AIBU to evict my tenant?

Tenancy began last December. It seems we were at cross purposes, I thought we had agreed 40 weeks but apparently that means 42 weeks according to the tenant.
We are now nearly at 41. We share a living space and i get less and less room. They are noisy at night and wake me up so I am not sleeping well at all. I am irritable and knackered. I havent had a penny in rent which is fine as I didnt expect it but I am starting to feel put-upon.
AIBU to say this is enough and turf them out? If i'm not - how?!

Wait I'm confused they're getting to the end of their tenancy? They don't pay you rent anyway? Is this a family member? Of course you can tell them to move out but maybe give them time to find somewhere else?

you know they wont leave until theyre ready and no doubt will do it in the middle of the night leaving a big puddle when they do.....

Tenant or lodger? If they're not paying rent and never have they're just a house guest. Give them a weeks notice and offer to help them pack

They aren't your tenant if you don't have a contract and they're not paying rent. Therefore they have no right to be in your home. Ask them to leave.

Spicy curry and sex might persuade them to leave. They are a CF if they don't leave without being forced out.

Lol!! Sorry, bit slow tonight. Not had my coffee. Only thing that worked for me was induction and even that took a couple of days!!

I’ve had two tenants liked yours. The first made me ill AND overstayed to he was forcibly removed.

It took me 5 years before I felt able to engage in a similar arrangement but I got another unreasonable one who made me sick again. Luckily removal was better organised that time as we had previous experience to draw on.

I’d suggest sharing chocolate and orange juice as a sign of goodwill and allowing them to get out of their own accord. Tenants of this type rarely linger much longer as they realise there are better food sources elsewhere.

In our area even a 42 week agreement means 41 weeks 5 days max so they'll get evicted soon. :)

I had early eviction with my tenants, still felt like forever though. YANBU.

I am heartened to see other people had CF tenants. This is our first one so clearly we were naive to trust the original agreement. I have requested that they dont damage the property when they move out...

My first tenant was finally evicted via a newly installed velux window in the loft, at 42 weeks exactly.

Second tenant was much better well behaved. Left of her own volition, via the front door, after staying for 39 weeks. Left the place looking reasonably tidy, considering. 😂

Not long to go now OP!

My property was mostly unscathed - the basement remains slightly leaky but the actual door and hallway was untouched and no making-good has been required to communal areas.

I had a tenant like yours, but I sought professional counsel and fortunately the verbal threat of forcible eviction at the joint meeting was enough to persuade my tenant to move out of her own accord that evening.

My CF tenant stayed 41 weeks. When the eviction process finally started it took over 40 hours to actually get him to leave!

I had a really spicy curry and labour started a few hours later. Coincidence? Almost certainly given I was 40+4 so labour wasn't exactly a surprise. Worth a go though.
