Bathroom comes with the house??!!

So DH and I have just bought a new house (not brand new but new to us :)) and it cost us a lot of money (far more than a care to admit! :))
We moved in yesterday, the house is perfect except for one thing...

They've taken the bloody bathroom with them!!!!

One of the two main bathrooms upstairs is literally empty, like I don't mean just the furniture which you obviously take with you. But they've taken the bath, sink and shower!!!!

The room is tiled but theres random pipes sticking out of walls where these things should be!! The only thing left is the toilet. I honestly don't know what to do... We were going to redo the bathroom anyway at some point but never told this to anybody and weren't planning to do so until at least November/December time but now we don't have a choice!!

The kids come home from the holiday with my in-laws on Tuesday and we've got no bathroom for them!!!!

AIBU to think that the bathroom comes with the house, or is it totally reasonable to take the bathroom with you to your new house??!!

Back to solicitors. They have to pay for it to be refitted. A bathroom is part of the house. Yes to maybe the washing machine being removed but the bath and sink...come on they mad. They have to pay for a new one. Solicitors as they in breach of contact.

Where the vendors living in the house themselves, or did they have tenants?

Have a look at the property information report. It should state in there what is fixed or not and what they are leaving.

Section 3 of the law society fitting and contents form lists the bathroom items. The seller indicates whether, for example, the Bath is fitted and whether or not it is included in the sale. That will form part of the contract. Look there first.

I think it's more that they don't realise they need to be completely out on completion day. They don't see the issue with taking their time, maybe leaving a few bits of furniture there to be collected in due course.

@DontCallMeCharlotte - the other bathroom upstairs would be fine for us, but not the kids there's no bath and there only 1 and 3... we can make it work though :)

@HRHPrincessMegan I don't think we fell out with them... they were a little odd, being very very determined that we had to move in on the Saturday, they didn't want to wait until the Monday. They had to be out on Friday and us in on Saturday. but we never had an argument or anything!!! :)

How could they tell you when you had to move in? On completion they have to be out; what you do with the house that’s now legally yours is no concern of theirs... Hmm
You sound worrying misinformed yourself, op.
Have you read the fixtures and fittings list yet??

DH has got the fixtures and fittings form, includes all of the bathroom fixtures that are no longer there...

At first I was furious but now thinking about it, it is slightly amusing... and at least we might get a new bathroom out of it!!! :)

It's called moving house for a reason. It involves moving the house. Many people assume it just means gathering your belongings and relocating them to a different house - this is incorrect. When moving house the house must be moved - the people just taking personal effects are doing it wrong.

It’s not good news that they’ve moved abroad, that might make it much more difficult to sue them for costs. See what your solicitor advises.

In the meantime see if you can buy a small, inflatable baby bath that you could use on the floor of the shower.

Threads like this make me think our solicitor was particularly amazing. She went through everything with a fine toothed comb, flagged up issues we would have had no idea about and made sure we got the best deal possible. How is this not the norm?!

I bought a flat from someone who didn't understand he had to move out when we completed and exchanged on the same day. I turned up with my van and removal men 2 hours later. He hadn't packed a thing. I was livid. It cost me another £200+ to pay the movers to stick around another 4 hours while he threw everything in black bags. The flat was filthy, he took the light bulbs, the bedroom carpet, and it turned out he'd painted around the paintings on the walls so the place was a shit hole. I was 24 and totally out of my depth.

Insisting the move happen on a Saturday smacks of buying themselves time to flit abroad before you can contact their solicitor and your own, frankly. I’d be worried about this. Getting the money for a new bathroom may be an uphill struggle. What dicks.

The standard definition of F & F is to imagine it as a dolls house , pick it up, and turn it upside down.
If it doesn't fall out it it's part of the F & F's, unless clearly stated
otherwise.

It's on your list, so they will have to make amends.

  1. Read the list of fixtures and fittings that the seller will have filled in. If they have said they are taking the bath etc then they are within rights to take it (although ridiculous in my view!)
  1. Call your solicitor first things Monday.
