AIBU to evict my tenant?

Tenancy began last December. It seems we were at cross purposes, I thought we had agreed 40 weeks but apparently that means 42 weeks according to the tenant.
We are now nearly at 41. We share a living space and i get less and less room. They are noisy at night and wake me up so I am not sleeping well at all. I am irritable and knackered. I havent had a penny in rent which is fine as I didnt expect it but I am starting to feel put-upon.
AIBU to say this is enough and turf them out? If i'm not - how?!

I have had two tenants like yours who seriously outstayed their welcome. The first one agreed to leave of their own volition but then took aaaaaaaaages to actually vacate. The second one had to be forcibly evicted but fortunately was quicker and I was in the bath at the time.

Sadly though, both have been problematic ever since. You would probably describe their behaviour as borderline harassment, waking me up at unreasonable hours and making outrageous demands on my time and attention.

The biggest one starts a new job school on Tuesday and I expect I will be upset. I think I’ve got Stockholm syndrome.

In my experience of a really stubborn tenant, neither the curries nor the pineapple nor the sex nor the walking sideways up the stairs worked, but once I’d scheduled an eviction the tenant decided to start moving out of their own free will a few hours before it was set to begin.

I evicted a similar tenant on Friday. Takeaways, curry, sex, all the usual tricks did nothing.

Fortunately we found help from professionals who were able to begin the eviction process the day after their tenancy ended. Only took a few hours and was relatively straightforward. Minimal damage too. I would highly recommend getting the professionals in if need be.

My one and only tenant stayed until 42+1 weeks and then the bailiffs had to drag them out. Needless to say considerable damage was done to the property as they left.

I was told that first tenents always leave late, so I was somewhat surprised when the tenant flooded my property in the middle of night two weeks before the end of their tendency. This was right over Christmas as well so as you can imagine this was incredibly inconvenient!!!! After flooding the properly the tenent refused to leave and was served an eviction notice. However, they refused to leave so I had to get the bailiffs in and they caused a considerable amount of damage during the eviction!

I thought I was so clever with my last tenant. I got an order in place to have them evicted via the roof, 6 days before their official leaving date. It was going to be so calm, unlike previous evictions. What did this tenant do? Decide they had to leave the day before! Did still manage to get the roof eviction but it was no quite as calmly as planned.

I've had two tenants like this.
The first was very well behaved, up until his tenancy was up. Couldn't shift him. Had to get a bailiff in with a pair of barbecue tongs to get him out. Caused some damage to the door.
Tenant number two was awful. Caused all sorts of problems. I had leaks, property damage, all night parties, it left me rather sick. Literally.
In the end he caused a significant flood and then refused to leave when asked. Ended up being dragged out via the roof, all the time protesting that it was a month early. You caused the flood mate, you're no longer welcome chez womb.
He left behind all sorts of muck that required a serious clean up in the form of IV antibiotics. Since then I have remained happily tenant free.

My first tenant overstayed a little bit (41 weeks) but left in the morning before eviction was planned and straight away was met by a company of visiting students.

Mine had to be evicted at 42 weeks, with the notice delivered via pessary. Mind you, once he got the eviction notice he didn't hang about too long!

Mine signed up for 40 but left way earlier than that. I’d much rather they’d stayed as per our agreement!

My CF tenant made it to almost 43 weeks!! Threat of induction seemed to work, and she was born on my grandmother’s birthday so maybe it was meant to be.

I’m so sorry but I’m cackling at the “did you not have a tenancy agreement?” type comments. Almost as much as the brilliant “noisy sex in communal areas”

My first tenant (and I was very wary about the 2nd one but she was ok) left the property a week late after spreading the walls liberally with shit (maybe he was 19 years early with the Dulux Honey Spice trend?)

Ultimately , the Uniformed Personel who were over-seeing the eviction were more concerned about him and left me covered in my own piss'n'vomit surveying the dtate of destruction as they hastily repaied the damage.

Thankfully I have a great relationship with tenant 1 and 2.
Though tenant 1 keeps reminding me it was MY choice to let him live there and evict him, so I need to pay him regular maintenance .

Try bouncing on a ball. The constant movement may irritate them enough for them to want out.

My front door hasn't been the same since the last tenant left.
My DH suggested we just use the back door in future but I'm having none of that!

YABU. The tenancy did not in fact start until 2 weeks after you claim it did. Your tenant is merely exerting their right to the full 40 weeks occupancy.

My mother evicted me using a mixture of caster oil and orange juice! It was much faster than she expected

Both my previous tenants refused to leave through the door so they had to be dragged out through the roof. Hope you manage to get the evicted quickly and smoothly as possible and don't need too much intervention!
