half parked in a disabled bay? So you were either so ill you didn’t realise so shouldn’t be driving or you did notice but didn’t care enough to park properly? Pay the fine.

Actually Justmarried even people with a blue badge are not allowed to stay in the car in a disabled bay. (If they're not getting out of the car then they don't need to park in a special bay)

No one should be driving if the have such low blood pressure that they feel faint. Pregnant or not.

So you think pregnant women should be allowed to risk their life, their babies life and the lives of other road users and pedestrians just because they are pregnant? Nobody should drive is there is a likelihood of fainting pregnant or not.

OP the parking ticket is a result of your own actions so need to accept the ticket at the time. Although there are other forums where people specialise in getting out of paying driving fines and parking tickets which may be worth a look

Just pay and move on. You were wrong.

Traffic wardens get yelled at and abused every day, for simply doing their jobs. Can't expect them to be happy with that. Would you be happy getting abused in your job? They don't make the rules, government does.

Exactly. The reason for the fainting is irrelevant. If you can't be reasonably sure you'll be safe driving, you shouldn't be.
