To be a bit off about M&S taking back my free dress?

I bought several items in the M&S sale. Couple of things didn't fit stupid sizing so I returned them for a refund. The sales assistant couldn't find one item on my receipt and said I could only have a credit note. I knew it was the correct receipt and I wanted a refund so she took me to customer services. We went through each item on the receipt to try and identify which one it was as it was just not scanning as any of the receipt items. Turns out I hadn't paid for it Shock. I had had no idea when i bought it as i just threw the pile on the counter, and paid when asked. I hadn't counted what was scanned or checked my receipt. Who does! It seemed that the original sales assistant had missed scanning or charging for the item.

So, there we were at the customer services desk, with me trying to return a dress I had never paid for, though i hadn't known that at the time. The sales assistant said they had to keep the dress and there would be no refund or exchange and they would out it back out for sale. I accepted that I should no longer be asking for a refund because it wouldn't be right since I hadn't paid for it in the first place. I did ask him if he could at least put the dress in the Oxfam box by the desk (M&S have a charity clothing collection scheme). Since the shop had already lost the dress through its own incompetence so it didnt seem right that it should profit from me bringing it back. He said he would ask his manager but I knew he wouldn't and it was a fob off.

I left the store feeling a bit off. If I hadn't brought it back then i could have ebayed it or given it to charity shop or waited til i slimmed into it. I lost myself a free dress!!! Ok ok I know that would be wrong and I'm honest as the day.

Has anyone else had this happen to them or have got unexpected free stuff?? Cheer me up!! and share some of your windfall with me

So YOU didn't do the right thing, OP. The sales assistant kept the dress, you didn't willingly leave it. And now you're saying you were only talking 'technically' about legal ownership? You're a deluded fool. And yes, I do have morals (which you seem to think is a dirty word) and I don't keep what isn't mine.

And you're laughing and enjoying this so much, yet wish you hadn't posted in AIBU? Riiiiiiihht.

I imagine you're the type of person who borrows a tenner from a friend and 'forgets' to give it back.

Have you ever put something on top of your stroller, a pack of nappies or something and not realised until you've got home that they are still there and you didn't pay.
Would you say that they are now yours because you made it out of the store without anyone noticing and you hadn't realised?
The dress was never yours op.

OP, you did ask posters their opinion - it's sort of the whole point of AIBU so it's a bit ridiculous to get stroppy and indignant when posters do give their opinion...

I also can't see why you are annoyed. I'd have just handed it back when I realised I hadn't paid for it. 🤷🏻‍♀️ I wouldn't have given it anymore thought.

I agree. And I certainly wouldn't have got stroppy, demanding the dress was MY property. In fact, I would have been embarrassed and apologetic, and would have hoped they didn't think I'd nicked it!

I think the only reason I would be a bit upset as I walked away would be if at the back of my mind there was a slight chance there was a forgotten receipt at home with the item on.

I think some of you hiphopcat are getting a bit overinvested in this!

I wasn't dishonest and it's unfair to keep saying I was to those who are. I insisted that I hadn't bought it on another day on another receipt because that was the truth. I wouldn't even have accepted a credit note let alone a refund once I knew i hadnt paid for it in the first place. And I'm not annoyed! Just maybe a teensy tiny bit miffed that I had to go through the whole rigmarole, a 15 mile round trip and waste time in the shop (a food 20 mins sorting this out) when the whole thing was not my fault. They did apologise profusely to me, though I did wonder/worry if they thought I was trying to pull a fast one, but if i were then I would have accepted the credit note and run, not stayed to get a refund in the knowledge the dress wasn't on the receipt.

I never said the shop stole my dress. That would require dishonest intent. They did keep it though!!

So, a genuine question esp to the Moral Beryls out there (yes they do look like the above pic in my imagination Wink ): If you checked your receipt when you got home and discovered the dress wasn't on it, therefore not paid for (not deliberately stolen), would you march straight back to the shop and hand it in sheepishly, or would you keep it/eBay it/ give to charity?

C'mon. Honest replies! (Pun intended)

I do wonder what on earth I was thinking though when I selected it. Must have been lured in by the sale prices!

It was all very polite and courteous (its M&S don't you know!). No stropping by anyone. Just in case people are imagining a whole showdown of remonstrations in store.
