to be pissed off that I'm being charged for the snow days

Children's nursery closed for the 2 snow days a couple of weeks ago and nursery have made the decision to charge for those days.

I feel really pissed off as I had to take unpaid leave + make time back in lieu.

I have two under three so it's not bloody cheap either!!

Apart from this I couldn't be happier with them. It's a wonderful nursery. They're worth every penny we pay them but I'm really naffed off they charged for this!

I'm being unreasonable, aren't I?

I'd be more pissed off with your employer, who has really screwed you over.

StealthPolarBear · 21/03/2018 18:52

"Mum2oneStepmum2two

There’s no way they didn’t pay their staff if they chose to close, by the way - that would be against the law!"
Is it also against the law for ops employer not to pay her then?

Ginger1982 · 21/03/2018 18:54

Not the same thing I know but I didn't pay my dog walker for the snow days because they didn't provide the service. Check your contract but I would argue the toss.

Treacletoots · 21/03/2018 18:55

It's pretty standard for nursery contracts that you pay for your place not the exact hours you have your children there (if different to agreed). Sadly the snow is out of everyone's control so they're not being unreasonable. You do have every right to be a bit miffed though, at the snow...

Icanttakemuchmore · 21/03/2018 18:57

Mum2oneStepmum2two it isn't against the law. I work for the government and If they chose to, they could force us to use unpaid, or paid leave from our leave quota if staff couldn't get in because of the snow.

Coloursthatweremyjoy · 21/03/2018 18:58

I work in a pre school. We don't get paid for snow days.

What does your contract say?

colleysmill · 21/03/2018 19:00

I had this too. Contract says it's at buraerys discretion. Some parents complained and we all received a very aggressive email saying that because of the complaints they would not be refunding anything.

And this is a big local chain of nurseries whose main business is in part of the family home

colleysmill · 21/03/2018 19:02

Im tempted to challene it but I challenged them last year over fee rises for which the notice given was 4 days and the contract stated 4 weeks. Not sure I can do it again!

laurzj82 · 21/03/2018 19:03

DD's nursery didn't charge us for snow days

Jon66 · 21/03/2018 19:05

No, unless it is in the terms and conditions they cannot charge for a service they failed to deliver. Particularly as you would not be paid for those days unless you have a very sympathetic boss.

Lizzie48 · 21/03/2018 19:09

This is tricky. We never faced this thankfully when my DDs were in nursery, as they're in school now and I'm a SAHM, it didn't affect me.

I'm not sure we'd have made an issue of it, though, tbh.

PistFump · 21/03/2018 19:09

Hmm that's an interesting one. I would expect a business to have a contingency in place (e.g insurance or savings) to pay for days they decide to close, including snow days.

Allyg1185 · 21/03/2018 19:14

I work in a private nursery and its in the contract that parents will still be charged. Unfortunate and as a parent myself i know how frustrating it is

caringcarer · 21/03/2018 19:18

Stagecoach singing, dance and drama cancelled due to snow but are running a six hour session this Saturday to make up for three hours lost. Nursery should offer OP child extra sessions to make up time.

topcat2014 · 21/03/2018 19:22

It all comes down to the contract.
I love it when MN comes over all on 'fairness
Business is nothing about being 'fair'.

If the nursery hasn't got that in it's terms then no payment is due.

I don't pay Tesco on the days I shop at Aldi, and this should be no different.

Teeniemiff · 21/03/2018 19:25

Check your contract but our Nursery we don’t pay for days they close- eg bank holidays & they shut for a week over Xmas.
I think if they made the decision to close they shouldn’t charge.
Others saying staff would be annoyed not to be paid, what about other business that won’t pay their staff (like OP) ? Why would that be different if it was a Nursery?
It’s dufferebt if you chose not to go or couldn’t get there but doesn’t sound like that was the case. I’m guessing Nursery knows that it may have meant many parents were unable to work without child care so likely parents may not have been paid. So to then expect you to pay them I think is unreasonable.

Iflyaway · 21/03/2018 19:29

Yes, shit happens.

The snow doesn't stop the rent, heating, council taxes, salaries, etc.

I had to pay during the summer holidays too. But bills have to be paid as well by the staff (rent etc.), and I have to pay my rent/mortgage, utilities also when I go on holiday too. It's life.

FaveNumberIs2 · 21/03/2018 19:29

I would be questioning your HR department as to why you had to take unpaid leave AND repay the time in lieu.

Do you pay twice for your groceries?

Unfortunately, staff do still have to be paid, especially if they turn up for work.

I’m in a similar boat as the nursesry staff, I turned up for work on time and was sent home for three days because the business was closed, I did not make the decision to close, so why shouldn’t I be paid for those days?

KittenBeast · 21/03/2018 19:32

My son's nursery closed and I did not have to pay. Because he was not there, and nor were any of the staff. Why tf should she have to pay? Confused

StealthPolarBear · 21/03/2018 19:33

Fave she made up the time for a day and a half and took half a day unpaid, is my understanding

ssd · 21/03/2018 19:41

my workplace shut and I didnt get paid (but I'm in a shit job)

op, I don't think you should have to pay if the place was shut, at the very least I'd question it

Slarti · 21/03/2018 20:19

How has the nursery 'won?'

@Flobella put simply they receive payment for a service without providing it.

Suzielou66 · 21/03/2018 20:26

You are definitely not being unreasonable. If you had tried to take your children to the nursery to take advantage of the service you had paid there would have been no one there to provide the service. No service-No charge. I would refuse to pay. Never heard of anything so ridiculous. They can’t charge for days when they choose to close.
Why are you taking unpaid leave if they expect you to make up the time later? If you aren’t being paid for the time why should you work that time later? Doesn’t make sense. You only have to make up the time if it’s paid leave.

CottonSock · 21/03/2018 20:28

Ours is refunding parents

KnackeredMumofTwins · 21/03/2018 21:30

I've to pay the nursery and after school club for the week they were closed, close to £210. I work for the council who also sent staff home and been told I've to take annual leave, make the time up or tale unpaid dependant leave. I've not enough annual leave to cover school holidays as it is, to make the time up I'd need to work extra days incurring more nursery and after school club fees or I just accept the loss of wages and pay the fees. It's definitely not a win for me. There must be a better solution.
